And whereas it hath been found ufeful and neceflary to inftitute a Profeflbr of Civil Law in the 442 What Powers to be enjoyed by the Profeflbr of Civil as any "Vacancy fhall happen in that Office, the fame fhall be fupplied in the fame Way and Manner, as y ' is before directed concerning the Profeffors of Univcrfal Civil Hiftory, Greek and Roman Antiquities, and of Scots Law. For Payment of forty-four Pounds ten Shillings annually toMinifters of South Leithl to be proportioned betwixt them at the Sight of the Overfeers, fo as to make their Stipends equal, and for Payment of thirty-three Pounds fix Shillings and eight Pence annually to the Treafurer of the Canon- Gate, for Payment of an additional Stipend to their Minifters, to be proportioned betwixt them at the Sight of the Overfeers, fo as to make them equal; both to commence and grow due from the fifteenth Day of May one thoufand feven hundred and twenty-three, the firft Moiety thereof payable the eleventh of November following, and for paying what other Salaries fhall be found neceflary by the Magiftrat.es Mjfers teaching ai:( ] Council, with the Confent of the Overfeers, for M afters and Profeffors to be inftituted and ap- otherlib.-ral ^ pointed, with the Confent of his Majefty, his Heirs and SuccefTors, to teach other Liberal Arts and Sci- videdfor. C F °" e "ces in the faid Univerfity, and Exercifes in the faid City: For Payment of the Sum of fifty Pounds yearly, additional Salary to the Profeflbr of Divinity in the College of Edinburgh, and his SuccefTors in Office, to commence and grow due from and after the firft Day of July one thoufand feven hundred and twenty-three, the firft Moiety thereof payable the firft Day of 'January following ;: And for making and paying Augmentations of Salaries to other Profeffors already eftablifhed, and not fufficiently provided for: And tor Payment of the Intereft of the whole Capital Debt due by the faid City, which hath been bor- rowed in Purfuance of the faid in Part recited Act of the third Year of his prefent Majefty, or hath been inlifted amongft the Debts of the faid City, with the Approbation of the Overfeers, as a Charge upon the Duty thereby continued, or which may be borrowed on or before the firft Day of July next, with the Approbation of the faid Overfeers, or which may be borrowed in Purfuance of the Powers given by this prefent A& : And for defraying the Charges that fhall be approved of by the Overfeers for collecting and applying of this Duty, and other neceflary incident Charges concerning the fame, and for paying ofF the faid Capital Debt of the faid City ; and if any more Money fhall arife by the Impofition hereby granted and continued, than fhall be found neceflary to pay off all the faid Debts, and difcharge the annual Pay- ments, and execute the Purpofes that remain to be compleated as aforefaid, that Overplus Money mall ■ be and is hereby directed to be laid out and applyed for carrying on fuch publick Works as fhall be found neceflary and ufeful for the Service of the faid City, as the fame fhall be fettled and agreed upon by the Magiftrates and Council thereof, and by the Overfeers, to whom the fame fhall be prbpofed, at one of their four Meetings herein after mentioned and appointed ; it being always hereby declared, that any Propofal fo to be made, fhall not be approved by them, or any Directions given about the fame, until there be another Meeting, and the fame Propofals by them in fuch fubfequent Meeting confidered and ap- proved of, and then and not till then, Direction fhall be given for the Execution thereof. ' VI. And for the better explaining and eftablifhing the Way and Manner of levying the faid Duty and ' Impofition within the faid City of Edinburgh, Suburbs and Liberties thereof, and within the faid 1 Paroches of Saint Cuthbert's, Canon-Gate, South and North Leith, with their and every of their Appur- ' tenances, and for avoiding the Multiplicity of Oaths, and keeping an Equality among the Brewers, ' and preventing their being over-charged;' Be it further ena£fed by the Authority aforefaid, That the faid Duty and Impofition lhall be raifed, levied, collected and paid, in the fame Way and Manner, as his Majefty's Excife is now raifed and levied within the faid City and Liberties thereof, and the Charges made by his Majefty's Officers for levying and collecting of fuch Excife, or an Abftract thereof, under the Hand of the Accomptant for the Edinburgh Brewery for the Time being, fhall and are hereby de- clared to be the Rule for levying and collecting the faid Duty and Impofition hereby granted : Provided always, That the faid Magiftrates and Council for the Time being, fhall, and they are hereby impow- ered and required to make to the faid feveral and refpective Brewers as aforefaid, in collecting the faid Duty or Impofition hereby granted, the feveral Allowances, Difcounts and Mitigations which are now made to the faid Brewers by the faid Commiffioners of Excife in Scotland, cr their Officers thereto duly authorifed ; and the Commiffioners of Excife in Scotland for the Time being, are hereby authorized, di- rected and required to appoint their proper Officer or Officers, or the faid Accomptant for the Edinburgh Brewery, from Time to Time, and fo often as the fame fhall be defired by the faid Magiftrates of the faid City, or their Collector or Collectors, true and exact Copies or A'oftracts attefted and figned by the faid proper Officer or Officers or Accomptant, of the feveral and refpective Charges given up by the faid Offi- cers of Excife, upon the feveral and refpective Brewers hereby fubjected to and made liable in Payment of the faid Duty and Impofition, and that without any Fee or Reward ; and that the faid Charges given up, from time to time, by the faid Officers of Excife as aforefaid, fhall be the only Rule and Method of charging the faid feveral Brewers in Payment of the faid Duty. VII. Provided always, and be it further enacted by the Authority aforefaid, That fuch of the faid Brew- ers only as fhall live and reftde within the faid City and Liberties thereof, fhall, by Virtue hereof, and on Account of the Premiffes, be fubject to the Jurisdiction of the faid City; and that fuch of the faid Brew- ers who fhall live without the faid City and Liberties thereof, fhall, after Commencement of the faid Duty, and during the Continuance thereof, be and continue to be fubject to all Suits and Proceffes, which may happen concerning the faid Duty and Impofition, to fuch Judge or Judges only, who, be- fore the making this Act, were competent and proper to determine in any Suits againft the faid Brewers ; and Duties how to be levied.
