D. 1737. collected ; and the refpecYive Deputies for the time being (hall be obliged, and he and they is and are here- by required, to give fuch Receipt without Fee or Reward ; and fuch Receipts thall by the Collector or Collectors be produced to the Alderman of the Ward, at the Time he and they (hall fettle and adjuft his and their yearly Account and Accounts, and (hall by the faid Alderman be taken and al- lowed as a full and fufficient Difcharge for all and every fuch Sum and Sums of Money fuch Col- lectors (hall have received and paid to fuch Deputies refpectively as aforefaid ; and the faid feveral Collectors (hall within twenty Days next after the End of every three Months after their feverally faking upon themfelves the faid Office of a Collector produce and deliver to the Alderman of the faid Ward, or fuch Perfon as he (hall appoint to receive the fame, the Book and Books in which they entred the Sums by them feverally received on account of the faid Rates ; and (hall at the fame Time give and deliver to the faid Alderman, or fuch Perfon as he (hall appoint to receive the fame, a true Account in Writing of all fuch Perfons as (hall have neglected or refufed to pay the faid Rates and Affeffments, to the Intent that the fame may afterwards be recovered and levied. And to the End that the Payment of the faid Rates and Affeffments for the Purpofes afore- Incapaciuted'to f aid ma y be effectually enforced, Be it further enacted by the Authority aforefaid, That every Free- vote at Elec- man of London liable to pay the Rates and Affeffments aforefaid, who (hall have neglected or refufed aoni. to pay the faid Rates and Affeffments to the Perfon or Perfons authorized and impowered to collect and receive the fame (the fame having been lawfully demanded) or (hall have defired to be excufed from paying fuch Rates and Affeffments, (hall be under the fame Incapacity of voting at Elec- tions within the faid City of London, as any Perfon or Perfons now is or are, who do not pay their Scot and Lot to the feveral yearly Rates and Taxes, to which the Citizens of London are at this Time liable. And be it further enaiSted by the Authority aforefaid, That it lhall and may be lawful to and ^ca'cTareto try ^ or t ' ie Lord Mayor for the time being, or any two or more Juitices of the Peace for the faid City, offences againit t0 hear and determine any of the Offences, which are made fubject to and punilhable by any pecu- this Aft, niary Penalties directed to be levied by this Act : And the faid Lord Mayor, or fuch Juitices of the Peace, are hereby authorized and required, upon any Information exhibited, or Complaint made in that Behalf, within ten Days after fuch Offence committed, to fummon the Party or Parties ac- cufed, and the Witneffes on either Side; and in cafe the faid Party or Parties accufed (hall not ap- pear on fuch Summons (and after Oath made of the Commiffion of any the Offences above men- tioned by one or more credible Witnefs or Witneffes) to iffue a Warrant or Warrants for appre- hending the Party or Parties offending in the faid City of London ; and upon the Appearance of the Party or Parties accufed, or his or their Contempt in not appearing, upon the Proof of Notice given to proceed to the Examination of the Witnefs or Witneffes upon Oath (which Oath he or they are hereby authorized, impowered, and required to adminifter) and to give fuch Judgment, Sentence and Determination as (hall be juft and conformable to the Tenor and true Meaning of this Act; and where the Party or Parties accufed (hall be convicfted of fuch Offence, either upon fuch Infor- »nd to levy Pe- mation as aforefaid, or on Confeffion of the Party or Parties accufed, it (hall and may be lawful for naiues by Di- f Llc h L orc j Mayor or Juitices, to iffue a Warrant or Warrants for levying the pecuniary Penalties and Forfeitures fo adjudged on the Goods and Chatties of the Offender or Offenders, and to caufe Sale to be made thereof, in cafe they (hall not be redeemed in Five Days, rendring to the Party or Parties the Overplus (if any there be after deducting the reafonable Charges of fuch Di- ftrefs and Sale) upon Demand ; and in cafe any Perfon or Perfons (hall be fo conviSed as aforefaid, and no Goods or Chatties of fuch Perfon or Perfons fo offending can at the Time of fuch Con- viction be found, then and in fuch Cafe it (hall and may be lawful to and for the Lord Mayor or Juitices of the Peace before whom fuch Perfon or Perfons (hall be convicted as aforefaid, to com- mit fuch Offender or Offenders to the Houfe of Correction, there to be kept to hard Labour for any Time not exceeding the Space of three Months, or until fuch pecuniary Penalty or Penalties (hall be paid. eh?"' 23 ' 6 XIII. Provided neverthelefs, That it (hall and may be lawful to and for fuch Lord Mayor or Juftices of the Peace, from time to time (where they fee Caufe) to mitigate, compound or leffen any of the faid Forfeitures or Penalties as he or they in their Difcretion (hall think fit (fo as fuch Mitigation do not extend to remit above one Moiety of the Penalty or Penalties inflicted and directed to be levied by this Ad) and every fuch Mitigation (hall be a fufficient Difcharge to the Perfon offending refpectively, for fo much of the faid Penalty or Forfeiture as lhall be fo ieffened, mitigated or remitted.
