And be it further enacted by the Authority aforefaid, That all and every the Offender and Of- fenders, Offence and Offences againft this Act, lhall be fubject and liable to the Penalties and Forfei- H.ts or Fdts Co tares herein after mentioned, that is to fay, The faid Hats or Felts dyed or undyed, finifhed or un- tranfported, for- finifhed, fo exported, tranfported, (hipped off, carried, conveyed or loaden contrary to the true Intent and Meaning of this Act, lhall be forfeited, and that every of the Offender and Offenders therein lhall likewife forfeit and pay the Sum of five hundred Pounds for every fuch Offence committed ; and every Mafter, Mariner, Porter, Carter, Waggoner, Boatman, or other Perfon whatfoever knowing, fuch Of- fence, and wittingly aiding and alMing therein, fhajl forfeit and pay the Sum of forty Pounds ; which faid feveral Penalties and Forfeitures lhall and may be recovered by Action of Debt, Bill, Plaint or In- formation in any of his Majefty's Courts of Record in Great Britain^ or in fuch of the faid Plantations ■ wherein fuch Offence lhall be committed (in which Suit no Effoin, Protection or Wager of Law, or more than one Imparlance fhall be allowed) and lhall go and be applied, one- Moiety to the Ufe of his Majefty, his Heirs and. Succeffors, and the other Moiety to him, her or them, that fhall fue for the fame. III. And be it further enacted by the Authority aforefaid, That it fhall and may be lawful to and for and Feits robe" any Perfon or Perfons to feize, take, fecure and convey to his Majefty's next Warehoufe all fuch Hats • isized and car- an d Felts dyed or undyed, finifhed or unfinifhed, as he or they fhall happen to fee, find, . know or u.ir>R ° Ware- difcover to be laid on Board in any Ship, Veflel or Boat, or to be brought, carried or laid on Shore, at or near the Sea, or in any navigable River or Water, to the Intent or Purpofe to be exported or conveyed out of the faid Plantations, contrary to the true Intent and Meaning of this Act, or to be : laden upon any Horfe, Cart or other Carriage to the Intent or Purpofe to b& exported, conveyed or carried into any other of the faid Plantations, or into any other Part or Place whatfoever, , contrary to? the true Intent and Meaning hereof; and that fuch Perfon or Perfons, that (hall happen fo to feize, . take or fecure any of the Commodities aforefaid, fhall be indemnified for fo doing to all -Intents and-. Purpofes. ' IV. And to the Intent and Purpofe that this Act may more effectually be put' in Execution, - for

1 be fuffered to be font from thence to fupply other Plantations and Foreign Markets, that are or have ' been fupplyed from Great Britain :' Be it further enacted by the Authority aforefaid,. That if any Commiffioner or Commiffioners, or other Officer or Officers of the Cuftoms of any Port or Place within the Britijh Plantations, or any Farmer or Farmers of the Revenue of the Cuftoms arifing;. in the Plan- tations, or any Officer or Officers imployed in the Management of the faid Revenue, fhall, from and after the faid twenty-ninth Day of September one thouland feven hundred and- thirty-two,-, take or fuffer to be taken, any Entry outward, or fign any Cocket, Warrant or Sufferance- for the Shipping, or Exporting any Hats or Felts dyed or undyed, finifhed or unfinifhed, or* fhall wittingly and willingly permit, contrive or fuffer the fame to be done, directly or indirectly, contrary to the. true Intent and Meaning of this Act ; that then and in every fuch cafe, fuch Commiffioner or Commiffioners, . Farmer or Farmers, Officer or Officers fo figning fuch Cocket, Warrant or Sufferance,- or paffing, fuch Entry for the fame, or any wife conniving thereat, contrary to the true. Intent and- Meaning, hereof, fhall for every fuch Offence or Neglect, forfeit his Office, and fhall moreover for- every fuch. Offence forfeit the Sum of five hundred Pounds, to be recovered and applied in Manner and Form as aforefaid. V. And be it further enacted by the Authority aforefaid, That every Offence committed againft this- Act fhall and may be inquired of, tried, heard and determined, in the County where any fuch Goods - fhall be fo laden or put on Board as aforefaid, or elfe in the County or Place either in Great Britain or the Plantations where fuch Offender fhall happen to be apprehended or arretted for fuch Offence, or where any of the Goods aforefaid fhall happen to be feized, taken or brought in ; and that the faid Trial fhall be in fuch Manner and Form, and in fuch Effect to all Intents and Purpofes as if the fame Of- fence had been wholly done and committed in the fame County or Place where the fame fhall be tried by virtue and in purfuance of this Act. VI. And be it further enacted by the Authority aforefaid, That if any Action, Bill, Plaint, or In- formation, fhail be commenced or profecuted againft any Perfon for what he fhall do in purfuance of this Act, fuch Perfon fo fued fhall and may file common Bail or enter into a common Appearance, and- plead the General Iffue, Not guilty, and, upon Iffue joined, may give this Act and the fpecial Matter in Evidence ; and if the Plaintiff or Profecutor fhall become nonfuit, or fuffer Difeontinuance, or if a Verdict pafs againft him, or if upon Demurrer Judgment pafs againlt him, the Defendant fhall recover treble Cofts and Damages. VII.
