C. 19. 217 thofe PurpBfes, then and fo often, .and in every fuch Cafe, the Deficiency of any fuch Quarter fhall and may be fupplied out of the Overplus Monies of the faid Duties and Revenues, every or any of them, arilmg in any fubfequent Quarter ; and in default thereof by the Space of a Half Year, then all and eve- ry fuch Deficiency and Deficiencies (hall be fupplied and made good, from Time to Time, by or out of the faid general yearly Fund by the faid other Act of the third Year of his Majefly's Reign, cftabiifhed or intended to be eftablifhcd, as aforefaid, or out of Money to be railed at the Exchequer for purchafmg an Annuity or Annuities after a Rate not exceeding five Pounds per Centum per Annum., for every fuch De- ficiency ; which Annuity or Annuities fhall, by virtue of this Act, be charged on the faid general yearly Fund, and be payable and transferable at the Panic of England, as other Annuities payable out of the faid general yearly Fund are intended by the faid other Act of the third Year of his Majefly's Reign to be 3 Geo. i. c. 7. payable and transferrable, until the Redemption thereof by Parliament ; and if at any Time or Times any fuch Deficiency fhall be paid to the laid Corporation by fuch Annuity or Annuities charged on the faid general yearly Fund, the Difcount of fuch Annuity or Annuities which fhall be necefiary for con- verting the fame into ready Money (if any fuch Difcount fhall happen) fhall, by order of the Ccmmif- jioners of the Treafury, or three or more of them, or High-treafurer for the Time being, be fatisfied to the faid Corporation out of the fame general yearly Fund, or put of Money to be railed at the Exchequer for purchafmg a like Annuity or Annuities at the fame Rate, to be charged on the fame general yearly Fund, and to be payable and transferrable, as aforefaid, until the Redemption thereof by Parliament : And for the better and more regular Payment of all Monies intended by the faid Act of the third Year of his Majefly's Reign, for Redemption of the then yearly Fund of the faid Corporation, to be paid to the fame, fubject neverthelefs to fuch Redemption, as aforefaid, the Commiffioners of the Treafury, or the High-treafurer for the Time being, are hereby impowered and required to fign and iffue out fuch Order and Orders for Payment of all fuch Sum and Sums of Money as by this or the faid lafl mentioned A£l are or fhall become due and payable to the faid Corporation, and alio for raifing out of and upon the faid general yearly Fund eflablifhed by the faid recited Act of the third Year of his Majefly's Reign, io much as fhall be requifite and necefiary to pay to the faid Corporation all fuch Deficiency and Deficiencies as are in and by this Act directed to be paid to them ; and after figning fuch Order or Orders the fame fhall be firm, good, valid and effectual in the Law, according to the Purport and true Meaning thereof, and of this Act, and fhall not be determinable by or upon the Death and Removal of any Commifiioner or Com- miffioners oi' the Treafury, or High-treafurer, or Under-treafurer for the Time being, or by or upon the Determination of the Power, Office and Offices of them or any of them ; nor fhall any Commifiioner of the Treafury, or High-treafurer for the Time being, have any Power to revoke, countermand, or make void fuch Order or Orders fo figned, as aforefaid. XXIV. And be it further enacted by the Authority aforefaid, That the Share and Interefl of every The Shares to Member of the faid Corporation, of and in the prefent capital Stock of the fame, and of and in the In- be pe ereafe of fuch Capital, to be had and made in purfuance of this Aft, and of and in the faid Annuity and E(litcs - Annuities, after the Rate of five Pounds per Centum per Annum, payable or to be paid for the fame to the faid Corporation, and of and in the faid eight thoufand Pounds and two thoufand Pounds per Annum, or a proportionable Part of the faid two thoufand Pounds per Annum, by this Act payable for Management, ihall be and be adjudged to be a perfonal and not a real Eflate, and fhall go to the Executors or Admini- flrators of the refpective Perfons dying poffeffed thereof or entitled thereunto, and not to the Heirs of fuch Perfons ; any Law, Cuftom or Ufage to the contrary hotwithflanding : And that the refpective Members shares transfer! of the faid Company, who fhall have a Share or Intereft in the prefent capital Stock, or increafed Stock ra'ble and de- thereof, as well for and in refpect of the faid Lottery-annuities and Arrears thereof, which fhall be fub- vilsab ^' fcribed as aforefaid, as for or in refpect of the faid Sum of feven hundred feventy-eight thoufand feven hundred and fifty Pounds, or fuch proportional Part thereof as fhall be actually paid by the faid Corpora- tion into his Majefly's Exchequer as aforefaid, (including therein fuch Deductions, Abatements and Re- coupments as are allowed or permitted to be made by the faid Corporation as aforefaid) fliall and may af- fign and transfer fuch Share or Interefl, or any Part thereof, in the Books of the faid Company, in fuch or the like Method, Manner and Form as are prefcribed by the Act- or Acts of Parliament and Charter Vol. V.
