Serfons during their Lives, or for fo long Time as his faid Exe- cutors and Truftees fhould think fit to continue them under their Care in the faid intended Hofpital ; and hath thereby further declared his Mind and Will to be, that fuch poor fick Perfons received into, and entertained in the faid intended Hofpital, fhould be fubjeft at all Times to his faid Executors and ' Truftees, and to fuch Rules and Orders as they fhould think fit to make for their Behaviour in the fard intended Hofpital, and liable to be expelled from thence and removed at the Pleafure of his faid Execu- tors and Truftees, and other like fick Perfons admitted and entertained in their Room ; and thereby further declares his Mind and Will to be, that if his faid Executors and Truftees fhould not find Caufe, or fhould on any Account whatfoever not think fit to keep all, or great Part of the Beds or Wards in the faid intended Holpital, filled and fupplied with fick Perfons deemed or called incurable, it fhould bo lawful for them to caufe any Number of the faid Beds or Wards to be filled and made ufe of in like Manner, and with like Patients, as the Beds in the Hofpital of St. Thomas are ordinarily ufed for; all which Patients fo to be received and taken in from time to time into the faid intended Hofpital as in- curable or otherwife, he hath declared his Mind to be, that his faid Executors and Truftees fhould provide in all Things, as near as might be, according to the Courfe, Cuftoms and Ufage of late Years' prevailing and praftifed in the faid prefent Hofpital of St. Thomas; and he hath thereby further declared his Mind and Will to be, and for the better and more regular Difpofition and Management of the Af- fairs and Bufinefs of the faid intended Hofpital, and for perpetuating the Charity thereby intended, and the ' Provifion for the fame, he hath thereby ordered and appointed, and earneftly defired and intreated his faid Executors and Truftees, forthwith after his Deceafe, by humble Application to his Majefty, or to the Legiflature, to endeavour to obtain Letters Patent under the Great Seal, or an Aft of Parliament, in- corporating his faid Executors and laft named Truftees, together with Mr. Benjamin Braine, Senior, Mr. Thomas Clarke, William Cole, Efquire, Doctor Thomas Crow, Doctor Francis Fauquier, Mr. Jofiua Gee, Mr. Matthew Howard, Dr. Edward Hulfe, Mr. Samuel LeJJingham, Mr. Henry Lovell, Mr. Samuel Monk, Mr. Jofeph Paice, Senior, Mr. Daniej. Powle, Mr Thomas Styles, Senior, and alfo Robert Atwood, Robert Briftow and Jonathan Blackwell, Efquires, Mr. James Brooks, Deputy Richard Chauncey, Richard Chi/well, Efquire, Deputy John Carbonnel, William Daw/on and Richard Ducane, Efquires, Sir Peter Eaton and Sir Nathaniel Gould, Knights, Thomas Gearing and Peter Godfrey, Efquires, Mr. Nathaniel Garland, Mr. John Gunfton, Edmond Halfey, Efquire, Mr. Henry Hankey, Mr. Thomas Hucks, Mr. Wil- liam King, M.r^James Lamb, Mr. James Leaver, Mr. Percival Lewis, Captain Daniel Locke, John Lon- don, Efquire, Thomas Malyn, Junior, and Nathaniel Micklethwaite, Efquires, Mr. Samuel Mayo, Mr. Thomas Martin, Mr. Francis Moult, Mr. Jo/iah Nicholfon, Mr. Nathaniel Newnham, Jeremia Sambrooke., Efquire, Mr. Samuel Sheafe, John Smith, Efquire, Sir John Tajh, Knight, Peter Theobalds, Efquire, and Mr. James Townjhend, of Cheapfide (the faid Gentlemen being then all Governors of the prefent Hofpi- tal of St. Thomas) or fo many of the faid Gentlemen, as fhould be living at the Time of procuring fuch intended Corporation, and willing to become Members thereof, and fo many other Gentlemen, Go- vernors, or reputed Governors of the prefent Hofpital of St. Thomas, or others, by his faid Executors, or the major Part of them to be appointed, as together with his faid Executors and other the Gentle- men above named, fhall make up the Number of fifty at the leaft, and not exceed fixty, and their Suc- ceffors, in Manner by fuch Letters Patent or Aft of Parliament directed and exprefied, to be from time to time elefted and admitted Members of fuch intended Corporation, into one diftinft and fepa- rate Body Politick or Corporate, with perpetual Succeffion, for the better managing and governing of the faid intended Hofpital, and for the better fettling and applying the faid Refidue of his Eftate for fuch Ufes as aforefaid, and for fuch other and further Uf;s as are therein after appointed, with a Pre- fident and Treafurer, and fuch other Officers of the faid intended Corporation, as by his faid Execu- tors fhould be thought neceffary or convenient in fuch Letters Patent or Aft of Parliament to be named and appointed, and in Manner therein directed, to be from time to time for ever thereafter fucceffively into fuch refpeftive Offices elefted and admitted, by fuch Name or Names, as to his Majefty or the Legiflature fhould feem proper, and by fuch Name or Names to have perpetual Succeffion, with Power to have and ufe a feparate and diftinft Common Seal for the neceffary Affairs of the laid intended Cor- poration, and with Power by fuch Name or Names as aforefaid, to have, hold, take, enjoy, alien, transfer, and difpofe of the faid thereby before devifed refiduary Part of his Eftate, and therewith or with any Part thereof, to purchafe, take and enjoy MefTuages, Lands, Tenements, Fee-Farm Rents, or other Eftates of Inheritance, for Perpetuity or otherwife, and to the Value of the faid refiduary Part of his Eftate, or to fuch further or other yearly Value, as to his faid Majefty or the Legiflature fhould feem convergent, and with Power and Capacity in Law to fue and be fued, to implead and be im- pleaded, anfwer and be anfwered unto by fuch Name or Na Ties as aforefaid, in any Court or Courts of Record, or elfewhere, and with fuch other Powers, Privileges and Capacities in Law, as to his Ma- , jefty or the Legiflature mould feem meet to be granted ; and declared his Mind and Will to be, and fur- ther defired his faid Executors and laft named Truftees, by fuch humble Application as aforefaid, to his Majefty or the Legiflature, to endeavour to obtain and procure that by fuch Letters Patent or Aft of Par- liament as aforefaid, a Committee be appointed of one and twenty of the Members of fuch intended Corporation, for the more conftant and ordinary Management and Application of the faid refiduary Part of his Eftate, and of the Charity thereby intended, to which Committee, or to fuch Number of them as fhould be thought convenient, when convened and affembled, by and with the Prefident and Treafurer
