By i Ann. fiat, or Four of them at the leaft, whereof One to be of the Riorum; (z) and at and upon the Appearances of 1. _c. is. Seflions (" ucn Conftables or Inhabitants the faid Juftiees of Peace, or Four of them, whereof One to be of the Quo- taxhe fc "raT' 3 ' rum -> w ' tn the Affent of the faid Conftables cr Inhabitants, fhall have Power and Authority to tax and fet Townfiiips, &c every Inhabitant in any fuch City, Town, or Parifh within the Limits of their Commiflions and Authori- ties, to fuch reafonable Aid and Sum of Money, as they fhall think by their Difcretions convenient and fufficient for the repairing, re-edifying, and Amendment of fuch Bridges; (3) and after fuch Taxation made, the faid Juftices fhali caiife the Names and Sums of every particular Perlbn fo by them taxed, to be Two Collectors written in a Roll indented : (4) And fhall alfo have Power and Authority to make Two Collectors of every of every Hun- Hundred, for Collection of all fuch Sums of Money by them fet and taxed; which Collectors, receiving the one Part of the faid Roll indented under the Seals of the faid Juftices, fhall have Power and Authority to collect and receive all the particular Sums of Money therein contained, and to diftrain every fuch Inha<- bitant as fhall be taxed and refufe Payment thereof, in his Lands, Goods, and Chatties, and to fell fuch Diftrefs, and of the Sale thereof retain and perceive all the Money taxed, and the Refidue (if the Diftrefs TheTulUcesihall ^ e better) to deliver to the Owner thereof; (5) and that the fame Juftices, or Four of them, within the appoint two who Limits of their Commiflions and Authorities, fhall alfo have Power and Authority to name and appoint Two ftall repair the Surveyors, which fhall fee every fuch decayed Bridge repaired and amended from time to time, as often as Need fhall require, to whofe Hands the faid Collectors fhall pay the faid Sums of Money taxed, and by them received; (6) and that the Collectors and Surveyors, and every of them, and their Executors and Ad- miniftrators, and the Executors and Adminiftrators of them, and every of them, from time to time, fhall make a true Declaration and Accompt to the Juftices of Peace of the Shire, Riding, City or Town Corpo- rate, wherein they fhall be appointed Collectors or Surveyors, or to Four of the fame Juftices, whereof One to be of the Quorum, of the Receips, Payments, and Expences of the faid Sums of Money: (7) And if they or any of them refufe that to do, that then the fame Juftices of Peace, or Four of them, from time to time, by their Difcretion;, fhall have Power and Authority to make Procefs againft the faid Collectors and Sur- veyors, and every of them, their Executors and Adminiftrators, and the Executors and Adminiftrators of every of them, by Attachments under their Seals, returnable at the General Seflions of Peace, (8) and if they appear, then to compel them to account as is afore faid; or elfe if they or any of them refufe that to do, then to commit fuch of them as fhall refufe, to Ward, there to. remain without Bail or Mainprize, till the faid Declaration and Accompt be truly made. V. And where any Bridge or Bridges lien in One Shire or Riding, and fuch Perfons Inhabitants, Bodies Politick, Lands, or Tenements, which owen to be charged to the making and amending of fuch Bridges, lien and abiden in another Shire or Riding, or where fuch Bridges been within any City or Town Corporate, and the Perfons Inhabitants, Bodies Politick, Lands, or Tenements, that owen to make or repair any fuch Bridges, lien and been out of the faid Cities and Towns Corporate; be it enacted, That in every fuch Cafe the Juftices of Peace of the Shire, City or Town Corporate, within the which fuch decayed Bridges, or -any Part thereof fhall happen to be, fhall have Power to enquire, hear, and determine all fuch Annoyances, be- ing within the Limits of their Commiflions or Authorities; (2) and if the Annoyance be prefented, then to make Procefs into every Shire within this Realm, againft fuch as owen to make or amend any fuch Bridges fo prefented before them to be decayed, to the Annoyance and Let of the Paftage of the King's Subjects, and to do further in every Behalf in every fuch Cafe, as they might do by Authority of this Act, in cafe that the Perfons or Bodies Politick, Lands, or Tenements, which owen to be charged to the amending or making of fuch Bridges, or any Part thereof, were in the fame Shire, Riding, City, or Town Corporate, where fuch Annoyance fhall happen to be. (3) And that all Sheriffs, and Bailiffs of Liberties and Franchifes, fhall truly ferve and execute fuch Procefs, as fhall come to their Hands from the faid Juftices of Peace afore whom any Prefentment fhall be had for any fuch Annoyance, according to the Tenour and Effect of the faid Procefs to them directed, without Favour, Affection, or Corruption, upon Pain to make fuch Fine, as fhall be fet upon them or any of them by the Difcretion of the faid Juftices. VI. Provided alway, That this Act, or any Thing therein contained, be not prejudicial to the Liberties of the Five Ports, or Members of the fame. And for Reformation of Annoyances of Bridges within the faid Ports and Members. VII. Be it enacted by Authority of this prefent Parliament, That the Warden, Mayors, and Bailiffs elected, and Ju rates of the fam ■, Ports, and every of them, have Power and Authority to inquire, hear, and determine all Manner of common Annoyances of Bridges within the fame Ports and Members, and to make fuch Procefs, Pains, Taxations, and all other Things within the fame Ports and Members, as the Juftices of Peace may do in other Shires or Places out of the fame Ports, by Virtue and Authority of this prefent Act in every Behalf. VIII. And be it further enacted by the Authority aforefaid, That the Juftices of Peace, or Four of them, fhall have full Power and Authority to allow fuch reafonable Cofts and Charges to the faid Surveyors and Collectors, as by their Difcretions fhall be thought convenient. IX. Forafmuch that albeit Bridges decayed were amended and repaired according to the Tenor of this ' Act, yet neverthelefs, if fpeedy Remedy for the Amendment of the Ways next adjoining to every of the Ends of fuch Bridges mould not be had and made, the King's Subjects fhould take little or none Avail or ' Commodity in many Parts of this Realm by the making of the Bridges :' (2) In Confideration whereof, be it enacted by the King our Sovereign Lord, and the Lords Spiritual and Temporal, and the Commons, in this prefent Parliament affembled, and by Authority of the fame, That fuch Part and Portion of the Highways in every Part of this Realm, as well within Franchife as without, as He next adjoining to the Ends of any Bridges within this Realm, diftant from any of the faid Ends by the Space of Three hundred Foot, be made, repaired, and amended as often as Need fhall require; (3) and that the Juftices of the Peace ill every Shire of this Realm, Franchife, City, or Borough, or Four of them at the leaft, whereof One to be of the Quorum, within the Limits of their Commiflions and Authorities, -fhall have Power and Authority 3 to The JuUices may make Pro cefs into every Shire againft Offenders.
