IT7HEREAS divers of«his Majefty's Subjects have been of late feduced to enlift themfclves to
' VV ferve as Soldiers vtnder foreign Princes, States or Potentates, which Practice is highly preju- ' dicial to the Safety and Welfare of this Kingdom ;' For Remedy thereof, be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That if any Subject of the Crown of Great Britain, from and after the twenty-fourth Day of June next, fhall within the Kingdom of Great Britain or Ireland, or from and after the twenty-ninth Day of September next with- out the fame, enlift or enter himfelf, or if any Perfon fhall procure any Subject: of his Majefty, his Heirs or SuccefTors, to enlift or enter himfelf, or hire or retain any Perfon being a Subject of his Ma- jefty, his Heirs or SuccefTors, with an Intent to caufe fuch Perfon to enlift or enter himfelf, or procure any Perfon being a Subject of his Majefty, his Heirs or SuccefTors, to go beyond the Seas, or embark, with an Intent and in order to be enlifted to ferve any foreign Prince, State or Potentate as a Soldier, without Leave or Licence of his Majefty, his Heirs or SuccefTors, firft had and obtained for enlifting any of the Subjects of his Majefty, his Heirs or Succeffbrs, to ferve any fuch foreign Prince, State or Potentate as Soldiers, under the Sign Manual of his Majefty, his Heirs or SuccefTors, every fuch Perfon fo offending, being thereof lawfully convicted, fhall be taken, deemed and adjudged to be guilty of Felony, and fhall fuffer Death as in Cafes of Felony without Benefit of Clergy. II. And be it further enacted by the Authority aforefaid, That where any Offence againft this Act fhail be committed out of this Realm, the fame may be alledged to be committed, and may be laid, en- quired of and tried in any County in England. III. Provided always, and be it further enacted by the Authority aforefaid, That in cafe any Perfon fo enlifted or inveigled, or enticed to go beyond the Seas in order fo be enlifted, as a Non-com- miffioned Officer or private Soldier in any foreign Service, without his Majefty's Licence firft had and obtained as aforefaid, fhall, within fourteen Days after fuch Enlifting or Agreement to go beyond the Seas, voluntarily difcover upon Oath before any of his Majifty's Juftices of the Peace, or other civit Magiftrate, the Perfon or Perfons by whom he was fo enlifted, inveigled or enticed as aforefaid, fo a3 he or they may be apprehended and convicted of the faid Offence, fuch Ptrfon or Perfons fo difcover- ing as aforefaid fhall be indemnified from the Penalty inflicted by this Act, and all other Penalties, whatfoever on account of the faid Offence.
