I. 11 Act for continuing the Duties upon Malt, Mum, Cyder and Perry, in that Part of Great Britain called England; and for granting to his Majefty certain Duties upon Malt, Mum, Cyder and Perry, in that Part of Great Britain called Scotland; for the Service of the Year one thoufand feven hundred and forty- two. WHEREAS by an Act pafTed in the laft Seffion of Parliament, intituled, An Ail for the Prcfervi- p ream b!e, «- iion of the P ublick Roads in that Part of Great Britain called England, reciting, That whereas an citing the ABs Act was made in the fifth Year of the Reign of his late Majefty King George the Firft, intituled, An Ail nGeo. 1.0.42, for making more effectual the fever al Ails paJJ'ed for repairing and amending the Highways of this Kingdom, §• 6i and 'which had proved infufficient for that Purpofe, by reafon that the faid Acl: extended to fuch Waggons s Geo ' c ' **' and Carts only as travelled for Hire, and by reafon of many Difficulties in the Manner of convicting and punifhing the Offenders againft the fame; it was enacted, That the faid Ait, and all and fingular the Claufes, Penalties, and Forfeitures therein contained, fhould extend, and be conftrued to extend to all Waggons and Carts, and to the Owners and Drivers thereof, his and their Horfes, with the Geers, Bri- dles, Halters, and Accoutrements, whether travelling for Hire or not for Hire, or in any Manner what^ foever, and that, all and every Perfon and Perfons who fhould offend againft either of the (aid Acts, fhould for every fuch Offence (being thereof Convicted as therein is mentioned) feverally forfeit, befubjectand liable to the refpedtive Penalties and Forfeitures in the faid Act of the fifth Year of his late Majefty con- tained, to be levied, recovered, and applied in fuch Manner, and to fuch Ufes, as in and by the faid Act is mentioned and directed, and his and their Horfes, with the Geers, Bridles, and Accoutrements, fhould, for the Space of three Days next after fuch Offence, be and remain fubject and liable to fuch Seizures and DiftrefTes, and for the Ufe and Benefit of fuch Perfon and Perfons, as they would or might have been, had they been feized or diftrained in the Fact during the Commiffion of fuch Offence : And whereas the extending fuch Part of the faid Act as relates to the Breadth of the Streaks or Tire with which the Wheels of Waggons are to be bound, or to the Nails with which they are to be fet or faftened on to fuch Wag- gons as do not travel for Hire, or to the Owners or Drivers thereof, has been found inconvenient to Far- mers and others, and highly detrimental to the Markets of this Kingdom ;' Be it enacted by the King's Covta^lur Ifig&s
