Penalties fhall be levied by Diflrrefs and Sale of the Goods and Chattels of the Offender by Warrant unde the Hand and Seal of any Juftice of the Peace of the Place, to be direfted to the Conftables and Headbo roughs of the fame Parifh where the Offence was done, rendring the Surplufage to the Party ; and in De fault of Diffrefs, or Not-payment of the faid Penalties, within fix Days after Demand thereof, where it i not hereby othcrwife provided, or Notice in Writing left at the Houfe or Dwelling-place of the Offender by the faid Conftable or Hfiadborough, the faid Offender (not being a Peer of this Realm) fhall be com' mitted to the Common Gaol of the laid Counties or City refpeftively, by the Warrant of any fuch Juftic' under his Hand and Seal, there to remain without Bail or Mainprize until Payment.
