' XX/HEREAS by a Claufe in one Aft of Parliament made in the firft Year of their Majefties Reign, I.' YV intituled. An J£i to repeal the Statute made in the fifth Tear of King Henry the Fourth, againft the ' multiplying of Gold and Silver, it is amongft other Things enaited. That no Mine of Tin, Copper, Iron, ' or Lead, fhall hereafter be adjudged, reputed or taken to be a Royal Mine, although Gold or Silver may

  • be extraded out of the fame : But notwithftanding the good Provifion by the faid Statute to prevent the

' difcouraging their Majefties good Subjefts, who have Mines of Copper, Tin, Iron, or Lead in their

  • Soils, from digging and opening the fame, m.any Doubts and Queftions have arifen upon the faid Statute,

' whereby great Suits and Troubles have arifen to many Owners and Proprietors of fuch Mines;' where- fore for the better Explanation of the faid Statute, II. Be it enabled and declared by the King's and Queen's moft Excellent Majefties, by and with the Ad- vice and Confcnt of the Lords Spiritual and Temporal, and the Commons in this prefent Parliament af- fembled, and by the Authority of the fame. That all and every Perfon or Perfons, being Subjeds of the Crown of England, Bodies Politick or Corporate, that now are or hereafter fhall be the Owner or Own- ers, Proprietor or Proprietors of any Mine or Mines within the Kingdom oi Endand, Dominion of IValei, or Town of Berwick upon Tweed, wherein any O.'e now is, or hereafter fhall be difcovered, opened, found or wrought, and in which there is Copper, Tin, Iron or Lead, fliall and may hold and enjoy the fame Mine or Mines and Ore, and continue in the Pofieffion thereof, and dig and work the faid Mine or Mines or Ore, notwithftanding that fuch Mine or Mines or Ore fliall be pretended or claimed to be a Roy- al Mine or Royal Mines ; any Law, Ufage or Cuftom to the contrary notwithftanding. in. Provided always, and be it enafted and declared. That their Majefties, their Heirs and Succeffors, and ail claiming any Royal Mines under them, fhall and may have the Ore of any fuch Mine or Mines iii any Part of the faid Kingdom of England, Dominion of TVales, or Town of Berwick upon Tweed (other than Tin Ore in the Counties of Devon and Cor7iwiill) paying to the Proprietors or Owners of the faid Mine or Mines wherein fuch Ore is or fhall be found, within thirty Days after the faid Ore is or fliall be raifed and laid upon the Banks of the faid Mine or Mines, and before the fame be removed from thence, the Rates following (that is to fay) For all Ore waftit, made clean, and merchantable, wherein is Cop- per, the Rate of fixteen Pounds per Ton ; and for all Ore waflit, made clean, and merchantable, wherein therc'is Tin, the Rate of forty Shillings />^r Ton ; and for all Qre wafhr, made clean, and merchantable, wherein there is Iron, the Rate of forty Shillings tt^r Ton ; and for all Ore waflit, made clean, and mer- chantable,
