make falfe Re- Rewardwhatfoeve:', to any Ganger or Gangers, or other Officer whatfoever, to make any faUe Return or' turns, Report into the Office of Excife, of any Beer, Ale or other Liquors excifeable, made or brev/ed, or to be made or brewed, within his or their Charge, Divifion or Walk, or to forbear or omit the doing or execti- ting of his or their Places or Imployments, upon Penalty of ten Pounds for every fuch Offence; (z) and! that no fworn Gauger or Gaugers, or other Officer whatfoever, fhall direftly or indireftly take and receive ' any Bribe, Money, Fee, Gift or other Reward, of any Brewer or other Perfon whatfoever, for any Caufe or Matter relating to the Excife ; upon Penalty that every fuch fworn Gauger or other Officer fo offending,' fhall for every fuch Offence forfeit and lofe the Sum of ten Pounds : (3) All and every of which faid rc- fpeftive Offences fhall be proved by the Oaths of two lawful and credible Witneffes before two Juffices of i the Peace or Chief Magiftrate of the Place where fuch Offence fhall be committed; which faid Juflices orj Magiflrates refpeftively have hereby Power to adminiflcr the faid Oaths, and alfo to examine, adjudge and determine the fame, and to caufe fuch Penalties by Warrant under their Hands and Seals to be levied byj Diffrefs and Sale of the Offender's Goods, rendring to the Party the Overplus; and for Want of fuch Diflrefs to commit every fuch Offender to the common Gaol of fuch County or Place, there to remain by the Space of three Months without Bail or Mainprife. Foreign Liquors XVII. And for the better Levying and Collecting the Duties of Excife upon all foreign or imported Li-: imported to be quors ; (2) Be it enafted by Authority aforefaid, That no fuch foreign or imported Liquors fhall be landed iVei^Tel,' ^^ P"' °'^ Shore out of any Ship or Veffel from beyond the Seas, before due Entry be firft made thereof with the Officer or Colleftor appointed for the Excife in the Port or Place where the fame fhall be imported, or before the Duty of Excife due and payable for the fame be fully fatisfied and paid ; (■;) and that every Warrant for the Landing or Delivering of any fuch foreign Liquors fliall be figned by the Hand of the faad Officer or Colledor of the Excife in the faid Port or Place refpedively ; (4) upon Pain that all fuch fo- reign Liquors as (liall be landed, put on Shore or delivered contrary to the true Intent and Meaning hereof, or without the Prefence of an Officer or Waiter for the Excife, or the Value thereof, fhall be forfeited and loft, the one Moiety to the King's Majefty, and the other Moiety to him or them who fhall or will feiife, inform or fue for the fame, to be recovered of the Importer or Proprietor thereof. XVIII. And that no Perfon or Perfons whatfoever bringing any excifeable Liquors (except Beer, Ale, Cyder, Perry and Metheglin) into any Part or Place of this Realm, by Coaft Cockquet, Tranfire or Cer- tificate, nor any Perfon or Perfons to whom the fame or any of them fhall be configned, fhall land or caufe any fuch excifeable Liquors (except before excepted) to be landed or put on Shore, without making or caufing due Entry to be made of the fame, with the Officer or Officers of the Excife for the Time being appointed to receive and take fuch Entries within the Port or Place where the fame fhall be landed ; upon Pain in every fuch Cafe as aforefaid, to forfeit double the Value of the faid Liquors landed or put on Shore contrary to the true Intent and Meaning hereof. Kppealsln XIX. Provided alfo, and be it further enafired and ordained by Authority aforefaid. That no Appeal in Caufes of Excife, ^^y Caufe of Excife whatfoever fhall be admitted, until the Party Appellant fhall have firft depofited and laid down the fingle Duty of Excife in the Hands of the Commiflioners, Farmers or Sub-Commiffioners ol Excife, ^within whofe Jurifdi£fion or Divifion the faid Caufe was originally heard and determined, and have given Security to the Commiff.oners of Appeal, or Juftice of the Peace refpedlively where fuch Caufe is tc he_ finally adjudged, for all fuch Fine, Forfeiture and Penalty as upon fuch Hearing and Determination was adjudged againft him; (z) and that if upon the Hearing and Determining of any fuch Appeal, the faid original Judgment fhall happen to be reverfed and made null, then and in every fuch Cafe, the faid Com- miffioners, Farmers or Sub-Commiffioners of Excife In whofe Hands the faid fingle Duty of Excife was de- pofited, ftiall refl-ore and deliver back the fame, or as much thereof as fhall be adjudged by the Commiffio- ners of Appeals or Juftices of the Peace refpeftlvely, to the faid Appellant, and the Party originally pro- fecuting fhall pay him the double Cofts : (3) But in Cafe the firft Judgment fhall be affirmed, the Part^ appealing fliall pay the like Cofts unto the Commiffioner or Commiffioners complained of; any Thing ir this Aft or in any other Aft or Statute whatfoever to the contrary thereof contained in any wife notwith- ftanding. lycifeupon Vi- XX. And be it further enafled by the Authority aforefaid. And it is hereby further declared. That every College and Hall in either of the Univerfities, whici Halh in the before the Duty of Excife was impofed did brew their own Beer and Ale within their own Precinfls, am Vniverfities, fize It out to their refpeftive Members within their own Precindfs only, are not liable to the Payment of an^ Duty of Excife for the fame, either by this or any the fore-mentioned Afts. Commiflioners ' XXIIL And be It further enafted by the Authority aforefaid. That no Farmer, Commiffioner, Sub 8^ke"oFecr^ Commiffioner or other Officer of Excife, fliall dircftly or indireftly take or receive any Money, Fee or Re ward, for or concerning the taking of any Bond, or giving any Receipt or Note in Writing, relating to th , Excife, to or from any Perfon or Perfons whatfoever ; upon Pain that every fuch Peribn fo offending mail io ■'every fuch Offence forfeit the Sum of ten Shillings. 3 » XXIV.
