Provided always, and be it enacted, That if in the new Cut there happen any Breaches, Inundati Hurts, the Mayor and Citizens of London lhall flop the Breaches at their own Charge*, and fp maintain them from Time to Time. And be it alio enacted, That the faid Lord Mayor, Comminalty, and Citizens, fhaJl have the whole Jurifdiction, Confervice, Rule and Government, as well of the faid new cut River, and Ground ofea h Side, as alfo the Royalty of the Fifh, and Fifhing of the fame, and Profits of the laid Ground, Soil and Water to them and their SuccefTors for ever; and alfo lhall have Authority topunifh as weil all fuch Tranfi grefl'ors as fhall offend in the breaking of fuch good Orders as fhall be hereafter made, for fuch of the Queen's Majelty's Subjects as fhall have Occafion to travel and pals by the fame new cut River ; as alio every other Pcrfon and Perfons which fhall break fuch good and wholfome Rules and Orders, as fhall be provided and ordained for the Prefervation, Keeping, and Maintaining of the faid River, and every P.trt thereof. And further be it enacted, That the Sheriff's and Jufticcs of the Peace, and fuch other as it fhall pleafe the Lord Chancellor, or Lord Keeper of the Great Seal to put in Commiflion for the fame, as well ol Mid- dlesex , EJJ'ex, as of ' Hertfordjhire, or the more of them, by their Difcretions, fhall at the Cofls and Charges of the Country, after that the faid new Cut fhall be made and finifhed, caufe the fame from fuch Place whereas the faid new Cut fhall begin unto the Town of IVare^ alonglt the faid River, to be fuffieiently eleanfed of all the Shelfcs and Shallows, and to bring the fame to a convenient Depth in all Places, for the Paffages of Barges, Tiltboats, and other Veffels, in as good and convenient Depth all the Way of the fame, as fhall be made and continued in the aforcfaid new River by the Mayor, Comminalty, and Ci- tizens of the faid City of London, and fo to continue the fame from Time to Time, upon the Pains there- fore to be limited, and levied by the Difcretions of the faid Com nifTioners, or the more Part of them : And alfo that all other Buildings and Obstacles Handing in or upon the faid River, which may be found Impeach- ments or Lettes to this good Work, may be removed and taken away, to the End that this may be a good and perfect Work, and by the Grace of God to fuch good Effect and Commodity, as is hoped and looked for. Provided alway, and be it enacted, That this Act fhall not extend to take away any Building, Lock, «r Obftacle, which by the faid Commiflioners, or the more Part of them, {hall be thought not to hinder the; Paffage of Boats or Veffels by and through the faid River. And be it further enacted, That the Mayor, Comminalty, and Citizens of London, fhall make and main- tain, at their Cofts and Charges, fuch fufficient Hedges and Fences, as fhali be requifite between th* Grounds fo by them to be taken to the Ufe abovefaid, and the Grounds of other Owners, and alfo conve- nient Bridges and Ways, for the Paffage of the Queen's Subjects and their Carriages. Provided always, and be it further enacted by the Authority aforefaid, That the Lord Chancellor, or Lord Keeper of the great Seal of England for the Time being, fhall and may by his Difcretion, and at the Requeftof the faid Lord Mayor, Comminalty, and Citizens tor the Time being, appoint and authorize by Commiflion, under the Great Seal of England, fixtecn Commiflioners, whereof four to be of the laid Ci'.y of London, and the other twelve to be of the Counties adjoining to the faid River of Lee, v.'z. four of every ©f the Shires of EJJex, Middlejex, and Hertfordjhire, and every of the faid twelve having Lands, Tene- ments or Hereditaments, of the clear yearly Value of forty Marks in the fame Shires, or fome of them, and not being Citizens of London, ufing the Trade of Merchandife ; which iixteen Commiflioners, or the more Number of them, fhall have full Power and lawful Authority, to treat, agree, and compound with fuch Numbers of Freeholders and Inhabitants of the faid Counties, as to their Difcretions fhall feem meet and convenient, for the Scowering, Cleanfing, Repairing, and Keeping of the faid River of Lee, from fuch Place whereas the faid new River or Cut fhall have the Beginning unto the faid Town of Ware, in fuch Sort as that the fame may be navigable for Boats, Barges, and other Veffels. And further be it enacted, That until or before fuch Order or Means be devifed and agreed upon by the faid Commiflioners, and the faid Commiflion returned into the high Court of Chancery, it ihall not be lawful to the faid Lord Mayor, Citizens* and Comminalty, to put the faid digging, trenching, or new cutting of the faid River in Execution, nor to cut or take in any Ground by Force of this Statute ; any Thing in this Act to the contrary notwithftanding. And be it further enacted, That the Mayor, Citizens and Comminalty of London, fhall not- by- Virtue of this Act take any Man's Ground, until he have compounded with the Owners of the fame Ground j
