  • backs on the Exportation of Wines, it is enacted, That in cafe any Merchant or other Perfon importing

' Wines fhall find the fame, or any Part thereof fo damaged, corrupt or unmerchantable, that he fhall rc- ' fufe to pay or fecure the Duties of fuch Wines, and fhall thereupon ftave, fpill or otherwife deftroy the ' fame, as by the faid Act he is allowed to do, in the Manner therein mentioned, fuch Merchant or other ' Perfon, /hall as a Compenfation for the Freight and other Charges, have the Sum of four Pounds for

  • every Tun of Wine, containing two hundred and fifty-two Gallons, of the Grov/th of Germany, or

' Wines which pay Duties as fuch, and of the Growth of France, fo /laved, fpilt, or otherwife de- ' ftroyed, and the Sum of eight Pounds per Tun, for every Tun of Wine of the Growth of Spain, Por-

  • tugal, or elfewhere, and fo in Proportion for a greater or lefler Quantity, to be paid in the Manner

' thereby directed ; which feveral and refpedtive Allowances were made with regard to the Diftances of ' the Places from whence the faid feveral Sorts of Wine arc ufually imported : And whereas fince the ' making of the faid Act, great Quantities of mean and corrupt Wines have been imported from the Ifle ' of Man, the Freight whereof was inconfiderable, and ftaved for the Benefit of the above-mentioned Al- ' lowances for Freight and Charges, contrary to the true Intent and Meaning of the faid Act, which fraudulent Practice may not only, from the Encouragement before-mentioned, be continued from the After 25 March Growth of fuch Wine, or the ufual Port or Place of its fir ft /hipping ; any Thing in the faid Act to the from the Place contrary notwithstanding. of its Growth. 4 Houfe- Money, it is enacted, That every Licence taken out for the Importation of Nutmegsj Cloves, V melT°&°. to^e ' Mace or Cinnamon, in the Manner therein directed, fhall be delivered to the Merchant demanding the delivered to the

it therefore enacted by the Authority aforefaid, That in cafe the Mafter, Purfer, or other Perfon taking ' mp ° r ° ' Charge of any Ship, importing any of the faid Spices from any Place or Places beyond the Seas, other than directly from the Eaft -Indies, /hall not deliver up fuch Licence to the Collector and Comptroller of the Port into which the faid Spices fhall be imported, at the Time of his or their entring the faid Ship, regularly indorfed, as in and by the faid Art is directed, and alfo annex fuch Licence to the Entry or Report of the Ship ; and in cafe each Cask of Nutmegs, Cloves or Mace fo imported, fhall not contain Penalty in cafe neat three hundred Pound Weight, and each Bale of Cinnamon neat feventy Pound Weight, as by the ° f Deficiency m •faid Act is directed ; then and in any of the faid Cafes, fuch Nutmegs, Cloves, Mace or Cinnamon fhall c^f'^". be forfeited, and deemed to be imported without a Licence, granted or to be granted by Virtue of the faid Act, or any former Law, and fuch Spice fhall and may be profecuted, as alfo the Ship importing the fame, by any Act or Acts of Parliament now in Force relating to the Cuftoms, as if fuch Spice had ■been imported without Licence; any Law, Cuftom or Ufage to the contrary notwithftanding.
