Year yearly, upon the firft Day of January in each Year, or within twenty Days next following at the fartheff, give and deliver to or into the OfHce of the Receiver or Receivers of the faid Duty in the Port of London, a true and exact. Lift or Account of the Number and Names of all and every the Ships or Veffels that in the Year preceding every fuch Account (hall have been hired or employed by the Commiffioners, or other Officers of every fuch Office refpectively, for or in the Service of his Majefty, his Heirs or Succeffors, and of all and every the Ships and Veffels which, at the Time of delivering in fuch Account, remain in the Service of every fuch Office refpectively, and of all fuch as between every fuch Account fhall be difcharged from fuch Service, and of the Names of the Mafters, Commanders and Owners of all and every fuch Ships and Veffels refpectively, and alfo of the Numbers of Seamen, or other Perfons that fhall from Time Treafurer of the t Time be employed in every fuch Ship or '/effel ; and that no Treafurer, Paymafter or other Officer of or faid Offices to belonging to any fuch publick Office or Offices, fhall make out or pay any Bill for the Freight of any Shin pay no W^ges to * r '^ .^J. , . 3 . ^ , 1 1 ■ 1 * r -in- r 1 • u rr • n 1 • tt • li r any Matter, till or Veiiel fo hired or employed, or to be hired or employed tor or in the Service of his Majesty, his Heirs or JieproHuce an Succeffors as aforefaid, or pay any Wages to any Mafter, Commander, Seaman or other Perfon employed Acquittance or that fhall be employed in any fuch Ship or Veffel, until every fuch Mafter, Commander or Owner re- fpectively fhall and do produce and fhew unto fuch Treafurer, Paymafter or other Officer refpectively, an Acquittance or Certificate figned by the faid Receiver or Receivers, or his or their Deputy or Deputies for the Time being, whereby it fhall appear that fuch Mafter, Commander or Owner hath duly and fully paid and difcharged the faid Duty of fix Pence per Menfem, and that he is not more than thirty Days in Arrear to the faid Hofpital ; and in cafe any Default, Neglect or Omiffion fhall be made by any fuch Secretary, Chief Clerk, Treafurer, Paymafter or other Officer of or belonging to any of the faid publick Offices re- fpectively, in any of the Acts, Matters or Things hereby directed to be by them refpectively done and per- formed as aforefaid, or fhall in any wife act. contrary to the before mentioned Directions ; then and in every of the faid Cafes every fuch Secretary, Chief Clerk, Treafurer, Paymafter and other Officer, fo making Default, Neglect or Omiffion, or acting contrary to fuch Directions as aforefaid, {hail for every fuch Act, Default, Neglect or Omiffion, forfeit the Sum of fifty Pounds of lawful Money of Great Britain, to bs recovered and applied in fuch Manner and for fuch Ufes as in that Behalf is herein after mentioned and directed. ' VII. And whereas by the faid Act of the tenth of Queen Anne, the faid Duty of fix Pence per Men/em ' is directed to be paid by the Mafters, Commanders or Owners of Ships or Veffels thereby made liable to ' pay the fame, within fourteen Days after they fhould be cleared inward by the Officers of the Cuftoms, c which hath been found ineffectual, in as much as many Mafters and Commanders of Ships and Veffels, after ' they have been cleared at the Cuftom-Houfe, have wholly neglected to pay the faid Duty, whereby great ' Detriment and Lofs hath happened to the faid Hofpital :' For Remedy whereof be it further enacted by the Authority aforefaid, That from henceforth all and -every the Mafters, Commanders and Owners of all Merchant Ships and other private Ships and Veffels whatfocver, by this Actor any of the faid former Act9 made liable to the Payment of the (aid Duty of fix Pence per Men/em, fhall pay all fuch Monies as fhall from Time to Time be due from them and every of them refpecfively unto the faid Hofpital, for or on Ac- count of the faid Duty, before any fuch Ships or Veffels fhall be cleared inwards by the Officers of the Cuftoms of his Majefty, his Heirs or Succeffors, in any of the Ports of this Kingdom of Great Britain, or of the faid Kingdom of Ireland, or of the faid Iflands of Gucrnfey, Jerfey, Aldemey, Sark and Man^ or of any of them, or of any of his Majefty's Colonics, Iflands or Dominions in America; and that noCuftomer, Collector, Comptroller, Receiver, Surveyor, Searcher, Waiter or other Officer whatfoever, of or belong- ing to the Cuftoms of his Majefty, his FJeirs or Succeffors, fhall, at any Time hereafter, clear inwards any Merchant Ship or private Veffel whatfoever, by this or any of the faid former Acts made or declared liable to the Payment of the faid Duly of fix Pence per Men/em, or grant any Warrant, or give or make out any Cocquet, Tranfires, Returns or Discharges unto or for any iuch Ship or Veffel whatfoever, or final! permit or fuffer any fuch Ship or Veffel to go out of any the Ports before mentioned, until the faid Mafter, Commander or Owner or Owners of every fuch Ship or Veffel refpecfively fhall and do produce and fhew forth unto fuch Officer or Officers, an Acquittance or Certificate, figned by the faid Receiver or Receivers, or his or their Deputy or Deputies for the Time being, whereby it fhall appear, that fuch Mafter, Com- mander or Owner or Owners have duly and fully paid and difcharged the faid Duty, and that he or they is not or are more than thirty Days in Arrear to the faid Hofpital. or that they are exempted from the Payment Cu- of the faid Duties by Virtue of the Exceptions herein, and in the faid Act of the tenth of Queen Anne ^ c .- contained ; and every Mafter, Commander and Owner of any fuch Ship or Veffel who fhall refuk or ne- pe ault, gi e< q. f0 p a y t h e f a |^ Q u ty of fix Pence per Men/em, in the Manner and within the Time herein before men- tioned, limited and appointfd for Payment thereof, and alfo every Cuftomer, Coll ctor, Comptroller, Re- ceiver, Surveyor, Searcher, Waiter and other Officer of the Cuftoms, who fhall make Default in any of the Premiffes injoined them reflectively by this Act, or fhall in any wife act contrary to the Directions herein before mentioned, fhall for every fuch Refufal, Neglect, Default or Act, forfeit the Sum of twenty Pounds of lawful Money of this Kingdom, if fuch Forfeitures fhall be incurred within Great Britain or Ireland, or to the Amount thereof in the Money of fuch Iflands, Colonies or Dominions where the fame fhall be incurred, to be recovered and applied in fuch Manner as in that Behalf is herein after mentioned ant} directed. VII . Provided, and be it further enacted by the Authority aforefaid, That in all Cafes, wherein by this Act an Oath is required or appointed to be taken, the folemn Affirmation and Declaration of the People cal- led £hial-ers iha be accepted inftead of fuch Oath, in fuch Manner and Form as by the Laws and Statutes of this Kingdom is directed and appointed ; and if any fuch Quaker fhall refufe to make fuch folemn Af- firmation and Declaration in any Cafe, wherein any other Perfon is hereby required to take an Oath, every barters ^omeis. making .forfeit 2 Oualcers fclemn Declaration to "be accepted in- ftead of an iOath. fuch Quaker fo refufing fhall, for every fuch Offence, be fubject to the like Forfeitures and Penalties as any other Perfon refufing to take an Oath is made liable to by this Act ; and in cafe any fuch Quaker {hall, upon his,
