(.j^g^g^f^ ^j^]j j^g affignable and transferrable, in fuch and the fame Manner and Form, as are enafted, prefcribed or appointed in and by the abovefaid Aft, v/hich granted Duties of Excife to fecure Recompences and Advantages to fuch as fhould advance the Sum of ten hundred thoufand Pounds, for or concerning the Orders which were to be given to the Contributors upon that Aft ; and fo much of the feveral Rates and Duties of Excife, and of the faid Impofition arifing by the Tunnage of Ships and VeffeJs, granted by the feveral Afts above mentioned, as is and fhall be fufficient to pay and fatisfy the feveral Sums of Money which fliall from time to time grow due and be payable upon the faid feveral Annuities to be purchafed and obtained in Purfuance of this Aft, and which fhall refpeftively be charged upon the Rates, Duties or Ira- pofitions aforefaid, is and flrall be appropriated and applied, and the fame is hereby appropriated, to and for the Payment of the faid feveral Annuities to be purchafed and obtained in Purlliance of this Aft, ac- cording as the fame ftiall become due by the Purport and true Meaning thereof; and (hall not be diverted or divertible to any other Ufe, Intent or Purpofe whatfoever, under the like Penalties, Forfeitures and Difabilities, in Refpeft to all and every the Officers and other Perfons that are or ought to be concerned in the Payments thereof, as are appointed and enafted (in cafe of diverting or mifapplying, or not paying) in and by the faid Aft which granted Duties of Excife to fecure Recompences and Advantages to fuch as fhould advance the Sum of ten hundred thoufand Pounds ; and every Article, Rule and Claufe in the faid lafl mentioned A£t contained, as for and concerning any Penalties, Forfeitures or Difabilities, upon any OfHcers or others, for mifapplying or diverting any of the Duties or Sums of Money thereby granted, fhall be of full Force and Effeft to all Intents and Purpofes, during the Continuance of the faid Term of ninety-fix Years; and the fa'd Penalties and Forfeitures fhall be fued for, profecuted, recovered and paid, in fuch Manner and Form as the Penalties in the Aft laft mentioned are appointed to be fued for, profe- cuted, recovered or paid ; in which Suit no Proteftion, Privilege of Parliament, or other Privilege, Wager of Law, or any more than one Imparlance fhall be allowed. And the faid Officers are hereby required to keep Books and Regifters, and to make Entri s of the Names of all Perfoni who fhall advance Monies on this Aft, and of all Perfons to be nominated as aforefaid, and of the feveral Sums fo advanced, and the Times of paying in the fame refpeftively, and of the Nature of each Payment to be made in Purfuance of this Aft, to which all Perfons concerned fhall have Accefs ; all which the faid Officers for the time being fhall do or perform, without Fee or Reward, under the like Penalties, Forfeitures and Difabilities, as in the like Cafes are appointed to be inflifted by the Aft lafl: mentioned. Monies by this VIII. And be it further enafted, That any Monies payable to any Perfon or Perfons, upon or by virtue Aa advanced to of this Aft, for Annuities to be purchafed or obtained as aforefaid, fhall not be charged or chargeable to or be Tax fiee. -^[{h any Taxes or publick Rates, Duties or Impofitions whatfoever. Guardian may IX. And be it further enafted. upon any the Terms in this Aft mentioned ; and fuch Infant, upon the Payment of the fame, fhall be- come a Contributor within the Meaning of this Aft, and be intituled to the Annuity- for which fuch Sum fhall be fo paid, and the faid Guardian or Truftce, as to the Sum fo advanced, is hereby dif- charged. Punidiment X. And be it enafted by the Authority aforefaid, Thar'if any Perfon or Perfons fhall fraudulently con- fll"ii'f^l? *f tribute any Sum or Sums of Money upon this Aft, under Colour or Pretence of having an Eflate for a advancTMoney '"'"g'^ Life changed or converted into a Term certain as aforefaid, or under Colour or Pretence of pur- his [Nominee ' chafing Or obtaining an Interefl- to take EfFeft (in Point of Payment) after a fingle Life fuppofed to be in being dead. being, when in Truth and Reality the particular Eflate for fuch fingle Life (at the Time of the paying the Coniideration Money fo to be contributed or advanced) fhall be aftually determined by the Death of the Nominee, or Perfon during whofe Life fuch particular Eftate was to continue, that then and in every fuch Cafe the Confideratioii Money, or Sum fo to be advanced or contributed, fhall be forfeited and loft to his Majefty ; and no Eftate, Intereft or Term, for or in Refpeft of the fame, fhall by this Aft arife or be vefted either in fuch Contributor, or in any Perfon to be nominated for him, her or them as afore- faid, or in his, her or their Executors, Adminiflrators or Affigns ; and fuch Contributor, for every fuch Offence, fhall forfeit the Sum of one hundred Pounds, one Moiety thereof to his Majefty, and the other Moiety to him or them that fhall difcover fuch Offence, and fue for the faid Sum, by Aftion of Debt, Bill, Suit or Information as aforefaid ; any thing herein contained to the contrary notwith- flanding. Manner of Or- XI. Provided always, and it is hereby enafted. That when as any the faid particular Eftates for fingle ders upon the Lives fhall be changed into certain Terms of Years, and be thereby merged or extinguifhed, according changingEftates. ^^ ^^^ ^^.^^g iviggning of this Aft as aforefaid, the Orders which were made and figned purfuant to the faid former Afts, for the Annuities payable during fuch fingle Lives, fhall be brought into the Receipt of the Exchequer, and there remain as Vouchers for the Payments already made, without making any further Iffues or Payments thereupon, for any Time beyond the Feaft of the Nativity of our Lord, v/hich fliall be m the Year one thoufand fix hundred ninety-five, from which Feaft Day the Ifiues or Payments of the jefpeftive Annuities, hereby appointed to be paid, fhall be made upon the faid Orders, which are to be drawn
