' Factors : And whereas notwithftanding the Benefit and Ufefulnefs of this Defign had been expe-

  • rienced, yet the Payment of the faid cuftomary Sums hath of late Years not been complied with,

' there being no Authority to inforce fuch Compliance; by reafon whereof feveral of his Majefty's Sub- ' jects in Diftrefs have been reduced to great Extremities for want of the Affiftance which they other-- ' wife would have received, had fuch Contribution been continued :' Therefore to promote fuch good Intentions, and to continue the faid Contributions for the fame; may it pleafe your moft Excellent Ma- jefty, that it may be enacted; and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Par- liament affembled, and by the Authority of the fame, That from and after the twenty-ninth Day of fhipftradingto September, which fhall be in the Year of our Lord one thoufand feven hundred and thirty-feven, it lhall Leghorn, to be lawful to and for fuch Perfon or Perfons as fhall be appointed by the Conful named for his Majefty's pay for Goods Subjects trading to the faid Port of Leghorn, for the time being, together with the Majority of the Bri- ™e third of^aT tijh Merchants and Factors there, to receive and recover from all Mafters or other Chief Officers and Livre per Ton- Commanders of all Britifl) or Irijh Ships or Veffels trading from Great Britain or Ireland, or any other <? r Bale; _ to be Part of his Majefty's Dominions, to the faid Port, any Sum or Sums of Money, not exceeding one oiTadlng'and' Livre per Ton on all Tonnage Goods imported into the faid Port in fuch Ships and Veffels; and on all allowed by Bale Goods any Sum or Sums of Money, not exceeding one Third of a Livre per Bale or Parcel; and Freighters or all Bills of Lading of fuch Ships and Veffels, fhall fpecify to pay the faid Monies accordingly, under the {^Goods, Denomination of Contribution, as by Aft of Parliament, or to that Effect; and the Perfons paying the fame fhall be reimburfed by their refperftive Freighters, or by the Perfons to whom the faid Goods and Merchandizes fhall be configned, or who fhall receive the fame; and in cafe the Matter or Commander of fuch Ship or Veffel fhall neglect to fpecify the Payment of the faid Monies in the Bill or Bills of Lading as aforefaid, he fhall be anfwerable for the fame; and in cafe no Bill of Lading fhall appear, or Goods t0 be no Tonnage be fettled between the Owner or Owners of the Goods and the Matter or Commander of valued, where any Britijh or Irijh Ship or Veffel trading as aforefaid, then the Tonnage of fuch Goods or Merchan- there "« no Bill dize fhall be valued by Two indifferent Britijh Merchants on the Place; one to be appointed by the ins '" Conful, and the other by the Matter or Commander of fuch Ships or Veffels, within ten Days next after the unlading of the faid Goods; and in cafe the two Perfons fo chofen fhall not agree and award the fame in three Days next after fuch Appointment, fuch two Perfons fhall then choofe a third Perfon, being a Britijh Merchant on the Place, as an Umpire, who fhall decide and determine the faid Valua- tion of Tonnage in three Days; and fuch Sums fhall be paid in fuch Cafe for the Purpofes aforefaid, as fhall be agreeable to this Act. ft „ II. And be it enacted by the Authority aforefaid, That all Mafters, Commanders, or other Chief every Veffels" Officers of all Britijh or Irijh Ships or Veffels trading from Great Britain or Ireland, or any other Cargo to be Part of his Majefty's Dominions, to the Port of Leghorn, and unloading and delivering the Ship or s? ve " u P ont Veffel, or any Part of the Cargoe there, fhall, within ten Days after the Arrival of fuch Ship or Vef- fel deliver to the Conful refiding there, or to fuch other Perfon or Perfons as fhall be appointed for that Purpofe by him, a true Manifeft in Writing upon Oath, fpecifying the Particulars of the whole Cargoe of fuch Ships or Veffels fo unloaded or delivered, or fuch Part thereof- as fhall be unloaded or delivered there, and to whom configned; which Oath fuch Conful, or other Perfon. or Perfons to be appointed by him, is and are hereby reflectively impowered and required to ad— •minifter gratis.
