WHEREAS the Eleftion of Members to ferve in Parliament ought to be free; and whereas the late Lord Wardens of the Cinque Ports have pretended unto, and claimed as of Right, a Pow- ' er of nominating and recommending to each of the faid Cinque-Ports, the two ancient Towns, and their ' refpeftive Members, one Perfon whom they ought to eletSl to ferve as a Baron or Member of Parliament ' for fuch refpedtive Port, ancient Town, or Member, contrary to the ancient Ufage, Right, and Free- ' dom of Eleftions : II. VIII. An A£: for reverfing the Judgment in a ^lo Warranto againft the City of London., and for reftoring the City of London to its ancient Rights and Privileges. ' TT/HEREAS a Judgement was given in the Court of King's Bench in or about Trinity Term, in ' W the five and thirtieth Year of the Reign of the late King Charles the Second, upon an Ihforma- ' tion in the Nature of a ^0 Warranto, exhibited in the faid Court againft the Mayor and Commonalty ' and Citizens of the City of Londo?i, that the Liberty, Privilege, and Franchife of the faid Mayor and ' Commonahy and Citizens, being a Body Politick and Corporate, fhould be feized into the King's ' Hands as forfeited : And forafmuch as the faid Judgment, and the Proceedings thereupon, is and were ' illegal and arbitrary ; and for that the reftoring of the faid Mayor and Commonalty and Citizens, to their ' ancient Liberties, of which they had been deprived, tends very much to the Peace and good Settlem.ent. ' of this Kingdom ; II. Be it declared and enaSed by the King's and Qiieen's moft Excellent Majefties, by and with the judgment Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament af- againft iheCisy fembled, and by Authority of the fam.e. That the faid Judgment given in the faid Court of King's jg^«f/jCharter void. in the faid Trinity Term., in the five and thirtieth Year of the Reign of the laid King Charles the Second, or in any other Term, and all and ev-.ry othr jjdginent given or recorded in the faid Court, for the feizing into the faid late King's Hand, the Liberty, Privilege, or Franchife of the Ti'Iayor and Commonalty «nd Citizens of the City of London., of being of themfelves a Body Corporate and Politick, by the Nanie of ' The Mayor and Commonalty, and Citizens of the City of London.^ and by that Nam.e to plead and be impleaded, and to anfwer and to be anfwered, or in what Manner or Vv'ords foever fuch Judgment was emred, is, fliall be, and are hereby reverfed, annulled, and made void, to all Intents and Purpofes what- jfoeyer ; and that Vacates be cntred upon the Rolls of the {aid Judgment, for the Vacating and Reverfal. ©f the fame accordingly. III. And be it further declared and enafted by the Authority aforefaid.
