C. 5. 301 (4) So as that for every Pound Troy of Crown or Standard Gold that ftall be brought in and delivered by him or them to be afTaycd, melted down and coined, as aforefaid, there fhall be delivered out to him or them refpeiSively, a Pound Troy of the cu.rent Coins of this Kingdom, of Crown or Standard Gold : (5) And for every Pound Troy of Sterling or Standard Silver that fhall be brought in and delivered by him or them to be allayed, melted down and coined, as aforefaid, there fhall be delivered out to him or them re- fpeftivcly, a Pound Troy of the current Coins of this Kingdom, of Sterling or Standard Silver, and Co pro- portionably for a greater or lefler Weight ; (6j and for every Pound Troy of Gold or Silver that fiiall be brought in and delivered to be aflaycd, melted down and coined, as aforefaid, that fhall be finer upon Affay than Crovv'n Gold or Standard Silver, there fhall be delivered for the fame fo much more than a Pound Troy as the fame doth in Proportion amount unto in Finenefs and Value: (7) And for every Pound y^^ of Gold or Silver that fliall be brought in and delivered to be allayed, melied down and coined, as aforefaid, that fhall be coarfer or bafer upon Aflay, or worfe in Value than Crown Gold or Standard Sil- ver, there fhall be delivered for the fame fo much lefs than a Pound Troy as the fame doth fall fhort in Fine- nefs or Value, and fo for a greater or lefier Quantity. • II. And it is hereby further enacfed by the Authority aforefaid, That there fhall be no Preference in There fliall be Point of Allaying or Coinage ; but that all Gold and Silver brought in and delivered into the Mint, to be no undue Pre- aflayed and coined, fhall be affayed, coined and delivered out to the refpeclive Importers, according to the 'crerce, but Order and Times of bringing in and delivering the fame into the Mint or Mints, and not otherwife ; fo as n°,?'P' '"'"^"^ he that fhall firfl: bring in and deliver any Gold or Silver to be coined, fliall be taken and accounted the ""tin order? firlt Perfon to have the fame affayed, coined and delivered ; and he or they that fliall bring in and deliver See SW. 3. c. i, any Gold or Silver next, to.be accounted the fecond Perfon to have the fame allayed, coined and delivered, §. 3. and fo fucceffively in Courfe: (z) And that the Gold and Silver brought in and coined, as aforefaid, fhall be in the fame Order delivered to the rel'pedfive Bringers in thereof, their Executors, Adminiftrators or AfTigns fucceflively, without Preference of one before the other, and not otherwife: (3) And if any un- due Preference be made in entring of any Gold or Silver, or delivering out of any Money coined, contrary ■ to the true Intent and Meaning of this AiSf, by any Officec or Officers of the Mint or Mints ; then the Penalty. Party or Parties offending fhall be liable by Aftion of Debt or on the Cafe, to pay the Value of the Gold or Silver brought in, and not entred and delivered according to the true Intent, Meaning and Direftion of this A(£f, as aforefaid, v/ith Damages and Cofts to the Party or Parties grieved, and fhall be fore-judged from his or their Place or Office : (4) And if fuch Preference be unduly made by any his or their Deputy or Deputies, Clerk or Clerks, without Diredtion or Privity of his or their Mafter or Mafters, then fuch Deputy or Deputies, Clerk or Clerks only fliall be liable to fuch Aftion, Damage and Cofts, as aforefaid, and be for ever after incapable of ferving or bearing Office in any Mint in the Kingdom of England. III. Provided always. That it fhall not be interpreted any undue Preference, to incur any Penalty, in What fliall not Point of Delivery of Monies coined, if the Officer or Officers, or their Deputies or Clerks, fhall deliver bean undue ■ out or pay any Monies coined to any Perfon or Perfons that do come and demand the fame upon fubfequent Preference. Entries, before others that did not come to demand their Monies in their Order and Courfe, fo as there be fo much Money referved as will fatisfy them, which fhall not be otherwife difpofed of, but kept for them. , _ ' ' IV. And for the more orderly and clear Performance thereof, be it enafted, and it is hereby enadied by the Authority aforefaid. That the Mafter-worker of his Majefty's Mint or Mints for the Time being, fhall at the Time of the Delivery and Entry of any Gold or Silver in the faid Mint or Mints, give unto the Bringer or Bringers in thereof to be coined, a Bill under his Hand denoting the Weight, Finenefs and Va- lue thereof, together with the Day and Order of its Delivery into the faid Mint or Mints. V. And for the further Encouragement and Affurance of fuch as fhall bring any Gold or Silver into There fhall be his Majefty's faid Mint or Mints to be coined ; (z) Be it enacted, and it is hereby enafted by the Autho- no Seizure or rity aforefaid, That no Confifcation, Forfeiture, Seizure, Attachment, Stop or Reftraint whatfoever fhall Forfeiture, &c. be made in the faid Mint or Mints, of any Gold or Silver brought in to be coined, for or by Reafon of any slw^ b'ol? ht Imbargo, Breach of the Peace, Letters of Mart or Reprifal, or War with any Foreign Nation, or upon ;„ ^^ be coined, any other Account or Pretence whatfoever; (3) but that all Gold and Silver brought into any of his Majefty's Mint or Mints within the Kingdom of England to be coined, fhall truly and with all convenient Speed be coined and delivered out to the refpeftive Bringer or Bringers in thereof, their reipeftive Execu- tors, Adminiftrators or Affigns, according to the Rtdes and Directions of this Aft. ' VI. And whereas it cannot be reafonably expefted, That the Expence, Wafte and Charge in Aflay- Animpofition ' ing.
