After 24 June 1734, SuiTeyors may make a Prefentment of Hedges annoy- ing the Roads, fue for the fame ; and all and every Broker or Brokers, Agent or Agents, who fliall negotiate, tranf- act, or intermeddle in the making or procuring to be made any fuch Contract or Agreement, as aforefaid, and fhall know that the Perfon or Perfons, by whom or on whofe Behalf fuch Contract or Agreement fhall be made, is or are not poffeffed of, or intitled unto, the Stock or Security, con- cerning which fuch Contract or Agreement ihall be made, in his, her, or their own Name or Names, or in the Name or Names of a Truftee or Truftees for their Ufe or Right, (hall, for every fuch Offence, forfeit and pay the Sum of one hundred Pounds, to be recovered by Action of Debt, Bill, Plaint, or Information, in any of his Majefty's Courts of Record at JVeJhninJler, in which no Eflbin, Privilege, Protection, or Wager of Law, or more than one Imparlance, lhall be allowed ; one Moiety thereof to the Ufe of his Majefty, his Heirs, and Succeffors, and the other Moiety thereof to the Ufe of him her, or them, who fhall fue for the fame. IX. And be it further enacted by the Authority aforefaid, That from and after the faid firft Day of June one thoufand (even hundred and thirty-four, all and every Broker or Brokers, or other Per- fon or Perfons, who fliall negotiate or act as a Broker receiving Brokerage, in the buying, felling or otherwife difpofing of any of the faid Publick or Joint Stocks, or other Publick Securities, fhall re- fpectively keep a Book or Regifter, which fhall be called The Broker; Book ; in which faid Book he and they fliall fairly, juftly, and truly enter all Contrails, Agreements and Bargains, that he or they fhall from time to time make between any Perfon or Perfons whatfoever, on the Day of the making fuch Contract or Agreement, together with the Names of the principal Parties, as well Buyers as Sellers, and alfo the Day of making fuch Contract: or Agreement, to the Intent and Purpofe that fuch Broker or Brokers, and other Perfon or Perfons, acting or negotiating as fuch, as aforefaid, fhall from time to time produce fuch Book or Regifter, when thereunto lawfully required : And in cafe fuch Broker or Brokers, or any other, who fliall negotiate or act as a Broker, as aforefaid, in relation to any the faid Matters, fhall not keep fuch Book or Regifter, or fliall wilfully omit to enter therein, fairly, juftly, and truly, any fuch Contract, Bargain or Agreement, as aforefaid, he or they fhall, for every fuch Offence or Omiffion, forfeit and pay the Sum of fifty Pounds, to be recovered by Action of Debt, Bill, Plaint, or Information, in any of his Majefty's Courts of Record at Weftminjler, in which no Effoin, Privilege, Protection, or Wager of Law, or more than one Imparlance, fhall be allowed ; one Moiety thereof to the Ufe of his Majefty, his Heirs and Succeffors, and the other Moiety thereof to the Ufe of him, her, or them, who ihall fue for the fame. X. Provided always, That nothing in this Act contained fliall extend, or be conftrued to extend, to any Contrails or Agreements for the Purchafe or Sale of any Stock, Annuities, or other Publick Securities, to be made with the Privity of the Accountant General of the Court of Chancery, in purfuance of any Decree or Order of the faid Court ; but that all fuch Contracts and Agreements may be made and performed in the fame Manner as they might have been, if this Act had never been made. XI. Provided alfo, and be it further enacted by the Authority aforefaid, That nothing in this Act con- tained fhall extend, or be conftrued to extend, to hinder or prevent any Perfon or Perfons from lending any Sum or Sums of Money on any Publick or Joint Stock or other Publick Securities whatfoever, or any Part, Share, or Intereft therein, or to prevent or hinder any Defeazance, Contract, or Agreement, being made and entered into for the re-delivering, affigning, or transferring fuch Publick or Joint Stock, or other Publick Securities, or any Part, Share, or Intereft therein, upon the Repayment of the Sum or Sums of Money, which fhall have been lent and borrowed thereupon, with Intereft for the fame, fo as no Premium or other Confederation whatfoever be paid to, or received by the Perfon or Perfons lending fuch Money, for or in Confideration of fuch Loan, more than legal In- tereft. XII. Provided alfo, and be it further enacted by the Authority aforefaid, That this present Act fliall continue and be in Force from the faid firft Day of June one thoufand feven hundred and thirty- four, for the Term of Three Years, and from thence to the End of the then next Seflion of Parliament, and no longer. CAP. IX. An Aft to explain and make more effectual the Laws in being, to oblige the Poflefibrs of Lands adjacent to common Highways, to cut and keep low fuch Hedges as are adjoining to the faid Highways. HE RE AS the making the common Highways as commodious as may be, tends greatly to the Eafe and Safety of His Majefty's Subjects, and to the Advantage of Trade and Commerce: And whereas in many Places the common Highways are greatly damaged by the Hedges adjoining thereto, being of fuch Height as to hinder thereby the Advantages which would otherwife accrue to the faid Highways by the Sun and Winds : And whereas fome Doubts have arifen, whether in fuch Cafes the Laws in being have provided a fufficient Remedy ;' Be it therefore enacted by the King's moft Ex- cellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Com- mons, in this prefent Parliament affembled, and by the Authority of the fame, That if the Surveyor or Surveyors of the Highways, on any View or Views which they are required by Law to make of the Highways within their refpective Parifhes, Places, Limits, and Jurifdictions, fhall, after the twenty-fourth Day of June y which fhall be in the Year of our Lord one thoufand feven hundred and thirty-four, find anv
