Subjccls in their ■ due Obedience, (2) Be it enacted by the Authority of this prefent Parliament, That every in what Courts Feoffment, Gift, Grant, Conveyance, Alienation, Eftate, Leafe, Incumbrance and Limitation of Ufe, they (hall be f or ou( . ' hath not repaired or (hall not repair to fome Church, Chapel or ufual Place of Common Prayer, but hath pl. 691. forborn or fhall forbear the fame, contrary to the Tenor of the faid Statute, (3) and which is or fhall be Lane 60, 91. revokable at the Pleafure of fuch Offender, (4) or in any wife directly or indirectly meant or intended, to j Roll 7, 92, or f or t ] le B cnoo f 5 Relief or Maintenance, or at the Difpofition of any fuch Offender, (5) or wherewith or whereby, or in' Confrderation' whereof, fuch Offender or his Family fhall be maintained, relieved or kept; (6) fhall, be deemed and taken to be utterly fruftrate and void, as againft the Queen's Majefty, for or con- cerning the levying and paying of fuch Sums of Money as any fuch Perfon by the Laws or Statutes of the Realm already made ought to pay or forfeit for not coming or repairing to any Church, Chapel, or ufual Place of Common Prayer, or for faying, hearing, or being' at any Mafs; (7) and fhall alfo be feized and had to and for her Majefty's Ufe and Behoof, as hereafter in this Aft is mentioned; any Pretence, Colour, feigned Confederation, or expreffing of any Ufe, to the contrary notwithftanding. Con-viftion of II. And further be it enacted by the Authority aforefaid, That every Conviction heretofore recorded far Recufancy fliall an y Offence -before mentioned, not already eftreated or certified into the Queen's Majefty's Court of Ex- be unified into cri equer, fhall from the Juftices before whom the Record of fuch Conviction fliall be remaining, be eftreated ^Ro'nVoSV ' a,1 d certified into the Queen's Majefty's Court of Exchequer, before the End of Eajier Term next coming, in fuch convenient Certainty for the Time and other Circumftances, as the Court of Exchequer may there- upon award out Procefs for Seizure of the Lands and Goods of every fuch Offender as hath not paid their In what Courts faid Forfeitures, according to the Laws and Statutes in fuch Cafe provided; (2) And that every Conviction Convufttons of hereafter for any Offence before mentioned fhall be in the Court commonly called the King's Bench, or at Recuiancy ihal ^ ^ffizes, or General Gaol-Delivery, and not elfewhere, and fhall from the Juftices before whom the Record of fuch Conviclion fliall remain, be eftreated and certified into the faid Court of Exchequer before the End of the Term next enfuing after every fuch Conviction, in fuch convenient Certainty as is afore- mentioned. At what Time III. And be it alfo enacted by the Authority aforefaid, That every fuch Offender in not repairing to the Money for- Divine Service, but forbearing the fame contrary to the faid Eftatute, as hath been heretofore convicted for tared for not fa^ Offence, and hath not made Submiffion, and been conformable according to the true Meaning of {h.llHe paid, the faid Statute?] fhall without any other Indictment or Conviction, pay into the Receipt of the faid Ex- The King may chequer, all fuch Sums of Money as according to the Rate of twenty Pounds for every Month fithence feize two Parts trie fame Conviction do yet remain unpaid, in Form as hereafter enfueth; that is to fay, The one Moiety of the Offenders t he r eof before the End of the next Trinity '1 erm, and the other Moiety thereof before the End of the next Lieu of the '" Hillary Term, or at any fuch other Times as by the Lord Treafurer, Chancellor and Chief Baron of the twenty Pounds. Exchequer, or any two of them, fhall by Com'poiition, upon good Bond and Surety taken, be limite.l before 3 Jac. 1. c. 4. the End of the faid next Trinity Term, if any fuch Compofition fliall happen to be; (2) and fhall alfo in §•' *»• every Eajier and Michaelmas Term, until fuch Time as the fame Perfon do make Submiffion, and be con- formable according to the true Meaning of the faid Statute, pay into the faid Receipt of the Exchequer twenty Pounds for every Month which fhall incur in all that mean Time. » Ro'l 3c IV.
