- Peace are hereby impowered and required to adminifter; the Perfon fo convicted (hall, for every
' fuch Offence, over and above any former Penalties inflidted by any former Act or Acts of Pariia- ' merit made againft any private or unlawful Lotteries, fotfeit the Sum of five hundred Pounds, one ' third Part thereof to his Majefty, his Heirs and SuccefLrs, and one other third Part thereof to ' the Informer, and the remaining third Part thereof to the Poor of the Parifh where fuch O.ence ' lhall be committed ; the fame to be levied by Dlftrefs and Sale of the Offender's Goods, by War- ' rant under the Hands and Seals of fuch Juftices, before whom fuch Offender lhail be convicted ' as aforefaid ; and (hall alfo for every fuch Offence, by fuch Juftices be committed to the Cou ity ' Gaol, there to remain without Bail or Mainprize for the Space of one whole ear, and from thence ' till the Sum of five hundred Pounds fo forfeited as aforefaid, fhall be fully paid a..d fatisfied : ' Provided neyerthelefs, That any Perfon who fhall think himfelf or herfelf aggrieved by the Judg- ' meat or Determination of two or more fuch Juftices in any the Cafes aforefaid, ihall have Liberty ' to appeal to the next Quarter-Seffions to be held for the County, City or Place where fuch Judg- ' ment or Determination (hall be made or given; and that tie Judgment to be given by the Ju- 4 ilices of the faid next Quarter-Seffions fhall be final : And wnereas it is found by Experience, ' that the faid good and wholefome Laws have not effectually anfwered the good Ends, Intents and ' Purpofes, in and by the faid Acts defigned ; but that, contrary to the true Intent and Meaning ' of the faid recited Acts, feveral deceitful Games and Subscriptions are daily carrieJ on under t;.e

' ral Printers have printed, publifhed, or caufed to be printed and publiihed, Propoials or Schemes ' for the Sale of fuch Houfes, Lands, Plate, Jewels, Goods and other Things, to be determined ' by Raffles, by Mathematical Machines or Engines, and by other indirect Ways and Means, ' tending to evade the faid good and wholefome Laws before mentioned : And whereas feveral Per- ' fons have for many Years paft carried on and fet up certain fraudulent Games and Lotteries, ' to be determined by the Chance of Cards and Dice, under the Denomination of the Games of ' the Ace of Hearts, Pharaoh, Baffet and Hazard, and thereby defrauded feveral of his Majeft/'s ' Subjects, ignorant of the great Difadvantage Adventurers in the faid Games and Lotteries fo deno- ' minated the Gaines of the Ace of Hearts, Phjraoh, Baffet or Hazard, are under, fubject and liable c to : And whereas feveral Doubts have arifen, whether the faid Games of the Ace of Hearts, Pha- ' raoh, Baffet and Hazard, are within the Defcriptions of the Lotteries prohibite I by the faid reci- ' ted Acts of Parliament : And whereas g'-eat Difficulties have arifen upon the Methods of Convic- ' tion of the Offenders againft the faid Acts of Parliament ;' For Remedy whereof, and for explain- ing and making more effectual the faid Acts of Parliament, may it pleafe your moil Excellent Majefty that it ma/ be enacted; and be it enacted by the King's mort Excellent Majefty, by and 200 1. Penalty Vvith the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent againft this Aft- Parliament affembled, and by the Authority of the fame, That if any Perfon or Perfons fhall, after 'the twenty-fourth Day of June o .e thoufand feven hundred and thirty- nine, erect, fet up, continue or keep, any Office or Place, under the Denomination of a Sale or Saks of Houfes, Land, Advow- fons, Prefentations to Livings, Plate, Jewels, Ships, Goods or other Tffngs, by way of Lottery, or by Lots, Tickets, Numbers or Figures, Cards or Dice ; or (hall make, print, advertife or publifn, or caufe to be made, printed, adwrtifed or publiihed, Propofals or Schemes for advancing fmall Sums cf Money by feveral Perfons, amounting in the whole to large Sums, to be divided among them by Chances of the Prizes in fome publick Lottery or Lotteries eftabliihed or allowed by Act of Parliament, or fhall deliver out, or caufe or procure 'to be delivered out, Tickets to the Perfons advancing fuch Sums, to intitle them to a Shire of the Money fo advanced, according to fuch Pro- Pofa's or Schemes ; or (hall expofe to Sale any Houfes, Lands, Advowfons, Prefentations to Livings, late, Jewels, Ships or other Goods, by any Game, Method or Device whatfoever, depending upon, or to be determined by any Let or Drawing, whether h be cut of a Box o; Wheel, or by Ca.ds or Dice, or by any Machine, Engine, or Device of Chance of any Kind whatfoever ; fuch Perfon or Perfons, and every or either of them, fhall, upon being convicted thereof before any one Juftke of the Peace for any County, Riding or Divifion, or before the Mayor, or other Juftice or Juftices of the Peace for any City or Town Coporate, upon the Oath or Oaths of one or more credible Witnefs or Witneffes (which faid Oaths the faid Juftices of the Peace, and Mayor, are hereby au- thorized, impowered and required to adminifter) or upon the View of fuch Juftice or Juftices, or the Mayor, Juftice or Juftices for any City or Town Coporate, or on the Confeifion of the Party or Parties accufed ; fhall forfeit and lofe the Sum of two hundred Pounds, to be levied by Diftrefs and Sale of the Offender's Goods, by Warrant under the Hands and Seals of one or more Juftice or Juftices of the Peace of fuch County, Riding, Divifion, City or Town, where the Offence dial! be the fame how to committed ; which faid Forfeitures, when recovered, after deducting the reafonabie Charges of fuch be levied and Proiecution, (hall go and be applied, one third thereof to the Informer, and the remaining two applied. thirds to the Ufe of the Poor of the Parifh where fi:ch Offence fhall be commuted, except, ng the i faid two thirds of fuch Forfeitures which fhall be incurred by, and recovered upon, any Perfon or i Perfons within the City of Bath, which faid two thirds fha'l go and be applied to and for the Ufe f and Benefit of the Poor refiding within the Hofpital or Infirmary lately erected for the Benefit of poor Perfons reforting to the faid City for the Benefit of the Mineral Waters, after deducting the Charges of Conviction as aforefaid. 4 II.
