And it is further enacted by the Authority aforclaid, That if any Perfon or Perfons fhall happen to TherefliaP.be be fucd, accufed, indicated, imprifoned, amerced, condemned or otherwife vexed or troubled in his Perfon, no Penalty i.-i- Lands, Tin Works, Goods or Chattels, by any of the Minifters or Officers of any of the King's Courts of fi '^ lery, or by any other Perfon or Perfons, for purfuing or attempting any Suit or Action according to totMiStaiuee!'* this Eftatute, againft fnch Perfon or Perfotis as fhall offend contrary to the Form aforefaid ; that then all filch Suits, Acculements, ndictrhents, Imprifonments, Actions, Condemnations, Fines, Amerciaments, and every other AA or Acts to be done in any of the faid Courts of Stannery, or elfewhere, by any Periba or Perfons againft any Perfon or Perfons forfuing or attempting any Suits or Actions by Virtue of this E- ftatute, fliall be utterly void and of none Effect in the Law ; (z) and that the Party fued, indicated, accufed, imprifoned or otherwife grieved or molefted, for purfuing againft any Perfon or Perfons offending this Sta- tute, fhall hav< his Action and Remedy grounded upon this Statute, by original Writ, Bill, Plaint, Infor- , motion or> herwife, in any of the King's Courts, againft fuch as fhall procure or attempt to vex, trouble or otherv.il moleft any fuch Perfon or Perfons for fuing or purfuing of the Forfeitures aforefaid, and fhall recover treble Damages in that Behalf; and the Party Defendant fhall not be admitted to wage his Law, ne i any Protection, . iloin nor Privilege fhall be to him allowable. And if it fliall happen any Perfon or Perfons, for purfuing any Suit or Action upon this Statute, or A R«n"|yto by Occafion of the fame, hereafter to be imprifoned by any manner of Perfon or Perfons being Officers or 'Jj}^'? h ' m thlt Minifters of the Court of Stannery, their Deputies or Subftitutes, that then every of the Juftices of Peace f crc< j foMuilig ■within any of the Counties aforefaid, wherein the faid Prifoner fliall happen to be committed to Prifon, according to thi» upon credible Information thereof, taking Surety by his Difcretion for Appearance of fuch' Prifoner at the Statute; next General Seffions of Peace, fhall have Power and Authority as well to direct his Warrant to the Gaoler or Keeper of the Prifon, as to any other Perfon or Perfons to whom the faid Prifoner fhall be committed unto, commanding him or them, upon Pain of Forfeiture of.v/. //. to deliver and put at large the faid Pri- > foner or Prifoners, (2) which if he refufe fo to do, then every fuch Offender fhall lofe and forfeit the faid j x/.li. the one Half of which Forfeiture to be to the Ufe of our Sovereign Lord the King, and the other I Half to him that is grieved by reafon of fuch Imprifonment, to be recovered in Manner and Form aforefaid; ■ and the Defendant in any Action or Suit for the fame fhall not wage his Law, ne have any Efibin or Pro- 1 tedtion allowed ; (3) and if it fhall appear, upon the Appearance of fuch Prifoner at the Quarter-Seffions, i by Examination or the Juftices of the Peace there being, that he was imprifoned contrary to the Form of .' this Statute, that then he fhall be forthwith difmiffed, and thereby difcharged ; and if he were lawfully imprifoned for any other juft Caufe, then to be remanded to Prifon by the Difcretion of the faid Juftices. Provided alway, That this Act, or any Thing therein contained, be not in any wife prejudicial or The Liberties^! hurtful to any of the Officers of the Stannery, ne to any of their lawful Liberties, Privileges, Ufages, '^Stannaries Laws or Cuftoms, faving only in the Cafes and Provifions contained and limited within this prefent Ait, faved " •which fhall alway be put in Execution according to the Tenor of this Adt; any U.fage, Cuftom, Privilege, Ordinance or Liberty to the contrary thereof notwithstanding.
