THE COPYRIGHT (AMENDMENT) ACT, 1983

An Act to amend the Copyright Act, 1957.

Be it enacted by Parliament in the Thirty-fourth Year of the Republic of India as follows:—

Short title and commencement 1. (1) This Act may be called the Copyright (Amendment) Act 1983.

(2) It shall come into force on such date^[1] as the Central Government may, by notification in the Official Gazette, appoint.

Substitution of expression “radio-diffusion” by expression “broadcast”. 2. Throughout the Copyright Act, 195714 of 1957. (hereinafter referred to as the principal Act), unless otherwise expressly provided, for the word “radio-diffusion”, wherever it occurs, the word “broadcast” shall be substituted.

Amendment of section 2. 3. In section 2 of the principal Act,—

(a) after clause (d), the following clause shall be inserted, namely:—

‘(dd) “broadcast” means communication to the public—

(i) by any means of wireless diffusion, whether in any one or more of the forms of signs, sounds or visual images; or

(ii) by wire,

and includes a re-broadcast’;

(b) after clause (f), the following clause shall be inserted, namely:—

‘(ff) “communication to the public” means communication to the public in whatever manner, including communication through satellite;’;

(c) for clause (l), the following clause shall be substituted, namely:—

‘(l) “Indian work” means a literary, dramatic or musical work,—

(i) the author of which is a citizen of India; or

(ii) which is first published in India; or

(iii) the author of which, in the case of an unpublished work, is, at the time of the making of the work, a citizen of India;’;

(d) clause (v) shall be omitted.
