4 Yarn, and Woollen Manufactures from Ireland ;' Be it therefore further enacted by the Authority aforefaid, That all Policies of Infurance which, from and after the twenty-fifth Day of December one infurances oh thoufand feven hundred and thirty-nine, fliall be made on Goods and Merchandizes loaden or to be ^" i oUm Good * loaden on any Ship or Veflel bound from Great Britain or Ireland to Foreign Parts beyond the Seas, V ° which fliall afterwards appear to be Wooll or Woollen Yarn, or any other Species of Wooll before- mentioned, or Woollen Manufactures from Ireland, and all Policies ot Infurance which, from and after the twenty-fifth Day of December one thoufand feven hundred and thirty-nine, fliall be made on any Ship or Veflel bound from Great Britain or Ireland to Foreign Parts beyond the Seas, which (hall have on board any Wooll or Woollen Yarn, or any other Species of Wooll before-mentioned, or Woollen Manufactures from Ireland, fhall be deemed and taken to be null and void, notwithftanding any Words or Agreement whatfoever, which fliall be inferted in any fuch Policy of Infurance ; and nothing (hall be recovered by the aflured in either Cafe from the Infurer for Lofs or Damage, or for the Premium which (hall have been given as the Confideration for infuring fuch Goods and Merchandizes, Ship or Veflel ; any Law, Cuftom or Ufage to the contrary notwithftanding. XXXIV. And be it further enacted by the Authority aforefaid, That if any Action or Suit fhall be General Iflue. commenced againft any Perfon or Perfons for any thing done in purfuance of this Act, the Defendant or Defendants in fuch Action or Suit may plead the General Iffue, and give this Act and the fpecial Matter in Evidence at any Trial to be had thereupon, and that the fame was done in purfuance and by the Authority of this Act ; and if it fliall appear fo to have been done, the Jury (hall find for the Defendant or Defendants ; and if the Plaintiff fliall be nonfuited, or difcontinue his Action after the Defendant or Defendants fhall have appeared ; or if Judgment (hall be given upon any Verdict or De- murrer againft the Plaintiff, the Defendant or Defendants fhall and may recover Treble Cofts, and Treble Colts, have the like Remedy for the fame, as any Defendant or Defendants have in other Cafes by Law. An Act to rectify a Miftake in an Act; made in the fixth Year of the Reign of his late Ma- jefty King George, for preventing Frauds and Abufes in the publick Revenues of Excife, Cuftoms, Stamp-duties, Poft-office and Houfe- money, relating to the Condition of Bonds taken from Matters of Ships ; and to indemnify Perfons who have acted under the faid Miftake ; and alio to obviate a Doubt which has arifen upon an Act made in the feventh Year of his faid late Majefty's Reign, for the further preventing his Majefty's Sub- jects from trading to the Eaft-Indies under foreign Commiffions ; and for encouraging and further fecuring the lawful Trade thereto, with regard to Profecutions in Ireland in a fummary Way, for the fraudulent Importation of Eajt-India Goods into that Kingdom.

  • customable or prohibited Goods, pretending to be bound for foreign Parts, do frequently lie hovering

' on the Coaft of Ireland, with Intention to run the fame privately on Shore, as Opportunity offers, to ' the great Diminution of his Majefty's Revenue, and Ruin of fair Traders; and Ships or Veffels of the ' Burthen of fifty Tons, or under, do frequently lie hovering on that Coaft to take in Wooll not lawfully ' licenfed, to be brought into England, and other Staple Commodities of Ireland prohibited to be export- ' ed ; for the better preventing whereof it was declared and enacted by the faid Act, That from and ' after the firft Day of Augujl one thoufand feven hundred and twenty, where any Ship or Veffel of the ' Burthen of fifty Tons, or under, laden with cuftomable or prohibited Goods, (hould be found at An- ' chor, or hovering on the Coafts of Ireland, within two Leagues of the Shore, and not proceeding on ' her Voyage, Wind and Weather permitting, it (hould and might be lawful to and for any Officer or ' Officers of his Majefty's Cuftoms of that Kingdom, to go on board every fuch Ship or Veffel, and to ' take an Account of the Lading, and to demand and take Security from the Marter or other Perfon hav- ' ing or taking the Charge or Command of fuch Ship or Veffel in that Voyage, by his own Bond, by ' him to be entred into, unto his Majefty, his heirs and Succeffors, in fuch Sum or Sums of Money as ' fhould be treble the Value of fuch Goods then on board, with Condition that fuch Ship or Veffel, as
