Penalty Vvith the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent againft this Aft- Parliament affembled, and by the Authority of the fame, That if any Perfon or Perfons fhall, after 'the twenty-fourth Day of June o .e thoufand feven hundred and thirty- nine, erect, fet up, continue or keep, any Office or Place, under the Denomination of a Sale or Saks of Houfes, Land, Advow- fons, Prefentations to Livings, Plate, Jewels, Ships, Goods or other Tffngs, by way of Lottery, or by Lots, Tickets, Numbers or Figures, Cards or Dice ; or (hall make, print, advertife or publifn, or caufe to be made, printed, adwrtifed or publiihed, Propofals or Schemes for advancing fmall Sums cf Money by feveral Perfons, amounting in the whole to large Sums, to be divided among them by Chances of the Prizes in fome publick Lottery or Lotteries eftabliihed or allowed by Act of Parliament, or fhall deliver out, or caufe or procure 'to be delivered out, Tickets to the Perfons advancing fuch Sums, to intitle them to a Shire of the Money fo advanced, according to fuch Pro- Pofa's or Schemes ; or (hall expofe to Sale any Houfes, Lands, Advowfons, Prefentations to Livings, late, Jewels, Ships or other Goods, by any Game, Method or Device whatfoever, depending upon, or to be determined by any Let or Drawing, whether h be cut of a Box o; Wheel, or by Ca.ds or Dice, or by any Machine, Engine, or Device of Chance of any Kind whatfoever ; fuch Perfon or Perfons, and every or either of them, fhall, upon being convicted thereof before any one Juftke of the Peace for any County, Riding or Divifion, or before the Mayor, or other Juftice or Juftices of the Peace for any City or Town Coporate, upon the Oath or Oaths of one or more credible Witnefs or Witneffes (which faid Oaths the faid Juftices of the Peace, and Mayor, are hereby au- thorized, impowered and required to adminifter) or upon the View of fuch Juftice or Juftices, or the Mayor, Juftice or Juftices for any City or Town Coporate, or on the Confeifion of the Party or Parties accufed ; fhall forfeit and lofe the Sum of two hundred Pounds, to be levied by Diftrefs and Sale of the Offender's Goods, by Warrant under the Hands and Seals of one or more Juftice or Juftices of the Peace of fuch County, Riding, Divifion, City or Town, where the Offence dial! be the fame how to committed ; which faid Forfeitures, when recovered, after deducting the reafonabie Charges of fuch be levied and Proiecution, (hall go and be applied, one third thereof to the Informer, and the remaining two applied. thirds to the Ufe of the Poor of the Parifh where fi:ch Offence fhall be commuted, except, ng the i faid two thirds of fuch Forfeitures which fhall be incurred by, and recovered upon, any Perfon or i Perfons within the City of Bath, which faid two thirds fha'l go and be applied to and for the Ufe f and Benefit of the Poor refiding within the Hofpital or Infirmary lately erected for the Benefit of poor Perfons reforting to the faid City for the Benefit of the Mineral Waters, after deducting the Charges of Conviction as aforefaid. 4 II.
