I. ■« T THEREAS by an Act paffed in the feventh Year of the Reign of his prefent Majefty, inti-

W tilled, An Ac! for repealing an Ail made in the ninth Year of the Reign of her late Majefty £>ueen Anne, intituled, ' An Act to oblige Ships coming from Places infected, more effectually to perform their Quarentine ;' and for the better preventing the Plague being brought from foreign Parts into Great Bri- 1 tain crlreland, or the IJles g/"Guernfey, Jerfey, Alderney, Sark or Man ; and to hinder the fpreading of '■ Infeclion, It is amongft other Things enacted, That if any Perfon infected with the Plague, or obliged ' to perform Quarentine, fhall wilfully refufe or neglect to repair within convenient Time, after due No-

tice for that Purpofe given to him, her or them, by the proper Officer to the Ship, Houfe, Lazaret or
other Place, duly appointed for him, her or them, or having been placed in fuch Ship, Houfe, Lazaret, or
other Place, fhall efcape or attempt to efcape out of the fame, whilft he, fhe or they fhall continue in—
fected, or before Quarentine fully performed refpectively, it fhall and may be lawful to and for the
Watchmen and other Perfons appointed to fee Quarentine performed, by any Kind of Violence that
the Cafe fhall require, to compel every fuch Perfon fo refufing or neglecting as aforefaid, and every fuch
Perfon fo efcaping or attempting to efcape as aforefaid, to repair or return unto fuch Ship, Houfe, La-
zaret or other Place fo appointed for him or her as aforefaid ; and every fuch Perfon fo refufing or neg-
lecting to repair within convenient Time after fuch Notice as aforefaid, into fuch Ship, Houfe, Laza-
ret or other Place appointed for him or her as aforefaid, and alfo every Perfon actually efcaping as afore-

c faid, (hall be adjudged guilty of Felony, and fhall fuffer Death as a Felon without Benefit of Clergy :

And it is by the faid recited Act alfo further enacted, That if at any Time or Times hereafter, any

' City, Town or Place within Great Britain or Ireland, fhall be infected with the Plague, It fhall and

may be lawful to and for his Majefty, his Heirs and Succeffors, to caufe one or more Line or Lines,
Trench or Trenches, to be caft up or made about fuch infected City, Town or Place, at a convenient

s Diftance from the fame, in order to cut off the Communication between fuch infected City, Town or

Place, and the reft of the Country; and to prohibit all Perfons, Goods and Merchandizes whatfoever,

' to enter, pafs or be carried over fuch Lines or Trenches, unlefs in fuch Cafes and by fuch proper Li- c cence, and fubject to fuch Regulations and Reftrictions for Performance of Quarentine, as fhall be di-^ ' rected or permitted by any Order or Orders made, or to be made by his Majefty, his Heirs or Succef- 5 fors in Council, and notified by Proclamation ; and in cafe any Perfon or Perfons, being within fuch ' Lines or Trenches or any of them, fhall during the Time of fuch Infection, prefume or attempt to 5 come out of the fame, unlefs in fuch Cafes, and by fuch proper Licence, and fubject to fuch Regulati- ' ons and Reftrictions for Performance of Quarentine, as fhall be directed or permitted by fuch Order or ' Orders made or to be made, and notified as aforefaid ; it fhall and may be lawful to and for the Watch- ' men, or Perfons appointed to guard or fecure fuch Lines or Trenches or any of them, by any Kind of ' Violence that the Cafe fhall require, to compel all and every fuch Perfon and Perfons to return back ' within fuch Lines or Trenches, and in cafe any Perfon fhall actually come out of fuch Lines or Trenches, ' or any of them (unlefs in fuch Cafes, and by fuch proper Licence, and fubject to fuch Regulations and ' Reftrictions as aforefaid) every fuch Perfon fhall be adjudged guilty of Felony, and fuffer Death as a ' Felon without Benefit of Clergy : And whereas the Execution of the Powers and Authorities mentioned ' in the faid recited Claufes might be very grievous to the Subjects of this Kingdom ;' Be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That the faid recited Claufes and the Powers therein mentioned, and all other Powers in the faid Act, to compel any Perfon or Perfons to remove from his, her or their Habitations, to any Ship, Lazaret or other Place, fhall be and are hereby repealed and made void from and after the five and twentieth Day of March one thoufand feven hundred and twenty-two. about any City, Stc. infected, or to compel Perfons to remove from their Habitations, repealed after March 25, 1722. II. Provided always, That nothing in this Act contained fhall be conftrued to repeal or make void any of the Powers or Penalties in the faid recited Act mentioned, relating to Perfons who fhall be on boaro any Ship obliged to perform Quarentine, or fhall come on Shore, or go on board any other Ship from any Ship obliged to perform Quarentine, but that fuch Powers and Penalties fhall be and remain in as full Sarin? to Perfons Force as if this Act had not been made.
