The Penalties inflifted by the Statute of 28 EJ. 3. c. 10. upon the Mayor ot Lomsn, /hall be according to Che Dlfctetion of the Jaiiices.
- Procefs fhall be made by Attachments, Diftrefs, and
' Exigent, if Need be, fo that at the King's Suit the ' Exigent fhall be awarded after the firfr. Capias re- ' turned, and at the third Capias returned at the Suit ' of the Party. (10) And if the Mayor, Sheriffs, and ' Aldermen have Lands and Tenements out of the 1 laid City, Procefs fhall be made againft them by At-

- laid Mayor, Sheriff's, and Aldermen, which cometh

- this Ordinance fhall extend to other Cities and Bo-

- priiions beufed, and not duly corrected nor redreffed,
- laving that the Inquefts be taken by * foreign People
of the fame County where fuch Cities and Boroughs be; (13) and that the Penalty of them of fuch Ci- ties, Boroughs, and Towns which fhall be thereof attainted, be judged by the Difcretion of the Ju- ftices, which fhall be thereto affigned." ' (14) Our Lord the King confidering the good and lawful Be- haviour of the Mayor, Sheriffs, and Aldermen, and- of all the Commonalty of the fame City of London towards him, and therefore willing to eafe and miti- gate the Penalty aforefaid, by the Affent of the Lords Spiritual and Temporal, and of the Commons afore- faid, hath ordained and eftablifhed, That the Penalty aforefaid, as well of the thoufand Marks, as of the two thoufand Marks, and of the Seizure of the Franchife, comprifed in the faid Statute, fhall not be limited in a Certainty, but that the Penalty in this Cafe be'by the Advice and Difcretion of the Juftices thereto affigned, as other Cities and Boroughs be within the Realm, and that the Remnant of the fame Statute, and the Procefs thereof, ftand in their Force.'
