XL A feigned Recovery againft him in the Reverfion, to make the Termor Iofe his Term. T is provided alfo, That if any Man leafe his Te- nement in the City of London, for Term of Years, and he to whom the Freehold belongeth, caufeth himfelf to be impleaded by Collufion, and maketh Default after Default, or cometh into the Court, and giveth it up, for to make the Termor lofe his Term, and the Demandant hath his Suit, fo that the Termor may recover by Writ of Covenant : (2) The Mayor and Bailiffs may inquire by a good Inqueft, in the Prefence of the Termor and the Demandant, whe- ther the Demandant moved his Plea upon good Right that he had, or by Collufion, or by Fraud, to make the Termor lofe his Term : (3) And if it befound by the Inqueft, that the Demandant moved his Plea upon good Right that he had, the Judgment fhall be given forthwith : (4) And if it be found by Inqueft, that he impleaded him by Fraud, to put the Termor from his Term, then * fhall the Termor enjoy his Ter?n, and the Execution of Judgement for the Demandant Jhall be fufpended until the Term be expired. (5) And in like Manner it fhall be of Equity before the Juf- tices in fuch Cafe, if the Termor do challenge it be- fore the Judgement.' CAP. T is provided alfo, That if a Man, impleaded for a Tenement in the fame City, doth vouch a Fo- reigner to Warranty, that he fhall come into the Chancery, and have a Writ to fummon his Warran- tor at a certain Day before the Juftices of the Bench, and another Writ to the Mayor and Bailiffs of Lon- don, that they fhall furceafe in the Matter that is be- fore them by Writ, until the Plea of the Warranty be determined before the Juftices of the Bench : (2) And when the Plea at the Bench fhall be determined, then fhall he that is vouched be commanded to go into the City, to anfwer unto the chief Plea. (3) And a Writ fhall be awarded at the Suit of the Demandant by the Juftices unto the Mayor and Bailiffs, that they fhall proceed in the Plea.
