116 STAT. 2644 PUBLIC LAW 107-314—DEC. 2, 2002 defense committees, the Select Committee on Intelligence of the Senate, and the Permanent Select Committee on Intelligence of the House of Representatives a report on the research and development, procurement, and other activities undertaken during the preceding fiscal year by the Department of Defense, the Department of Energy, and the intelligence community to develop weapons to defeat hardened and deeply buried targets. (b) REPORT ELEMENTS.— The report for a fiscal year under subsection (a) shall— (1) include a discussion of the integration and interoperability of the activities referred to in that subsection that were undertaken during that fiscal year, including a discussion of the relevance of such activities to applicable recommendations by the Chairman of the Joint Chiefs of Staff, assisted under section 181(b) of title 10, United States Code, by the Joint Requirements Oversight Council; and (2) set forth separately a description of the activities referred to in that subsection, if any, that were undertaken during such fiscal year by each element of— (A) the Department of Defense; (B) the Department of Energy; and (C) the intelligence community. (c) DEFINITION. —In this section, the term "intelligence community' has the meaning given such term in section 3(4) of the National Security Act of 1947 (50 U.S.C. 401a(4)). (d) TERMINATION.— No report is required under this section after the submission of the report that is due on April 1, 2007. SEC. 1033. REPORT ON EFFECTS OF NUCLEAR EARTH-PENETRATOR WEAPON AND OTHER WEAPONS. (a) NATIONAL ACADEMY OF SCIENCES STUDY. —The Secretary of Defense shall request the National Academy of Sciences to conduct a study and prepare a report on the following: (1) The anticipated short-term effects and long-term effects of the use by the United States of a nuclear earth-penetrator weapon on the target area, including the effects on civilian populations in proximity to the target area at the time of or after such use and the effects on United States military personnel who after such use carry out operations or battle damage assessments in the target area. (2) The anticipated short-term and long-term effects on civilian population in proximity to a target area— (A) if a non-penetrating nuclear weapon is used to attack a hard or deeply-buried target; and (B) if a conventional high-explosive weapon is used to attack an adversary's facilities for storage or production of weapons of mass destruction and, as a result of such attack, radioactive, nuclear, biological, or chemical weapons materials, agents, or other contaminants are released or spread into populated areas. Deadline. (b) REPORT. —Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit to Congress the report under subsection (a), together with any comments the Secretary may consider appropriate on the report. The report shall be submitted in unclassified form to the maximum extent possible, with a classified annex if needed.
