I. from May ijig. to May 1740. Duties to be paid to Colleftor, and by him to Receiver Ge- neral. Mayor, &^c. may affign where the Chanel fhall be enlarged, &c. may cut and dig the Land fo laid out, Wf. Earl of Kent's Land not to be cut. Except Gravel-pit Land, and two Pieces called Fore- lands. Nor the Lands of Nicholas CorfelUs, Efq; unlefs Reed Point. In cafe of Damaj^e Mayor and. Commonalty to repair the fame. Soil not to be laid on any Perfon's Land without Licence. On Payment of Sum agreed on, fuch Lands to be vefted in the Mayor and Commonalty, &c. Pe- jialty on Mayor, &c. not repairing the Premiffes. Mayor, ^c. to compound with the Owners of Lands. Commiffioners to mediate between the Corporation and Owners, and proportion every Perfon's Share. _ On Non-agreement, Sherift" of Effix to impanel a Jury, who are to enquire and affefs Damages. Commiffioners to give Judgment thereupon, &c. Such Judgment binding, to be kept among the Re- cords of the SefTions. Mayor, i^c. may nominate CollecSlor, b°f. Mayor of Colchejier, and Juftices of the Eaft Divifion of EJfex to be Commiffioners, and to take Account of the Receipts and DIfburfements, &c. No Goods to be laded or unladed at any Key In Colchejier River but at IVivenhoe, and the New Hiihe. Giles Sayer's Wharf excepted, i^c. Goods, i^c. unladen at Wivenhoe, and not carried to Colchefter, &c. exempted from Duties. The like from Colchejier to Wivenhoe. Mayor, ^c. may engage the Profits of the Toll, and grant the fame for 21 Years, for Security for Money borrowed, with Intereft at 6 /. per Cent, If before Expiration of the Term, fufficlent Money be raifed for the Ufes aforefaid, Duties to ceafe. In cafe Mayor, iSc. make new Chanel through Gravel-Pit Land, Earl of Kent may either have the Value thereof, or retain the fame. 4 CAP.
