D. 17.14. recovering the Penalties and Forfeitures, and making any Mitigations or Allowances, and all other Mat- ters and Things, during the Continuance of this Act, as fully, as if the fame were particularly and at large repeated in the Body of this prefent Aft. " This Aft to relate to the fame Day and Time as the former Aft. A Regifter to be kept, for transferring " the principal Sums, &c. due on the Malt Aft 1713, to the Regifter of this Aft. Claufe of Loan at 4/. " per Cent. Money lent not to be taxed. Orders for Payment affignable." •Duty to be paid ' VIII. And whereas by the aforefaid Afts it is enafted, That every Mahler, or other Maker of Malt, within four < fhall, within three Months after he fhall make or ought to have made fuch Entry of the faid Malt, as ' Months alter « therein is direfted, pay and clear off all the Duties whilih fhall be due from him or them refpeftively ;* n " ry ' It is hereby further enafted, That the i ime limited by the aforefaid Aft for the Payment of the faid Duty, be prolonged for one Month after the faid three Months from the Time of fuch Entry.

And whereas it has lately been difcovered, that great Quantities of unmalted Corn or Grain have 4 fraudulently been mixed with and amongft Malt, which hath or ought to have been charged with the '" Duties by feveral Afts of Parliament fet and impofed upon all Malt made in Great Britain, and that
- fuch Mixture hath afterwards been either fold in the Kingdom of Great Britain, or hath been fhipped off
- for Exportation, and the Perfon or Perfons by whom, or for or upon whofe Account the fame hath been.
4 fo fhipped off, hath or have thereupon claimed, and had the Drawback and Bounty in proportion to the 5 whole Quantity of fuch Mixture fo fhipped off, as if the fame had totally and intirely confifted of Malt* 5 for which the Duty had been duly paid or charged, whereas in truth great Part thereof hath at fuch ■* Time and Times confifted either of unmalted Corn, or Grain for which the. Duty on Malt had never
- been paid or duly charged, whereby her late Majefty Qyeen Anne, and his prefent Majefty hath been
4 very much defrauded in the Duty granted upon Malt, and the Perfons who have bought fuch Mixture, 4 have by the Means .aforefaid been very much deceived and impofed upon ;' For Remedy whereof, Be Unmalted Grain it enafted by the Authority aforefaid, That if any Malfter or Maker of Malt for Sale or Exportation, or mixed with other Seller of or Dealer in Malt for Sale or Exportation, at any Time after the twenty-fourth Day of ss^aBufheL? J me one thoufand feven hundred and fifteen, fhall or do, with Malt made of any Sort of Corn or Grain whatfoever, fraudulently mix or caufe to be mixed any unmalted Corn or Grain, or fhall fell, or offer to fell, or expofe to Sale any fuch Mixture, or fhall fhip off, or put on board, or caufe to be fliipped off, of to be put on board, or fhall offer or attempt to fhip off or put on board any Ship, Hoy, Barge, Boat, or -other navigable Veffel, any fuch Mixture, in order to export the fame, eveiy fuch Malfter or Maker of Malt, or other Seller of or Dealer in Malt, for every Bufliel of fuch Mixture fo fold or offered to be fold, or expofed to Sale, or fo fhipped off or put on board, or offered, or attempted to be fliipped off, or put on board any Ship, Hoy, Barge, Boat, or other navigable Veffel, in order to the Exportation thereof, fhall forfeit and lofe the Sum of five Shillings. And be it further enacted by the Authority aforefaid, That if any Malfter or Maker of Malt for ing Officer, for- Sale, fhall, after the faid twen*y~fourth Day of J.une one thoufand feven hundred and fifteen, prevent, ob- ieits ioJ. ftruft orJhinder any Officer or Officers of Excite, in the due Execution of any of the Powers or Autho- . rides given to him or them by this Aft, or by the faid recited Aft. or Afts, or any or either of the i;, for the ascertaining and fecaring the faid Duties hereby or by the faid recited Aft or Afts, or any or either of them, granted, the Perfon or Perfons offending therein fhall, for every fuch Offence, forfeit and lofe the Sum often Pounds, ■Fises 3 &c. how XV. And be it further enafted by the Authority aforefail, That all Fines, Penalties and Forfeitures by to be levud. this Aft 'impofed, fhall be fued for, levied and recovered, or mitigated by fuch Ways, Means and Me^ thods, as any Fine, Penalty or Forfeiture, is or may be recovered or mitigated by. any Law or Laws, of Excife, or by Aft ion of Debt, Bill-, Plaint, or Information, in any of his Majeity's Courts of Record at Wejhnmjler, Or in the Court of Seffion, Court of Judiciary, or Court of Exchequer in Scotland refpeftive- ly ; and that one Moiety of every fuch Fine, Penalty and Forfeiture fhall be to his Majefty, or his Heirs and Succeffors, and the oiher.
