And it is hereby further enacted, That from and after the faid firfl Day of May, in cafe any anion. ° e " Cloth-maker, Searcher, Mill-man or any other Perfon, (hall be profecuted for any of the Offences men- tioned in this or either of the faid former Acts, after the Cloth, relating to which fuch Profecution (hall be commenced, fhali be fold to the Merchant or Cloth-buyer, every fuch Merchant or Cloth-buyer fhall, and he is hereby required and obliged, on Demand of the Perfon fo profecuted, to produce fuch Cloth, unleisjt (hall appear on the Oath of fuch Merchant or Buyer, or the Perfon who packed the fame, to be made before one or more Juftice or Juftices of the faid Riding^ or any Corporation within the fame (which Cath fuch Juftice or Juftices is and are hereby required to'adminifter^ntf/j) that fuch Cloth was then dreffed, preffed and packed up, in order to be fern away from fuch Merchant or Buver, to the In- tent that the fame, and the Matter of fuch Complaint, may be infpected, inquired into and examined- and in cafe the Merchant, Buyer or Owner of fuch Cloth (hall refufe to produce the fame as aforefaid, fuch Merchant, Buyer or Owner fhall forfeit and pay, for every fuch Offence, the Sum of five Pounds, to be levied, recovered and applied as aforefaid. Extent of this XVI. And be it further enacted by the Authority aforefaid, That this Act, and all the Penalties and Aft# Claufes therein contained, fhall extend to all Woollen Broad Cloth which (hall be made, milled, dreffed or expofed to Sale in the Weft Riding of the County of York, except White Cloth, after the fame- (hall be put into hot Water in order to be died. Informations to XVII. And it is hereby further enacted by the Authority aforefaid, That all Informations on which SpTys, eWt m an Y Conviction fhall be made of any Offence by virtue of this Act, (hall be made within five Days next after the Difccvery of the fame Offence, and not otherwife. ' XVIII. And whereas there is now in the Hands of the Treafurer of the Weft Riding of the County
- of York, a eonfiderable Sum of Money, which hath arifen by and out of the Duties granted by the
' faid former Aits, for the damping and meafuring of Broad Cloth;' Now it is hereby further enacted by the P Dude1 n a nd the Authority aforefaid, That the Treafurer of the faid Weft Riding for the Time being, (hall out of Penalties. the Money remaining in his Hands, and which fhall hereafter be received by him on Account of the faid Duties, and of the Duties and Penalties herein before directed to be paid to fuch Treafurer as aforefaid,, in the firft Place pay the Charges and Expences attending the palling this Act, and fhall afterwards pay and apply the faid Duties and Penalties, as the fame fhall come in and be received, to fuch Ufes and Purpofes as the fame are directed to be paid and applied by virtue of this or the faid two former Acts, or either of them. Juftices to fettle XIX. And it is hereby further enacted by the Authority aforefaid, That after all the Money to be the Duties. expended in and about the obtaining this Act fhaH be totally paid off and difcharged, it fhall and may be lawful to and for the Juftices of the Peace for the faid Weft Riding, at their General Quarter-SelTions held next after E after, to make Orders for the increafing or diminifhing the Rates and Duties to be paid for meafuring, damping and fealing of Cloth, fo as the fame fhall never exceed four Pence for a Whole Cloth, and two Pence for an End or Half Cloth.
