And be it further enaded by the Authority aforefaid, That all fuch Perfons now having or bearin g Oath fliallbe ^^y jj^g OiHces aforefaid, and who in Refpe£l thereof have been or are obliged and required to take in " ^"' • Scotland an Oath, called, The Oath ofJlk^iance and JJfurance, before the Privy Coujicil there, fhall be o- bliged, on or before the twentieth Day oi April one thoufand feven hundred and eight, to take and fub- fcribe the Oath hereby appointed, before that Privy Council while it Ihall continue, and after the Deter- rnination thereof, before and in the Court of the Lords of Sefficn, or the Court of Judiciary, or the Court of Exchequer there; and all others now in any other the Offices aforefrdd, who in Refpeft thereof have lifed and been obliged to take the faid Oath of Allegiance and AfiTurance in any other Court or Place, fhall be, and are hereby required and obliged to take and fubfcribe the fame at the next Quarter-Seffions of the Peace which fhall be held for any County or Place in which any fuch Officer fliali be refident or abiding. And be it further enafted by the Authority aforefaid, That all and every Perfon or Perfons wliat- Months after foever, v/ho fhall hereafter be admitted into any OfSce, Civil or Military, within that Part of Great Bri- O&'TioZkl '"'^ called Scotland^ fhall within three Months after his Admittance into any fuch Office take and fubfcrihfe the Oath. ^"^^ Oath hereby appointed in the Courts above-mentioned refpeifively, according to the Diftindion above-mentioned for Perfons now in Office to take the fame. Courts to admi- IV. And be it further enafted by the Authority aforefaid, That the faid refpeflive Courts fhall from Time Biftet the Oath, to Time adm.inifter the faid Oath to fuch Perfons as fhall tender themfelves to take the fame, and fnall ^'^' keep proper Rolls of Parchment, in which the Subfcriptions of all Perfons taking the faid Oaths fhall from Time to Time be made ; to which all Perfons may have free Accefs without Fee or Reward. Perfons refuting V. And be it further enafted by the Authority aforefaid. That every Perfon hereby required to take ?f h'l^V^^^'' ^^^ fubfcribe the Oath aforefaid, and neglecting or refuftng fo to do, at fuch Times, and in fuch Manner ' ■ as is above direiSed, fliall be adjudged incapable and difabled in Law, to all Intents and Purpofes, to have or enjoy any Office or Offices, in refpe£t whereof he is hereby obliged to take the faid Oath, and the faid Office or Offices fhall be, and are hereby adjudged to be void. That it fhall and may be lawful for any two fiimmon before Juflices of the Peace, whereof one of them to be of the .^aj^rw;/, within any of the Counties, Ridings, them fufpeaed DivifioDS, Stewartrics, Cities, or Boroughs within the faid Kingdom of Gr^tfif 5r/to'??, or any other Per- ^"1°"^' ^""^ . fon or Perfons who fhall be by her Majefty for that Purpofe fpecially appointed by Order in the Privy Oatli'^ ' '"^ " ^ Council, or by CommifHon under the Great Seal, at any Time or Times to fummon and convene before them all fuch Perfons within the Limits of their refpeftive Jurifdiiflions, Powers, and Authorities, as they fhall or may fufpedl to be dangerous ox difaffefted to her Majefty or her Government, and fliall and may tender to every fuch Perfon and Perfons the Oath above-mentioned and appointed, and fhall at the next Quarter-Seffions of the Peace to be held for the County or Place in which the faid Oath fhall be tenr dred, certify the Chriftian Names, and Surnames, and Places of Abode of all Perfons refufing to take the faid Oath, to be there recorded, and fhall be from thence certified by the Clerk of the Peace of fuch Coun- ty, Riding, Liberty, Borough, Town Corporate, or Tlace within ^w^/fl^z^^, into her Majefty's Court of and certify the Chancery ov ^een's Bench z.t IVeJiminJler, and by the Clerk of the Peace of every Shire, Stewartry, Bo<- Namcs of thofe rough or Place in Scotland, into the Court of Seffion, there to be recorded in the Regifter or Rolls of the whorefuftj Bit, f^id refpeftive Courts ; and if the Perfon fo refufing and certified fhall not within the next Term or SelTir on after fuch Refufal, appear in the Court of Chancery, ^eens Bench, or Seffion, where fuch Certificate fhall be returned, and in open Court audibly and folemnly take and fubfcribe the Oath aforefaid, and endorfe or enter his fo doing upon the Certificate fo returned, fhall be from the Time of fuch his Negled or Refufal, taken, efleemed and adjudged a Popifli Recufant convi£t, and as fuch fhall forfeit and un- dergo fuch Penalties as a Popifh Recufant convi<£t ought to do by the Laws now in Force within England, CAP.
