A.D. 1710. the Hop Grounds wherein any Hops fliall be growing in every fuch Year ; and if any Perfon or Perfons, who {hall plant, or caufe to be planted or grow, any Hops within or upon any Ground whatfoever in Great Britain, fhall negledt to give or fend fuch Notice in Writing, of his, her or their Hop Grounds as aforefaid, within fuch Time as is before-mentioned, contrary to the true Meaning of this A£t; then and in every fuch Cafe, the Offender therein, for ev;ry fuch Offence, fliall forfeit and lofe the Sum of forty Shillings, for every Acre, by Eflimation, of fuch Ground, and after that Rate for a greater or leffer Quantity. VII. Provided always. That the Perfon or Perfons who are to give fuch Notice as aforefaid, fhall not be obliged, for the doing thereof, to go or fend farther than the next Market Town to the Place where the faid Hops fhall be planted or growing ; and the Officer who (hall receive the faid Notice fhall, within five Days after fuch Notice Ihall be given or fent to him, from time to time, enter the fame in a Book to- it in five Days, on be kept at the faid next OfHce for that Purpofe, upon Pain of forfeiting, for every Negle£l therein, tlie Penalty of 40s. g^j^ ^f forty Shillings to the Party whofe Notice fhall not be fo entred. And be it further enafted by the Authority aforefaid, That no Perfon or Perfons whatfoever, houfe, &c to be ^j^^jj ^^ ^^^ Time or Times, from and after the firft Day of Aiiguji one thoufand feven hundred and eleven, during the Continuance of the faid Duties upon Hops, make ufe of any Oufl, Store-houfe, or other Place, or of any Kiln, for curing or keeping of Hops, chargeable with any the Duties aforefaid, unlefs Notice of fuch Oufl, Store-houfe, Place, or Kiln, fhall have been before given, or fent in Writing as aforefaid, upon Pain of forfeiting the Sum of fifty Pounds for every Offence. IX. And it is hereby further enaiSted by the Authority aforefaid. That all fuch Hops as in any Year,. during the Continuance of this A£t, fhall grow in Great Britain as aforefaid, fhall by the refpeftive Owners or Planters thereof, within fix Weeks after the gathering or picking of the fame, be brought to. be cured and bagged at fuch Oufts, or other Places to be notified as aforefaid, and none other ; upon Pain of forfeiting the Sum of five Shillings for every Pound Weight of the faid Hops, which fhall not be fo brought, cured and bagged,' as aforefaid. X. And be it further enacSed by the Authority aforefaid. That the refpedlive Planters or Owners of the faid Hops to grow in Great Britain, or their Agents, before the bagging of the fame, fhall give or fend Notice in Writing under his or their Hands to the next Office of Excife, or to the proper Officer for the faid Duty, of the precife Day or Time on which he, fhe or they fhall bag his, her or their Hops : Which Notice, as to fuch Hops as fhall be bagged within the firfl Week after the Planter or Owner firfl begins to bag his Hops, fhall be given or left at leafl four and twenty Hours before every Day's bagging of the fame ; and as to the Remainder of his Hops for that Year fhall be given or left at leafl eight and forty Hours before every Day's bagging of the faid Remainder, to the End fome one or more of her Majefly's fworn Officers of Excife may (without his or their own wilful NeglecSt or De- fault) ' . -^ . ,,..,. , ,, , . . , , ... under Pa Owner, in not giving or fending fuch Notice as aforefaid. XI. And be it further enaaed by the Autiiority aforefaid. That the proper Officer of Excife for the Diffria in which the faid Hops fliall grow, or fomc other fworn Officer of Excife, by Appointment of the Commilfioners of that Revenue, fhall attend and be prefent at the Bagging of every Parcel of fucb Hops as aforefaid, and at the Weighing of the fame, and fliall caufe the true Weight of every Bag or Pocket of the faid Hops, great or fmall (fuch T.re of the Bag as is allowable by this Aft only excepted} to be plainly and vifibly marked in one or more Places upon every Bag of the faid Hops ; and fhall then alfo caufe an Entiy of tiie faid Weight (the Tare being abated) to be made in his Book, and fhall thereof make Return or Report in Writin to the refpedlive Commiffioners of Excife, or fuch as they fhall re^- fpeftively appoint to receive the fame, leaving a true Copy (if demanded) of fuch Report in Writing under his Hand, with or for fuch Planter or Owner refpectively ; and fuch Return or Report of the fkid Officer or Officers fhall be a Charge upon the faid Planters or Owners refpeftively ; and if the faid Officer or Officers fliall refufe or negleft to give or leave a true Copy of fuch Report in Writing, with or for fuch Planters or Owners refpettively, at the Time of taking fuch Account (upon Demand as aforefaid) every fuch Officer for fuch Oftence Ihall forfeit and pay the Sum of five Pounds to every fuch Planter or Owner refpedlively. XII. Provided always. That every Officer, who fhall be impowered to make fucb Charge as aforefaid^ fliall, in the firft Place, be fworn to the due and faithful Execution of his Office ; and the Oath in that Behalf fliall and may be adminiflred by all or any of the Commiffioners of Excife, or by any of her Majefty's Juflices of the Peace, who fhall give to fuch Officer a Certificate thereof.. XIII. Provided always, and it is hereby declared and enadled. That an Allowance after the Rate of allowed for Tare ^^^ Pounds fer Centum, fliall be made upon the Weight of every Bag or Pocket of the Hops to be of the Bag. vveighed as aforefaid, great or fmall, for the Tare of the fame Bag ; any thing herein contained to the contrary notwithftanding. XIV. And be it further enafted by the Authority aforefaid. That all and every Perfon and PerfonS. whatfoever, who fhall be the Planters or Owners of the faid Hops, fliall, within fix Months after the Time in which every Parcel of the faid Hops fhall or ought to be cured, bagged and weighed, as afore- faid, pay and clear off all the faid Duties of Hops of the Growth of Great Britain, that fhall be due from him, her and them lefpeftively ; and that all and every fuch Planters and Owners, who fball refufe or negled: to make fuch Payment as aforefaid, fliall forfeit and lofe to her Majefty, for every fuch Of- fence, double the Sum of the faid Duty, whereof the Payment fliall be fo refufed or negledled, that is ta fay, two third Parts of the faid double Duties to the Ufe of the Queen, and the other third Part to the Ufe of the Informer or Profecutor. XV. And be prefent at the Bagging, Weighing, and Marking of the fame, as are herein afte'r prefcribed. Pain of forfeiting the Sum of hfty Pounds_for_ every Negle6t or Default of any fucn Planter or Officer lo attend the bagging and weighiiigj and mark the Weight on the Bag, and irake Entry and Return ac- cordingly. A Copy of the Return to be left with the Planter. Officer not leaving Return, forfeits 3I. Officer to be Iworn. 10 1. per Cent. Planters to clear off m fix Months.
