XXXIX. Provided alfo, and it is hereby enacted by the Authority aforefaid, That at any Time upon one Year's Notice to be printed in the London Gazette, and affixed upon the Royal Exchange in Lon- don, by the Authority of Parliament, at any of the half yearly Feaft-Days for Payment of the faid re- fpective Annuities, or either of them, and upon Repayment by Parliament of the refpective principal bums, for which the faid refpeiiive Annuities, or either of them, (hall be payable to fuch refpedtive Perfons or Corporations as (hall be intitled to the fame Annuities, and alfo upon full Payment of all Arrearages of the fame Annuities ; then, and not till then, the faid refpective Annuities (hall ceafe and determine, and be underftood to be redeemed, and from and after fuch Redemption the Mo- nies arifing from the faid additional Duties on (lamped Vellum, Parchment and Paper (hall not be iffued or applied to any Ufe or Purpofe, but as (hall be directed by future Act or Acts of Parliament ; any Thing in this or any former Act or Acts of Parliament to the contrary notwith- ftanding ; and that any Vote or Refolution of the Houfe of Commons, fignified by the Speaker in Writing to be inferted in the faid London Gazette, and affixed on the Royal Exchange in London as afordaid, (hall be deemed and adjudged to be fufficient Notice, within the Words and Meaning of this Act. XL. And it is enatted by the Authority aforefaid, That if any Perfon or Perfons (hall at any Time or Times be fued or profecuted for any Thing by him or them done or executed in Purfuance of this Act, or of any Matter or Thing in this Act contained, fuch Perfon or Perfons (hall and may plead the General Ifiiie, and give the fpecial Matter in Evidence for his or their Defence ; and if upon the Trial a Verdict (hall pafs for the Defendant or Defendants, or the Plaintiff or Plaintiffs lhall become nonfuited, then fuch Defendant or Defendants (hall have treble Cofts to him or them awarded againft fuch Plaintiff or Plaintiffs. XLI. And be it further enacted by the Authority aforefaid, That the Sum of thirty-two thoufand fivj merLandTaxes. hundred and fixteen Pounds twelve Shillings and eleven Pence three Farthings, remaining in the Receipt and compound °^ ^' s Majefty's Exchequer for Arrears on former Land Taxes, payable in the Year one thoufand feven hundred and twenty eight or before, and alfo the Sum of fix hundred and fixty-nine Pounds nine Shil- lings and ten Pence Half-penny, remaining in the faid Receipt of Exchequer, on Arrears of former Du- ties on Malt, and likewife the Sum of nine thoufand five hundred and twenty-eight Pounds three Shil- lings and one Penny, remaining in the faid Receipt of Exchequer, for the Duty on Compound Liquors, and for Licence Money for retailing the faid Liquors, and for Forfeitures on the faid Retailers, (hall and may be iffued and applied as Part of his Majefty's Supply granted for the Service of the Year one thoufand feven hundred and thirty-one ; any Law, Statute or Provifion to the contrary in any wife notwithftanding. XLII. Provided always, and be it enacted by the Authority aforefaid, That all the Monies coming into the Exchequer, either by Loans or Exchequer Bills, upon one Act of this Seffion of Parliament, intituled, An Jet for continuing the Duties upon Malt, Mum, Cyder and Perry, in that Part of Great Bri- tain called England, and for granting to his Majejly certain Duties upon Malt, Mum, Cvder and Perry, in that Part of Great Britain called Scotland, for the Service of the Tear one thoufand feven hundred and thirty- one, and fo much Money, if any fuch be, of the Duties thereby granted and continued, as lhall arife or remain after all the Loans or Exchequer Bills made or to be made on the fame Act, and all the In- tereft, Premium, Rate or Charges thereon, and the Charges thereby allowable for railing the faid Du- ties (hall be fatisfied, or Money fufficient (hall be referved in the Exchequer to difcharge the fame; and all the Monies coming into the Exchequer, either by Loans or Exchequer Bills, upon one other Act of this Seffion of Parliament, intituled, An Acl for granting an Aid to his Alajejly by a Land Tax to he raifed in Great Britain for the Service of the Tear one thoufand feven hundred and thirty-one, and fo much Mo- ney, if any fuch be, of the Tax thereby granted, as lhall arife and remain after all the Loans or Exche- quer Bills made or to be made on the lame Act, and all the Intereft, Premium or Rate and Charges thereon, and the Charges thereby allowable for raifing the faid Land Tax, (ha'l be fatisfied, or :Vioney fufficient lhall be referved to difcharge the fame ; and alfo all the Monies coming into the Exchequer, by granting Annuities after the Rate of three Pounds ten Shillings per Centum per Annum, and by Con- tributions by way of a Lottery, on this Act ; and the Sum of thirty-two thoufand five hundred and fix- teen Pounds twelve Shillings and eleven Pence three Farthings, remaining in the Receipt of his Majefty's Exchequer on Arrears of former Land Taxes ; and the Sum of fix hundred and iixty-nine Pounds nine Shillings and ten Pence Half-penny, remaining in the Receipt of his Majefty's Exchequer, on Arrears of former Duties on Malt; and alfo the Sum of nine thoufand five hundred twenty-eight Pounds three Shillings and one Penny, remaining in the Receipt of his Majefty's Exchequer, for the Duty on Com- pound Liquors, and jfor Licence Money fur retailing the faid Liquors, and for Forfeitures on the faid Retailers, fhall be appropriated and applied, and are hereby appropriated for and towards the feveral Ufer, Ceneral Iflfue.
