Secretary of the Colony to fend over to the Commiffioners of Trade Lifts yearly to be regiltred in England ; on Penalty of 50 1. Provifo. Extended to the Unitas Fratrum by 20 Geo. 2. c. 44. IV. And be it further enacted by the Authority aforefaid, That a Teftimonial or Certificate under the Seal of any of the faid Colonies, of any Perfons having refided and inhabited for the Space of feven Years or more as aforefaid within the faid Colonies or fome of them, to be fpecified in fuch Certificate together with the particular Time of Refidence in each of fuch refpective Colonies (whereof the Colony under the Seal of which fuch Certificate fhall be given to be One) and of his having taken and fub- fcribed the faid Oaths, and of his having made, repeated and fubferibed the faid Declaration, and in cafe of a Quaker of his having made and fubferibed the Declaration of Fidelity, and of his having taken and affirmed the Effect of the Abjuration Oath as aforefaid, and in the Cafe of a Perfon profefTing the Jewijh Religion, of his having taken the Oath of Abjuration as aforefaid, within the fame Colony, under the Seal whereof fuch Certificate fhall be given as aforefaid, fhall be deemed and taken to be a Sufficient Teftimony and Proof thereof, and of his being a natural born Subject: of Great Britain, to all Intents and Purpofes whatfoever, and as fuch fhall be allowed in every Court within the Kingdoms of Great Britain and Ireland, and alfo in the faid Colonies in America. V. And be it further enacted by the Authority aforefaid, That every Secretary of the faid refpective Colonies for the time being, fhall and is hereby directed and required at the End of every Year, to be computed from the faid Firft Day of June in the Year of our Lord one thoufand feven hundred and forty, to tranfmit and fend over to the Office of the Commiffioners for Trade and Plantations kept in the City of London or Weftminfler, a true and perfect Lift of the Names of all and every Perfon and Per- fons who have in that Year intitled themfelves to the Benefit of this Act, under the Penalty and Forfei- ture of fifty Pounds of lawful Money of Great Britain for every Neglect or ©million : All which faid Lifts fo transmitted and fent over, fhall from Year to Year be duly and regularly entered by the faid Commiffioners, in a Book or Books to be had and kept for that Purpofe in the faid Office, for publick View and Inspection as Occafion fhall require. VI. Provided always, and it is hereby further enacted, That no Perfon who fhall become a natural born Subject of this Kingdom by virtue of this Act, fhall be of the Privy Council, or a Member of either Houfe of Parliament, or capable of taking, having or enjoying any Office or Place of Truft with- in the Kingdoms of Great Britain or Ireland, either Civil or Military, or of having, accepting or taking any Grant from the Crown to himfelf, or to any other in Truft for him, of any Lands, Tenements or Hereditaments within the Kingdoms of Great Britain or Ireland ; any thing herein before contained to the contrary thereof in any wife notwithftanding. CAP. VIII. An Acl to explain and amend an A£t made in the firft Year of the Reign of her late Ma- jefty Queen Anne, intituled, An ASi for the more effectual preventing the Abufes and Frauds of Perfons employed in the working up the Woollen, Linen, Fujlian, Cotton and Iron Manufac- tures of this Kingdom ; and for extending the faid Aft to the Manufactures of Leather. WHEREAS by an Act made in the firft Year of the Reign of her late Majefty Queen Anke, intituled, An Acl for the more effectual preventing the Abufes and Frauds of Perfons employed in the working up the Woollen, Linen, Fujlian, Cotton and Iron Manufactures of this Kingdom ; it is, amongft other Things, enacted, That if any Perfon or Perfons employed in working up of Woollen, Linen, Fuftian, Cotton or Iron Manufactures, fhould embezil or purloin any Wetts, Thrums, or Ends or Yarn, or any other Materials of Wooll, Hemp, Flax, Cotton or Iron, with which he, fhe or they was, were or fhould be intrufted to work upon, or fhould reel fhort or falfe Yarn, and fhould be there- of convicted in fuch Manner as in and by the faid Act is prefcribed, fhould forfeit double the Value of the Damages done, for the Ufe of the Poor of the faid Parifh ; and in cafe the Offender or Offen- ders to be convicted as in the faid Act is mentioned, fhould neglect or refufe to pay their Forfeiture or Forfeitures, that then it fhould and might be lawful to and for one Juftice of the Peace of the County where fuch Offence fhall be committed, to caufe the faid Offender to be committed to the Houfe of Correction, until Satisfaction fhould be made ; and in cafe it fhould appear to the faid Juftice, that the faid Offender was not able to make Satisfaction, then the faid Offender is to be there publickly whip- ped, and kept to hard Labour for any Time not exceeding fourteen Days : And by the faid Act it is further enacted, That every Perfon buying or receiving any Wefts, Thrums, or Ends of Yarn, or any other Materials of Wooll, Hemp, Flax, Cotton or Iron, and being thereof lawfully convicted in Manner as in the faid Act is mentioned, fhall fuffer the like Penalties and Forfeitures as one convicted purfuant to the faid Act for purloining and embezil ing of the faid Materials ; which faid Act was made temporary only ; but being by Experience found to be beneficial, was, by another Act paffed in the ninth Year of the Reign of her faid late Majefty, made perpetual : And whereas Doubts have arifen, whether the before-mentioned Claufes in the faid Act of the firft Year of the Reign of her faid late Majefty extend to the embeziling Woollen, Linen, Fuftian, Cotton and Iron Manufactures, ac- tually wrought or made up into merchantable Wares, and whether the faid Forfeiture of double the Va- lue of the Damages done, when recovered,- fhould be applied for the Ufe of the Poor of the Parifh where the Perfons injured fhall reflectively live, or for the Ufe of the Poor of the Parifh in which the Offence has been or fhall be committed : And whereas the Forfeitures and Penalties to which Offen- ders are fubjected by the recited Act, have proved ineffectual to anfwer the Purpofes thereby intended;' Now to explain and amend the faid Act, fo far as the fame relates to the Matters aforefaid, be it enact- ed
