Provided always, and be it further enacted by the Authority aforefaid, That if any Perfon or Ar- Perfons (hall find him, her or themfclves aggrieved by the Sentence or Determination ot Inch [uftice or Ju- <- itices of the Peace, Magiftrate or Magiftrates, it fliall and may be lawful to and for fuch Perfon and lVr- fons lb aggrieved, immediately after Sentence is pronounced againft him, her or them, to enter his, her or their Appeal in Prefence of the laid Jufiice or Justices of the Peace, Magiftrate or Magiftra laid Sentence, to the Determination of the Juftices of the Peace of the (aid County or Borough, at tl. next General Quarter- Seftions, that fliall be held for the fuid County or Borough, of which Appeal the fa J Juiiice or Juftices, Magiftrate or Magiftrates, are hereby appointed to make a Minute, and b W under his or their Hands to flop Execution of the Sentence (o appealed from, until the End of the n Quarter-Seflions as aforefaid ; and the faid Jufticcs of the Peace at their Quarter- Seflions are hereby' im- powered and required to proceed upon, and to hear and finally to determine in the faid Appeal, and if they give Judgment againft the Appellant, to Decree him to pay the full Cofts of the Appeal, and fui ther to pay a Fine not exceeding double the Penalty for which the original Sentence was given. XXXIII. And be it further enacted by the Authority aforefaid, That if any Juftice or Jufticcs of the Penalty 01 I Peace, or Magiftrate or Magiftrates within any Borough, (hall neglect or refufe to execute the Powers and giflratesne Authorities of this Act, or ihall not put the fame in Execution, according to the true Intent and Meaning « u,; thereof (to the Difcouragement of the Linen Manufacture), fuch Neglect or Refufal, or Malverfation fhall rsoft ' A ?- be, and be taken to be a Point of Dittay, and it fliall and may be lawful to and for the Perfon or Perfons 2 " '° I2 ™ n ,J aggrieved thereby, with the Approbation of the Truftees to be appointed by his M.ijefty as aforefaid, or St^t z. c. 20.' any five or more of them, to be fignificd in a Certificate under their Hands, to profecute the faid Juftice or 24 Ceo. a. c 31. Juftices of the Peace, Magiftrate or Magiftrates, before the Lords of the Judiciary at Edinburgh, or in their Circuits, for the Diftrict within which the Offence was committed ; and if the faid Juftice or Juftices of Peace, or Magiftrate or Magiftrates ihall be thereupon convicted of fuch Offence, it fliall and may be lawful for the faid Lords of Justiciary at Edinburgh, or in their Circuits-, to fet a Fine on fuch offending Juftice or Juftices of the Peace, or Magiftrate or Magiftrates, not exceeding one hundred Pounds Sterling. CAP. XXVII. An Act for continuing the Laws therein mentioned, relating to Copper Bars exported ; and for better preventing Frauds committed by Bankrupts ; and for fearching Drugs and Compofi- tions for Medicines.
