C. 10. 13 tutions, as the faid Governors, or any feven or more of them, with fuch Quorum as is therein directed, approved under fhould in their Difcretfons judge moil 'convenient, to be obferved, for and towards the belter Rule ;.: Wan«- Go.vernment of the faid Corporation, and the Members thereof, and the receiving, accounting for, and -1 managing all and every the Revenues thereby granted, or mentioned to be granted, and all Arrears tbere- of, and alfo for and concerning the diftributing, paying, and difpofing of the fame, and all other Gifts and Benevolences that fhould or might be given or bequeathed to the faid Corporation for the charitable Ends in the faid Letters Patent mentioned, for the Augmentation of the Maintenance of the poor Cle gy aforefaid ; and fuch Rules, Methods, Orders, Directions and Conftitutions, as fhould be fo prop and mould be approved, altered or amended by her faid late Majefty, her Heirs or SuccefTors, and fuch as flvifcild be made by her faid Majefty, her Heirs and SuccefTors', and fo fignificd and de lared by her, her Heirs or Succefibrs, under her or their Great Seal, her faid late Majefty thereby willed fhould be the Rules, Methods, Directions, Orders and Conftitutions, by which the Governors of the Bounty or Queen Anne, for the Augmentation of the Maintenance of the poor Clergy and their Succ flbrs, fhould receive, manage, govern, apply and difpofe her faid late Majefty 's Royal Bounty, and other Gifts and Benevolences which fhould or might after that Time be given or bequeathed to the faid Corporation (where the Donors thereof fhould not particularly direct the Application thereof) to and for the fncreafe of the Maintenance of fuch Parfons, Vicars, Curates and Minifters officiating in any Chureh or Chapel- within the Kingdom of England, Dominion of Wales, or Town tit Berwick upon Tweed, where the Li- turgy and Rites of the Church of England, as then by Law eftablifhed were and mould be ufed and ob- ferved, for whom a Maintenance was not then fufficiently provided : And whereas purfuant to the (aid Letters Patent of Incorporation, the faid Governors did agree upon, prepare, and propofeto her faid Jate Majefty, certain Rules and Conftitutions for the better Rule and Government of the faid Corpora- tion, and her faid late Majefty, by .Letters Patent under her Great Seal, bearing Date the fifth Day of March in the twelfth Year of her Reign, did eilablifhthe faid Rules and Confti utions, referving to her- felf, her Heirs and Succefibrs, Power,' from Time to Time, under her or their Great Seal, to alter the fame, and to give and make in like manner fuch other Rules and Conftitutions, according to the true In- tention of the faid Letters Patent of Incorporation, as to her faid Majefty, her Heirs or Succefibrs fhould feem meet : And whereas a more expeditious and eafy Method of making and altering the P.ules and Conftitutions, for the better Rule and Government of the faid Corporation, .may tend to the Advance- t ment of the faid Charity ;' Be it enacted and declared by the Authority aforefaid, That all fuch Rules Methods, Orders, Directions and Conftitutions, as ihall, from Time to Time, be by the faid Governors agreed upon, prepared and propofed to his Majefty, his Heirs and Succefibrs, according to the true In- tention of the faid Letters Patent of Incorporation, and by his Majefty, his Heirs and SuccefTors, ap- proved under his or their Sign Manual, ihall be as good, valid and effectual Rules, Methods, Directions, Orders and Conftitutions, for the Purpofes aforefaid, as if the fame were made or eftablifhed under the Great Seal of his Majefty, his Heirs or Succefibrs.
- IV. And whereas her faid late Majefty's Royal Bounty to the poor Clergy was intended to extend,
not only to Parfons and Vicars who come in by Prefentation or Collation, Inftitution, and Induction, but likewife to fuch Minifters who come in by Donation, or are only Stipendiary Preacher.; or Curates, officiating in any Church or Chapel where the Liturgy and Rites of the Church of England, is now by Law eftablifhed, are and fhall be ufed and obferved, moft of which are not Corporations, nor have a le- gal'Succcffion, and therefore are incapable of taking a Grant or Conveyance of fuch perpetual Augmen- tation as is agreeable to her faid late Majefty's Gracious Intentions, and in many Places it would be in the Power of the impropriator, Donor, Parfon, or Vicar, -to withdraw the Allowance now or heretofore paid to the Curate or Minifter ferving the Cure, or in cafe of a Chapelry, the Incumbent of the Mother-Church might, refufe to employ a Curate, or permit a Minifter duly nominated or licenced to officiate in "fuch augmented Chapel, and might officiate there himfelf, and take the Benefit of the Augmentation, though his living 'he above the Value of thofe which are intended to be firft augmented ; and the Maintenance of the Curate or Minifter would thus be funk inftead of being augmented :' Be it therefore enacted by the All aiigrrieriteS Authority aforefaid, That all fuch Churches, Curacies, or Chapels, which fhall at any Time hereafter be chcrcht ' s ' i " c - augmented by the Governors of the Bounty of Queen Anne for the Augmentation of the Maintenance of * 1 >" perpem. the. poor Clergy, fhall be, and are hereby declared and eftablifhed to be, from the Time of fuch Augmen- tations, perpetual Cures and Benefices, and the Minifters duly nominated and licenfed thereunto, and their and the M Succefibrs refpectively, fhall.be, and be efteemed in Law, Bodies Politick and Corporate, and fhall have ft . ers ""•'.' teBo. perpetual Succeffion by fuch Name and Names as in the Grant of fuch Augmentation {hall be mentioned, dlcs Poli:!tk » and fhall have a legal Capacity, and are hereby enabled to take, in Perpetuity, to them and their Succef- and ft-iD be er- fors, all fuch Lands, Tenements, Tithes, and Hereditaments, as fhall be granted unto or purchafedfor p° lcd t0 . ta! ; c ;° them refpectively by the faid Governors of the Bounty of Queen Anne for the Augmentation of the Main- ^T*% ^ c ' a tenance of the poor Clergy, or other Perfons contributing with the faid Governors as 'Benefactors ; any ' Law or Statute to the contrary notwithftanding : And that the Impropriators or Patrons of any augmented Impropriator:, Churches or Donatives, for the Time being, and their Heirs, and the Rectors and Vicars of the Mother- &c ' of au Em;n- Churches whereto, any fuch augmented Curacy or Chapel doth appertain, and their SuccefTors, fhall be and 2~ Gh "" h . os » are hereby utterly excluded from having or receiving, directly or indirectly, any Profit or Benefit by fuch Keftors frc Augmentation, and fhall from Time to Time, and at all Times, from and after fuch Augmentation, pay of theMorh'er- and allow to the Minifters officiating in any fuch augmented Church and Chapel refpectively, fuch.annu- Srmrfches, are al and other Penfions, Salaries, and Allowances, which by ancient Caftom, or otherwife, of Right; and !^ !lld ' ;d f . orl c ■not of Bounty, ought to be by them refpectively paid and allowed., and which they mighty by due Courfe or e enetkof Lav/,
