Payment of r.ny Sum of Money upon the Lofs of any Ship or Goods, or upon any Lofs by Fire, or for any o.hcr Purpoie for which any Writing, commonly called a Policy of Aflurance or Infurance, is or hath been ufually made, fliall be conftrued, deemed and adjudged to be Policies of Aflurance within this ■A£t, and to be charged with the Duty lait mentioned. Commiflioncrs LXIX. And be it further enafted, Tiiat the fame Duty upon fuch Policies, Deeds, Inftruments, and «f the Stamps Writings, as aforefaid, fliall be under the Government of the Commiflioners for the time being, appointed to manage thefe j.^ manage the Duties charged on ftampt Vellum, Parchment and Paper, who, or the major Part of them, are hereby required and empowered to employ the necelfary Officers under them for that Purpofe, and to caufe one or more new Stamp or Stamps to be provided, to denote the fame Duty, and to do all other Things neceffary to be by them done for the putting this Atft in due Execution, with relation to the fame Duty. . Deed, Inftrument, or Writing, as aforefaid, or fign, feal, execute, or fubfcribe the fame, before itJie Vellum, Parchment, or Paper, v/hereupon the fame fliall be printed or written, fliall appear to have been fo duly ftamped or marked, that then every fuch Perfon fo offending fliall, for every fuch Offence, forfeit the Sum of five Pounds; the one Moiety thereof to her Majefty, her Heirs and Succeffbrs, ahd the other Moiety thereof, with Full Coils of Suit, to fuch Perfon or Perfons as fliall inform and fue for the fame in any of her Majefty 's Courts of Record, by Aftion of Debt, Bill, Plaint, or Information, where- in no Eflbin, Privilege, Prote£lion, orWa,er of Law fliall be allowed; and that if any fuch Policy of Affui-ance fhall, during the Term laft mentioned, be ftgned, fealed, executed, or fubfcribed, upon Vel- lum, Parchment or Paper, not appearing to have been duly ftamped or marked according to Law, that 'then and in every I'uch Cafe, there ftiaU be paid to her Majefty, her Heirs and Succeffors (over and above ■ 'No fuch Policy the Duties hereby payable) for every fuch Policy of AflTurance, the Sum of five Pounds ; and that no fuch good, till5l.be Policy of Aflurance fhall be available in Law or Equity, or be given in Evidence, or admitted in any paid to the Court, unlefs as well the faid Duty hereby charged, as the faid Sum of five Pounds fliall be firft paid to 'Dur°b 'al'f ^ the Ufe of her Majefty, her Heirs or SuccelTors, and a Receipt produced for the fame, under the Hand ,,2y_ of the Receiver General for the time being of the Stamp Duties, or of his Deputy or Clerk, and until the Vellum, Parchment or Paper, on which fuch Policy of Affiirance is fo figned, fealed, executed, or fub- fcribed, fhall be marked or ftamped according to the true Meaning hereof; and the faid Receiver General, and his Deputy or Clerk, are hereby enjoined and required, upon Payment or Tender of the faid Duty payable by virtue hereof, and of the faid Sum of five Pounds, to give a Receipt for fuch Money, and the other proper Officers are thereupon required to mark or ftamp fuch Policy of Affurance with the proper Mark or Stamp requifite in that B.half. •'Ce'inferfeiiing LXXII. And be it further enaifled.
