Trial of buglaries at quarter sessions1.—(1.) A court of quarter sessions shall, notwithstanding Trial of anything in the Quarter Sessions Act, 1842, hive jurisdiction to try a person charged with burglary.
(2.) A justice of the peace when committing for trial a person charged with burglary shall, nevertheless, commit him for trial before a court of assize unless, owing to the absence of any circumstances which make the case a grave or difficult one, he thinks it expedient, in the interests of justice, to commit him for trial before a court of quarter sessions; and the Assizes Relief 52 & 53 Vict Act, 1889 52 & 53 Vict c.12, shall apply.
Short title2.— (1.) This Act of the session of the fifth and sixth years of short title, the reign of Her present Majesty, chapter thirty-eight, intituled " An Act to define the jurisdiction of justices in general and quarter sessions of the peace," is in this Act referred to, and may be cited, as the Quarter Sessions Act, 1842.5 & 6 Vict. c. 38.
(2.) This Act may be cited as the Burglary Act, 1896.
Extent of Act3. This Act shall not apply to Scotland or Ireland.
CHAPTER 58.
WHEREAS by the West Highland Raiway Act, 1894 57 & 58 Vict. c. clvi, the West Highland Railway Company were authorised to construct an extension of their railway from Banavie to Mallaig (in this Act called the railway), with a pier and ether works in connexion therewith, and to raise the necessary capital for that purpose, and by section fifty-two of the Act certain provisions were to take effect in the event of the Treasury being authorised to guarantee and guaranteeing, for a period of thirty years from the date of the opening for passenger traffic of the railway, the payment of interest or dividend at the rate of three pounds per centum per annum on two hundred and sixty thousand pounds of the share and loan capital to be raised under the Act, and granting a sum of thirty thousand pounds towards the cost of constructing the pier, breakwater, and other works by the Act authorised, and it is expedient that the Treasury be authorised to give such guarantee and make such grant:
Be it therefore enacted by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:
