D. 1716. venues and proportional Parts, or any of them, applicable to the Payment of the faid yearly Funds, An- nuities or Sums of Money, or any of them, payable to the faid Governor and Company as aforefaid, fhall, from Time to Time, be brought into the Receipt of the Exchequer for Payment thereof, fuch Mo- nies fhall and may be iffued upon fuch Order and Orders for or towards difcharging the faid yearly Funds, Annuities and Sums of Money to grow due for or at the End of the Quarter of the Year in which fuch Iffues or Payments fhall be made, fo as fuch weekly or other fpeedy Payments do not exceed the Sum of the quarterly Payment which fhall grow due for or at the End of fuch Quarter refpectively. And for better fecuring to the faid Governor and Company of Merchants of Great Britain, and their continued, 5ucceffors, all the Payments intended to be made to them by virtue or in purfuance of this Act, It is here- by enacted by the Authoriry aforefaid, That all and every the Rates, Subfidies, Impofitions, additional Impofitions and other Dirties and Revenues whatfoever, and all proportional Parts of them, or any of them, which were applicable to the Payment and Satisfaction of the faid yearly Fund of fix hundred thou- fand Pounds, and the faid former yearly Sum of eight thoufand Pounds, during the Continuance thereof, are and fhall be continued and be payable to his Majefty, his Heirs and Succeflors, for ever, for fatisfying and difcharging as well the faid yearly Fund of fix hundred thoufand Pounds, and the faid former yearly Sum of eight thoufand Pounds, and all Arrearages of them, which are or fhall be due at or before the faid Feaft of the Nativity of St. "John Baptiji one thoufand feven hundred and eighteen as aforefaid, as alio the laid yearly Fund of five hundred thoufand Pounds, and the faid yearly Sum of eight thoufand Pounds here- after to be paid, and all and every fuch new Annuity and Annuities, after the Rate of five Pounds per Cen- tum per Annum, for the faid Sum of two Millions, or fo much thereof as fhall be advanced upon this Acl:, fubjefi to Re- and every of them, in the Order, Manner and Form before in this Acl: prefcribed in that Behalf, and fub- damption, and j ec ^ to f ucn Redemption as aforefaid, according to the Tenor and true Meaning of this Act ; and that the by th/forme" '" ame P- ates > Subfidies, Impofitions and other Duties, Revenues and proportional Parts before-mentioned, Atts, and every of them, fhall be raifed, levied, .collected and brought into the Exchequer in England for the fame Purpofes, by and according to fuch Rules, Methods and Directions, and with fuch Drawbacks, Re- payments and Allowances, and under fuch Penalties, Forfeitures and Difabilities, as are prefcribed by any Act or Acts of Parliament now in Force, or by any Articles, Claufes, Matters or Things therein con- tained or thereby referred unto for raifing, levying, collecting or bringing in of the fame, as fully and ef- fectually as if the fame Acts, Articles, Claufes, Matters and Things, and every of them, were repeated and re-enacted in the Body of this prefent Act ; and that all the Monies which fhall be brought into the Receipt of the Exchequer of the faid Rates, Subfidies, Impofitions, additional Impofitions and other Du- ties and Revenues, and all proportional Parts of them, for the Purpofes aforefaid, fhall be fairly and di- and to be entred ftinctly entred and regiftred in one or more Book or Books to be kept in the Offices of the Auditor of the ^ t ^°°| i i ." ltbe Receipt and Clerk of the Pells, feverally for that Purpofe, to which all Perfons concerned, at all feafon- Lqu r " able Times, fhall have free Accefs without Fee or Charge. Thefe Duties XI. And it is hereby alfo enacted, That all the Monies of the faid Rates, Subfidies, Impofitions and th^u^Yv' other Duties and Revenues and proportional Parts of them, or any of them, which fhall or ought to be a q_ eso ' brought into the Receipt of the Exchequer for the Purpofes aforefaid, (except the necefTary Charges of raifing, collecting, levying, iiTuing, paying and accounting for the fame, and except fuch Part thereof as. by any former Act of Parliament is applicable to the Repayment of Loans frill remaining unfatisfied, and- to pay the Intereft of the fame) fhall be and are hereby appropriated, and fhall be iffued and applied to and for the Payment and Satisfaction of the faid yearly Fund of fix hundred thoufand Pounds, and of the faid former yearly Sum of eight thoufand Pounds, due or to grow due at or before the faid Feaft of the Na- tivity of St. John Baptiji one thoufand feven hundred and eighteen, and to and for the Payment and Satis- faction of the faid yearly Fund of five hundred thoufand Pounds, from and after the faid Feaft of the Na- tivity of St. John Baptfft one thoufand feven hundred and eighteen, and the faid growing yearly Sum of eight thoufand Pounds, and to and for the Payment of the faid Annuities after the Rate of five Pounds per Centum per Annum, hereafter to be acquired by virtue of this Act, and every of them, in their due Method and Order before prefcribed, according to the Tenor and true Meaning of this Act, and without any Fee or Charge whatfoever to be paid by the faid Governor and Company for the fame, or any Part thereof, but fubject to fuch Redemption as is herein after prefcribed, and to none other Ufe, Intent or Purpofe Penalty on Of- whatfoever : And that the refpective Officers of the Exchequer, who fhall make any Delay in iffuing or fieers of the Ex- paying the fame, or fhall be guilty of diverting or misapplying any the faid Monies contrary to this Act, hig? &' 'the'" f° r an Y f ucn Offence fhall be forejudged from their refpective Offices or Places, and be rendred incapable Monies.' to ferve his Majefty, his Heirs or Succeffors, in any Office or Imployment of Truft or Profit whatfo- ever, and fhall alfo be liable to pay double the Value of any Sum or Sums of Money fo delayed to be paid, or fo diverted or mifapplicd as aforefaid, to the faid Governor and Company of Merchants of Great Britain, and their Succeffors; to be recovered by Action of Debt, Bill, Suit or Information in any of his Maje- fty's Courts of Record at Wejlminjier, wherein no Effoin, Protection or Wager of Law, or more than one Imparlance fhall be granted or allowed.
