' T 7 HE RE AS his Majefty hath been called on by the repeated Infults, Depredations, and Cruel- { W ties of the Spaniards, to make ufe of the Power which Gcd hath given him, for vindicating the ' Honour and Dignity of his Crown, and for fecuring to his Subjects the undoubted Rights and Pri- ■' vileges of Navigation and Commerce to which they are juftly intitled ; and in order thereunto his ' Majefty upon juft and honourable Grounds hath thought fit to declare War with Spain; and it being ' highly requifite and neceffary to prohibit and reftrain all Commerce between his Majefty's Subjects and ' thole of Spain in Europe, and to enforce fuch Prohibitions and Reftrictions by fevere Penalties ;' Be it therefore enacted, &c. " No Goods to be imported from Old Spain, during the War, on Penalty of forfeiting Ship and Goods, " and Treble the Value. Except what are lodged at Minorca or Gibraltar, before i May 1740, and " brought home on BritiJI) Bottoms before 24 June 1740." HI. And to prevent collufive, fraudulent, or clandestine Captures by Privateers ; Be it enacted by the Authority aforefaid, That if any Privateer or Privateers (hall by Confent, or clandeftinely, or by Col- lufion, feize or take any Ship or Veffel whatfoever; upon due Proof thereof to be made in the Court of Admiralty, the Bail or Recognizance given in the faid Court by or on the Behalf of fuch Privateer at the taking out of his Commiffion fhall be pronounced and declared by the faid Court to be forfeited, -and the Privateer Ship itfelf, with all her Appurtenances, Guns, Tackle, Ammunition, and Goods on Board, as alio the Merchant Ship or Veffel that (hall be fo taken, with her Appurtenances and Lading, upon Proof as aforefaid, fhall be condemned as good and lawful Prize ; and after Condemnation and Sale thereof the Perfon or Perfons difcovering and profecuting the fame fhall have one Third Part of the net Produce for his or their Encouragement. An Act for continuing the feveral Laws therein mentioned ; relating to the Premiums upon the Importation of Mails, Yards and Bowfprits, Tar, Pitch and Turpentine ; to Britijh •made Sail Cloth, and the Duties payable on Foreign Sail Cloth •, to the Greenland, and to the Whale Fiihery : For granting a further Bounty for all Ships employed in the Whale Fiihery during the prefent War : For exmpting Harponeers, and others employed in the Greenland Fifhery Trade, from being impreffed : And for giving further Time for the Payment of Duties omitted to be paid for the Indentures and Contracts of Clerks .and Apprentices. ' ~K7 H E R E A S the Laws herein after mentioned are found to be very ufeful and beneficial to the ' V V Publick, and are fo near expiring that it is fit they fhould now be continued ; Be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That fo much of an Act made in the fecond Year of the Reign of his prefent Majefty, intituled, An AQ for better Prefervation of his Majeffs Woods in America, and for the Encourage .of the Importation of Naval Stores from thence ; and to encourage the Importation of Majls, Yards a-ui fpritsfrom that Part of Great Britain called Scotland; as relates to the Premiums upon Malts, Yards and Bowlprits, Tar, Pitch and Turpentine, which was made to be in Force from the twenty- ninth Day of September one thoufand feven hundred and twenty-nine, for the Space of thirteen Years, and to the £r.d of the then next Sefiion of Parliament, fhall be, and the fame is hereby continued from the Time there- in limited for the Expiration thereof, unto the twenty-fifth Day of December one thoufand feven hun- dred and fifty, and from thence to the End of the then next Sefiion of Parliament. II. And be it further enacted by the Authority aforefaid, That an Act made in the ninth Year of the Reign of his prefent Majefty, intituled, An Ac! for further encouraging and regulating the Manufailurc of Britifh Sail Cloth, and for the more cffetlual fecuring the Duties now payable on Foreign Sail Cloth impirt- ed into this Kingdom ; which was to be in Force from the twenty-fourth Day of June one thoufand (even hundred and thirty-fix, for the Space of five Years, and to the End of the then next Sefiion of Parlia- , ment, ihall be and the fame is hereby continued from the Time therein limited for the Expiration thereof, unto the twenty-fifth Day of December one thoufand feven hundred and fifty, andfromther.ee to the End of the then next Sefiion of Parliament.
