Moreover, we provide, That all Debts, where- unto the Sheriffs make Return, that the Debtors have nothing in their Bailiwicks, ne had not at fuch Time as they were charged with the fame Debts, or that the Debtors be not found, that the fame Debts fhall be eftreated in Rolls, and the fame Rolls to be deli- vered unto faithful and circumfpe£t Men, which fhall make Inquiry thereof after fuch Form as fhall be provided by the Treafurer and Barons. ' XL But for fo much as certain Pleas were hereto- fore holden in the Exchequer, which did not con- cern us nor our Minifters of the Exchequer, where- by as well our Pleas, as the Caufes of our People, are unduly prorogued and letted; (z) we will and or- dain, That no Plea fhall be holden or pleaded in the Exchequer aforefaid, unlefs it do fpecially concern us and our Minifters aforefaid. F ^Orafmuch as Merchants, which heretofore have lent their Goods to divers Perfons, be- greatly impoverifhed, becaufe there is no fpee- " dy Law provided for them to have Recovery of " their Debts at the Day of Payment affigned ; (2) " and by reafon hereof many Merchants have with-

  • ' drawn to come into this Realm with their Merchan-
    • dizes, to the Damage as well of the Merchants, as

" of the whole Realm;" ' (3) the King by him- 4 felf and by his Council hath ordained and eftablifhed,

  • that the Merchant which will be fure of his Debt,

' fhall caufe his Debtor to come before the Mayor of ' London, or of York, or Briftol, or before the Mayor 4 and a Clerk (which the King fhall appoint for the ' fame) for to knowledge the Debt and the Day of

  • Payment; (4) and the Recognifance fhall be entered
  • into a Roll with the Hand of the faid Clerk, which

' fhall be known. (;) Moreover, the faid Clerk fhall

  • make with his own Hand a Bill obligatory, where-

1 unto the Seal of the Debtor fhall be put, with the ' King's Seal, that fhall be provided for the fame Pur-

  • pofe, the which Seal fhall remain in the keeping of

' the Mayor and Clerk aforefaid : (6) And if the ' Debtor doth not pay at the Day to him limited, the ' Creditor may come before the faid Mayor and Clerk
