C. ■$. for farther IT is provided alfo and agreed, That if any Man be attainted of Diffeifin done in the Time of the King that now is, with Robbery of any Manner of Goods or Moveables, * and be found againjl him by Recognifance of Affile of Novel diffeifin, the Judge- ment fhall be fuch ; that the Plaintiff fhall recover his Seifin and his Damages, as well of the Goods and Moveables aforefaid, as for the Freehold, (2) and the Diffeifor fhall make Fine, which, whether he be pre- fent or not (* fo it be prefented) fhall firft be award- ed to Prifon. (3) And in like Manner it fhall be done of Diffeifin with Force and Arms, although there be no Robbery.' Cotton MS.
