D. 1733. en Penalty of pay the Sum of fifty Pounds to be recovered againft the faid Corporation by Bill, Plaint or Information $ oi ' in any of his Majefty's Courts at IVefiminfter, wherein no EfToign, Protection or Wager of Law, and no more than one Imparlance (hall be allowed ; one Moiety of which Penalty fhall be applied to the Ufe of the Poor of the Parifh where fuch Offence (hall be committed, the other Moiety to the Perfon who (hall fue for the fame, which Recompenfe, Payment and Satisfaction the faid Corporation are hereby impowered and authorized to ftop and retain out of the Wages due to fuch Ballaft Men as (hall offend in delivering (hort Tunnage of Ballaft as aforefaid, over and above the Penalties inflicted hereby for every fuch Offence. Owners of V. And it is hereby further enacted by the Authority aforefaid, That after the faid firft Day of June Ships, be. not one thoufand leven hundred and thirty-three, no Mafter, Owner or Officer of any Ship or Veffel, or MMen^to de- an Y other Perfon whatfoever, (hall oblige or compel any Ballaft Man to carry and deliver to any Ship or liver Ballaft Veffel any Quantity of Ballad which ihall be ordered and directed by the Rulers of the Ballaft Office of contrary to Or- t h e f a j c i Corporation to be carried to any other Ship or Veffel : And if any Mafter, Mate or other Officer Penalty on col- ot an y Ship or Veffel, or any other Perfon (hall, after the laid firft Day of June one thoufand (even hun- lufively receiv- dred and thirty-three, fraudulently, or by Collufion with any of the Ballaft A'] en, take or receive on ing more Ballaft board any fuch Ship or Veffel, any greater or other Quantity of Ballaft than they refpectively (hall enter the Office? M an< l P a Y * or at ^ Q la *d Ballaft Office, every Perfon fo offending, and being thereof lawfully convicted up- on the Oath of one or more credible Witnefs or Witneffes, before one or more Juftice or Juftices of the Peace for the City of Lc udou, or the Counties of Middlefex, EJJex, Kent or Surrey, or any of them, with- in their refpective Jurifdictions, in Manner herein after mentioned, (hall, for every Tun of Ballaft fo fraudu'ently taken and received above the Quantity fo entred and paid for, forfeit and pay the Sum of two (hillings and fix Pence. Penalty on Bal- VI. And it is hereby further enacted by the Authority aforefaid, That if any Ballaft Man (hall, from laft Men re- an d a f ter the faid firft Day of June one thoufand feven hundred and thirty-three, refufe to work at and If thl Wages* f° r tae Hire and Wages herein before mentioned, or, having contracted to ferve the faid Corporation for appointed, &c. any Term or Time, (hall quit or depart- from fuch Service, in breach of and contrary to fuch Con- tract, or (hall otherwife, at any Time, quit or depart from the Service of the faid Corporation without giving three Months Notice in Writing to the Supervifors of the Ballaft Office, or one of them, or fhall refufe to work, or (hall not work in fuch Places or Stations in the River of Thames as the faid Corporation fhall in that Behalf affign and appoint, or fhall work in any Place or Station contrary to the Orders or Direction of the Rulers of the Ballaft Office, or any one of them, given in Writing for that Purpofe, or (hall begin, promote, caufe or join in any Combina- tion, in order to raife the Wages of the Ballaft Men, or otherwife to obftruct the Service of the faid Corporation, or the Navigation of the River Thames ; every Perfon fo offending, and being thereof lawfully convicted as aforeffaid, fhall for every fuch Offence forfeit and pay the Sum of five Pounds. ' VII. And whereas the Ballaft Lighters belonging to and employed by the faid Corporation are
- marked at the Stem and Stern with Numbers denoting every five Tuns of their Tunnage and Burthen
' refpectively : And whereas it would tend more to the Satisfaction of the Mafters and Owners of Ships
- and Veffels having Occafion for Ballaft, and would prevent Frauds in delivering the fame, that the
' Weight and Tunnage of every fuch Lighter fhould be diftinguifhed by Marks denoting and expreffinz The Burthen of ' every two Tuns and a Half of the Tunnage or Burthen thereof refpectively :' It is therefore enacted Ballaft Lighters by the Authority aforefaid, That the faid Corporation of Trinity Houfe (hall, before the tenth Day of marked^ the 7"'y one thoufand feven hundred and thirty-three, caufe viable Marks to be made and fet on the Stem stern by 10 July and Stern of every fuch Lighter between every two Gauge Marks now placed on the Stem and Stern 1733- of every fuch Lighter refpectively, in order that the Tunnage and Burthen of every fuch Lighter may be computed and diftinguifhed by a gradual Progreffion of two Tuns and an Half. Mafters of Ships VIII. And it is hereby further enacted by the Authority aforefaid, That it fhall and may be lawful taking Ballaft, to and for the Mafters of all Ships and Veffels taking Ballaft of the faid Corporation^ and they are hereby may appoint authorized and impowered to meet in the Square at Billing/gate on the twentieth Day of June one thou- fp^aThVftiarks f an d feven hundred and thirty-three, and on the third Monday in June in every fucceeding Year, and ct Eaiiaft to adjourn to fuch Place as the Majority of them (hall think fit, and then and there, by Writing under Lighters. t ^ eir Hands and Seals, or under the Hands and Seals of the major Part of them, to appoint one or more Perfon or Perfons, being or having been Mafters or Mates of Ships or Veffels, to infpect and furvey all the Ballaft Lighters belonging to the faid Corporation, and which faid Perfon or Perfons, fo to be ap- pointed, fhall be, and is and are hereby authorized and impowered, from Time to Time, to view and examine the Marks of every fuch Lighter refpectively ; and in cafe fuch Perfon or Perfons (hall fufpeft that any of the Marks denoting the Tunnage of any fuch Lighter have been altered or difplaced, and Lighters,on Suf- fhall, at the Ballaft Office of the faid Corporation, require the fame Lighter to be re-weighed, then and pi "°f >j° be re " in every fuch Cafe the faid Corporation fhall, within ten working Days after fuch Requeft made (Wea- we '<; >e . ther permitting) caufe fuch Lighter to be re- weighed by Weights provided by the (aid Corporation ; and in cafe, upon fuch re-weighing of any fuch Lighter, the fame fhall be found to be of as great Tunnage as by the Marks thereof (hall be fignified and denoted, then and in fuch Cafe the Charge of fuch re-weighing fhall be paid by the Perfon or Perfons requiring the fame ; and in cafe fuch Perfon or Perfons fhall not pay the Charge of re-weighing of fuch Lighter, within ten Days after fuch re-weigh- ing, then and in every fuch Cafe the Perfon or Perfons fo offending fhall forfeit and pay the Sum of five Pounds ; but if fuch Lighter fhall, upon re-weighing thereof, be found to be of lefs Tunnage than the Marks thereof denote or import, then the Charge of fuch re-weighing (hall be born and paid by the faid Corporation, who fhall immediately, upon fuch re-weighing, caufe the Marks on the Stem and Stern
