Aft; except only as to fuch of the faid Articles, Rules, and Claufes, touching which other Provifions, Alterations, or Exemptions are made by any Aft or Afts of Parliament now in being ; which other Pro- vifions, Alterations or Exemptions fhall be obferved, with refpeft to the Duties hereby granted, during the Continuance of this Aft, in the fame Manner as they are to be obferved with Refpeft to the faid Sub-' fidies formerly granted, as aforefaid. Penalty on Of- III. And be it further enafted by the Authority aforefaid. That the Officers of her Majefty's Cuftoms, Ccer taking Fee or any of them, or any of their Clerks or Subftitutes, fhall not direftly or indireftly receive, take, or de- fer Entry,&c. jnand any Fee, Gratuity, or Reward whatfoever, from any her Majefty's Subjefts or Aliens for any En- try, Warrant, Debenture, Certificate, Cocquet, or other Matter or Thing to be done or performed by them or any of them, in relation only to the faid Subfidies, of Tunnage and Poundage hereinbefore granted ; on Pain of forfeiting for every fuch Offence the Sum of forty Pounds (to wit) One third there- of to her Majefty, and the other two Thirds thereof (befides Cofts of Suit) to the Party grieved, who' may fue for the fame by Aftion of Debt, or on the Cafe, Bill, Suit, or Information, in any of her Ma- ' jefty's Courts of Record 2it Wejiminjier, wherein no Eflbin, Proteftion, Wager of Law, or more than one Imparlance fhall be allowed. Provifii. IV, Provided, That nothing in this Aft fliall extend, or be conftrded to extend, to charge any Goods ' • or Merchandize chargeable by this Aft, imported in any Port of England or Wales before the faid eighth Day of March one thoufand feven hundred and four. Aftnottoaffea v_ Provided neverthelefs, and be it enafted by the Authority aforefaid. That the new or additional foH^f " fiie ufe ^'it'^s impofed by this Aft, fhall not extend to affeft fuch foreign Stores, as have been fold to the Ufe c^fthe^Na™. o^ her Majefty's Navy, by Contraft with the Navy Board, before the five and twentieth Day oi Decem- ber one thoufand feven hundred and four, fo as a Certificate be given from the Commillioners of the Navy, that fuch Foreign Stores have been fo contrafted for by them for her Majefty's Service, as aforefaid ; and ' fo as the Importer of the fame do make Oath before the Commiffioners appointed to manage the Cuftoms' (which Oath they are hereby impowered to adminifter) of the Truth of the faid Contraft, and that he will deliver the faid Goods into her Majefty's Stores, purfuant to the Contraft fo certified by the Com- miflioners of the Navy. Claufe of toan VI. And be it further enafted by the Authority aforefaid. That all the Monies arifing by the faid Subfidy. ' not to exceed of Tunnage and Poundage, and other the Duties hereby granted, as aforefaid (except the necelfary Charges i 636,9571. 4s. ob. of raifing and anfwering the fame) fhall from Time to Time be brought and paid into the Receipt of her Majefty's Exchequer ; and that it fhall and may be lawful to and for any Perfon and Perfons, Natives or Foreigners, Bodies Politick or Corporate, to lend to her Majefty at the faid Receipt, upon Credit there- of, any Sum or Sums of Money, not exceeding in the whole the Sum of fix hundred thirty-fix;^ thou- with Intereft at fand nine hundred fifty-feven Pounds four Shillings and a Halfpenny ; and to have and receive, for the.l 61. per Cent.
