' Laws therein mentioned, -which are expired and near Expiring., there are feveral good Claufes and Provi- f fions relating to Jurors, which were made temporary, and were afterwards continued by fubfequent A-' 1 ; f and the faid Claufes and Provifions, as well as feveral other Claufes and Provifions, relating to the Re- ' turns and Service of Jurors, made in an Act of the third and fourth Years of the Reign of her late Ma- 3&4Ann.c.i8. f jefty Queen Anne (tor making perpetual an Act for more eafy Recovery of fmall Tithes, and for other ' Purpofes therein mentioned,) are further continued by an Act. of the tenth Year of the Reign of her laid IO Ann ' c - '4' ' late Majefty (For reviving and continuing feveral Acts therein mentioned) but being near expiring,' Be bci ; } Geo- *■ it enacted by the Authority aforefaid, That all the faid Claufes and Provifions relating to Jurors, and to jq^J 2 c ._ the Returns and Service of Jurors, fhall be and are hereby continued, and lhall be in Force from the Ex- piration thereof, for and during the Space of feven Years, and from thence to the End of the next Sefiion of Parliament. III. And be it enacted by the Authority aforefaid, That an Act made in the firft Year of his prefent 1 Geo. i.-Srat. a. Majefty's Reign, intituled, An Act to prevent Dijlurbances by Seamen and others, and to preferve the Stores c - 2 5- belonging to his Majefty 's Navy Royal, and aljo for explaining an Act for the better preventing the Imbezilment of bis Majefty s Stores of War, and preventing Cheats, Frauds and Abufes in paying Seamens i Pages, and for re- viving and continuing an Act for the more eftfcftual Supprejfion of Piracy, as to io much thereof as is expired, lhall be, and is hereby revived from the five and twentieth Day of March one thoufand feven hundred and twenty-three, and made perpetual : ' And whereas by an Act made in the ninth and tenth Years of the 9 & 10 w, 3. Reign of his late Majefty King William the Third, intituled, An Ail for the better preventing the Im- c " 4I " bezilment of his Majefty' s Stores of JVar, and preventing Cheats, Frauds and Abujes in paying Seamens TP'agcs, a Penalty of two hundred Pounds, with Cofts of Profecution and Pain of Imprifonment, is inflicted upon Perfons having in their Cuftody, Pcffeffion or Keeping, or concealing contrary to the faid Act, any warlike, naval or ordnance Stores therein mentioned, or any other Stores marked with the Broad Arrow, by Stamp, Brand, or otherwife : And whereas it is neceffary to give Power to mitigate the faid Penalties, and to explain and amend the faid Act,' Be it enacted by the Authority aforefaid, That if any Perfon or Perfons fhall, after the five and twentieth Day of March one thoufand feven hundred and twen- ty-three, be lawfully convicted of having in his, her or their Cuftody, any Timber, Thick StufF or Plank, marked with the Broad Arrow, by Stamp, Brand, or otherwife, or of concealing any Timber, Thick StufF or Plank fo marked, every fuch Perfon fo offending fhall fuffer, forfeit and pay, as for having, keeping or concealing any other warlike, naval or ordnance Stores contrary to the faid Act. IV. Provided always, and it is hereby further enacted, That it fhall and may be lawful to and for any Judge, Juftice or Juftices, before whom any Offender or Offenders fhall be convicted of any of the Crimes or Offences before recited, enacted or mentioned in this Act, to mitigate the Penalty for the fame, as he or they fhall fee Caufe, and to commit the Offender or Offenders fo convicted, to the Common Gaol of the County or Place where the Offence fhall be committed, there to remain without Bail or Mainprize, until Payment be made of the Penalty and Forfeiture impofed by this or the faid former Act, or mitigated as aforefaid, or to punifh fuch Offender or Offenders corporally, by caufing him, her or them to be publickly whipped, or committed to fome Publick Workhoufe, there to be kept to hard La- bour for the Space of fix Months, or a lefs Time, as to fuch Judge, Juftice or Juftices, in his or their Difcretion fhall feem meet ; any Thing in the faid recited Act, or in any other Act to the contrary not- withftanding. V. And be it further enacted, That where any Difpute fhall arife between the Perfons, upon whofe Informations or Oaths, any Perfon or Perfons offending in the Premiffes, or againft: the faid former Act, fhall be profecuted and convicted, touching any Right or Title to any of the forfeitures or Penalties be- fore-mentioned, or any Part thereof, the Judge, Juftice or Juftices before whom- fuch Offender or Offen- ders fhall be convicted, fhall examine the Matter and finally determine the fame. VI. And be it further enacted by the Authority aforefaid, That an Act made in the firft Year of his 'Geo. i.Stat.aj prefent Majefty's Reign, intituled, An Aft for making the Militia of that Part of Great Britain called Eng- c " I4> land, more ufeful ; and for obliging an annual Account to be made of Trophy- Money , which is expired, fhall be and is hereby revived, and fhall be in Force from the five and twentieth Day of March one thoufand feven hundred and twenty-three, for and during the Space of feven Years, and from thence to the End of the then next Seffion of Parliament. EXP. ' VII. And whereas the Muskets for Foot Soldiers in the Militia, are by the faid recited Act prefcribed iGeo. i.Stat.a; ' to be five Foot long in the Barrel, and the Gauge of the Bore for Bullets of twelve to the Pound, but £■ x 4- ka - 3- "' more convenient Muskets may in many Places be provided :' Be it enafted, That it fhall and may be f°" C Zr'cbfr Gn lawful for the feveral Lieutenants, and their Deputies, in that Part of Great Britain called England, to z' (TarT 7 ;o°' appoint the Length and Size of Muskets for Foot Soldiers in the Militia ; and in cafe of fuch Appoint- Geo. 1. c. 25. merit, the Muskets fo to be appointed, fhall be provided, inftead of thofe before-mentioned, with fuch 3iG«.a. <-• 26. other Arms and Accoutrements, as are directed by the faid Act, under the Penalties therein mentioned ; Z~ G f- 2 - c - io - any Thing in the faid Act, or any former Act to the contrary notwithftanding. 33 «••-*■ c - *> ' VIII.
