And be it further enaded by the Authority aforefaid, That no Judgment, Statute, or Recogni- zance (other than fuch as fhall be entred into in the Name and upon the proper Account of her Majefty, ,^ her Heirs and Succeflbrs) which fhall be obtained, or entred into after the faid nine and twentieth Day of left any Lands, September in the faid Year of our Lord one thoufand feven hundred and eight, fliall affeiS or bind any &c. inEaftRi- Honors, Manors, Lands, Tenements, or Hereditaments, fituate, lying, and beir.g in the faid Eq/i Ri- ding, or HuH, ^/„^^ q^ ;„ t^g fgid Town and County of the Town of Kingfton upon Hull, but only from the Time that ti^extme t'h" a ^ Memorial of fuch Judgment, Statute, or Recognizance fhall be entred at the faid Regifler Office, ex- Memorial there- prefHng and containing, in cafe of fuch Judgment, the Names of the Plaintiffs, and the Names and Ad- oiba entred, S;c. ditions therein of the Defendants, the Sums thereby recovered, and the Time of the figning thereof; and in cafe of Statutes and Recognizances, expreliing and containing the Date of fuch Statute or Recogni- zance, the Names and Additions of the Cognizors and Cognizees therein, and for what Sums, and before whom the fame were acknowledged ; and that in order to the making an Entry of fuch Memorials of Judgments, Statutes, and Recognizances as aforefaid, the Party and Parties defiring the fame, fhall pro- duce to, and leave with the faid Regifter, or his Deputy, to be filed in the faid Publick or Regifter Of- fice, a Memorial of fuch Judgment, Statute, or Recognizance, ftgned by the proper Officer, or his De- puty who fhall fign fuch Judgment, or his SuccefTor in the fame Office, or by the proper Officer in whofe Office fuch Statute or Recognizance fhall be inrolled, together with an Affidavit, fv/orn before one of the Judges at Wejimlnjier, or, a A'lallrer in Chancery, That fuch Memorial was duly figned by the Officer, whofe Name Ihall appear to be thereunto let, which Memorialfuch refpetSive Officer is hereby required to give fuch Plaintiff or Plaintiffs, Cognizee or Cognizees, or his, her, or their Executors or Admini- ftrators, or Attorney, or any of them ; he, fhe, or they paying for the fame the Sum of one Shilling and no more. Recifter to enter XX. And be it further enacted. That the faid Regifter or his Deputy fhall make an Entry, and like- v.'ife (if required) fhall give a Certificate in Writing, under his Hand, teftified by two credible Witneffes, of every fuch Memorial of any Judgment, Statute, or Recognizance brought to him to be fo regiftred as aibrefaid, and therein mention the certain Day on which fuch Memorial is fo regiftred or entred, ex- preffing alfo in what Book, Page, and Number the fame is entred. Fees for Entries XXL And be it further enafted. That every fuch Regifter flaall be allowed for the Entry of every fuch ofMemonals. Memorial, as is by this Aft dire£i:ed, the Sum of one Shilling and no more, in cafe the fame do not ex- ceed two hundred Words; but if fuch Memorial fhall exceed two hundred Words, then after the Rate and Proportion of fix Pence an hundred for all the Words contained in fuch Memorial, over and above the firft two hundred Words ; and the like Fees for the like Number of Words contained in every fuch Bargain and Sale as aforefaid, and in every Certificate or Copy given out of the faid Office, and no more ; and for every Search in the faid Office one Shilling and no more. Times of Atten- XXIL And be it further ena£ted by the Authority aforefaid. That every fuch Regifter, or his fuffici- dance at the Of- ent Deputy, fhall give due Attendance at his Office every Day in the Week (except Sundays and Holy- ""• days) between the Hours of nine and tv/elve in the Forenoon, and the Hours of two and five in the Af- ternoon, for the Difpatch of all Bufinefs belonging to the faid Office, and that every fuch Regifter, or his Deputy, as often as required, fhall make Searches, concerning all Memorials that are regiftred as aforefaid, and give Certificates concerning the fame under his Hand (if required by any Perfbn) teftified by two credible Witneffes. Regiflertoen- XXIIL .A.nd be it further enafbed by the Authority aforefaid, That every Regifter at the T'ime of his ter intoaRecog- being fwom into the faid Office as aforefaid, fhall enter into a Recognizance, with two or more fufficient aizanceofzoool. Sureties (to be approved of by five or more of the Juftices of the Peace of the faid Riding, that were pre- ^"t'ion of^hif^ ^^"^ ^' ^'^ Eleftion, by Writing under their Hands and Seals to be regiftred at the next General Quarter- Seffions of the Peace for the faid Riding) of the Penalty of two thoufand Pounds unto her Majefty, her Heirs and Succeffors, to be taken by the fame Juftices of the Peace that approved of his Security, con- ditioned for his true and- faithful Performance of his Duty in the Execution of his faid Office, in all Things dire£t:ed and required by this A6t ; the fame to be tranfmitted by the fame Juftices of the Peace, within one Month next after the Date thereof, into the Office of her Majefty's Remembrancer of the Exchequer, there to remain amongft the Records of the faid Court. XXIV. And be it further enaded. That if any fuch Regiftier, or his Deputy, fhall negleft to perform his or their Duty in the Execution of the faid Office, according to the Rules and Diredlions in this Ad men- tioned, or commit or fuffer to be committed any undue or fradulent Pradice in the Execution of the faid Office, and be thereof lawfully convided, then fuch Regifter fliall forfeit his faid Office, and pay treble Damages with full Cofts of Suit to every fuch Perfon or Perfons as ftiall be injured thereby, to be recover- ed by Adion of Debt, Bill, Plaint, or Infarmation in any of her Majefty's Courts of Record at Wcjimln- Jier, v/herein no Effoin, Protedion, Privilege, or Wager of Law, ihall be allowed, nor any more than one Imparlance. XXV. Provided neverthelefs, and be it further enaded by the Authority aforefaid, That when any Re- gifter fhall die or furrender his Office, and that within the Space of three Years from and after fuch Death appear Rcco-ni- o Surrender no Mifbehaviour appear to have been committed by fuch Regifter in the Execution of his zanceiobc void, faid O&ce, then and in fuch Cafe, at the End of the faid three Years after his Death or Surrender, the faid Recognizance lb entred into by hirn fhall become void and of none Effed, to-all Intents and Purpofes whatfoever. • XXVI. And be it further enaded, That if any Perfon or Perfons fliall at any Time forge or conterfeit any Entry of the Acknowledgment of any Bargainor in any fuch Bargain and Sale .is aforefaid, or any fuch Memorial, Certificate, or Indoriement, as is herein mentioned or direded, and be thereof lawfully 3 Con- Office.
