Provided always, and be it enacted by tbe Authority aforefaid, That whatever Monies fhall be repaid by the ne f jn* uct j out f t he laid Sinking Fund, fliall from Time to Time be replaced by and out of the firir Supplies to be then after granted in Parliament. XXXVII. Provided always, and be it enacted by the Authority aforefaid, That in cafe there fliall be any Surplus or Remainder of the Monies arifing by the faid Rates or Duties, after the faid feveral and re- fpe&tve Annuities, and all Arrears thereof are fatisfied, or Money fufficient fhall be referved for that Purpofe ; Inch Surplus or Remainder (hall from Time to Time be referved for the Difpofition of Parlia- ment, and fliall not be ill'ued but by Authority of Parliament, and as fhall be directed by future Act or Acts of Parliament ; any Thing in any former or other Act or Acts of Parliament to the contrary not- withftanding. XXXXV1II. Provided alfo, and it is hereby enacted by the Authority aforefaid. That at any Time upon one Year's Notice to be printed in the London Gazette, and affixed upon the Royal Exchange m London, by Authority of Parliament, at any of the Half-yearly Feall Days for Payment of the laid re- fpective Annuities, or either of them, and upon Repayment by Parliament of the refpective principal Sums for which the faid refpective Annuities, or either of them, fhall be payable to Inch refpective Per- fons or Corporations as fliall be intitled to the fame Annuities, and alfo upon full Payment of all Ar- rearages of the fame Annuities ; then, and not till then, the faid refpective Annuities fliall ceafe and de- termine, and be underflood to be redeemed, and from and after fuch Redemption, the Monies arifing from the faid Rates or Duties fliall not be ilTued or applied to any other Ufe or Purpofe, but as fhall be directed by future Act or Acts of Parliament; any Thing in this or any former Act or Acts of Parlia- ment to the contrary notwithstanding; and that any Vote or Refolution of the Houfe of Commons figni- fied by the Speaker in Writing, to be infertcd in the London Gazette, and affixed on the Royal Exchange in London as aforefaid, fliall tie deemed and adjudged to be fufficient Notice within the Words and Meaning of this Act. XXXIX. And it is hereby enacted by the Authority aforefaid, That if any Perfon or Perfons fliall at any Time or Times be fued or profecuted for any Thing by him or them done or executed in purfuance of this Act, or of any Matter or Thing in this Act contained, fuch Perfon or Perfons lhall and may plead the General IiTue, and give the Special Matter in Evidence for his or their Defence ; and if upon the Trial a Verdict fhall pafs for the Defendant or Defendants, or the Plaintiff or Plaintiffs fliall become nonfuited, then fuch Defendant or Defendants fhall have treble Colts to him or them awarded againll fuch Plaintiff or Plaintiffs. CAP. XV. An Aft for the more eafy and effectual Conviction of Offenders found at large within the Kingdom of Great Britain, after they have been ordered for Tranfportation. ' 1TTHEREAS many Felons and other Offenders already ordered-, or hereafter to be ordered for ' W Tranfportation, or who have upon certain Conditions agreed to tranfport themfelves, either for 4 .Life, or for fome Term or Number of Years, according to Law, have already or hereafter may come 4 on Shore, or return into Great Britain, before they have been actually tranfported or tranfported them- ' ftlves to America, or have already, or may hereafter break Gaol or efcape before fuch Tranfportation :
- And whereas many of the Offenders aforefaid have efcaped by Reafon of the great Expence that is ne-
' ceffary for profecuting fuch Offenders to Conviction ;' For Remedy whereof may it pleafe it your molt Excellent Majefty that it may be enacted, And be it enacted by the King's molt Excellent Majelty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That if any Felon or other Offender already ordered, or hereafter to be ordered for Tranfportation, or who hath already or hereafter fliall agree to tranfport him or herfelf on certain Conditions, to any of his Majefty's Colonies and Plantations in Ame- rica, either for Life, or any Number of Years, fliall be afterwards at large within any Part of the King- dom of Great Britain, without fome lawful Caufe, before the Expiration of the Term for which he or fhe were fo ordered to be tranfported, or had fo agreed to tranfport him or herfelf; all and every fuch Per- fon or Perfons being thereof lawfully convicted, fliall fuffer Death as in Cafes of Felony, without Benefit of Clergy. II. And be it further enacted by the Authority aforefaid, That every fuch Offender or Offenders fhall be tried for any of the Offences aforefaid, before fuch Judges, and in fuch Manner, and the fame Evi- dence made ufe of, for his or her Conviction, as is directed in and by the Statute made in the ftxth Year of the Reign of his late Majefty King George the Firft, intituled, An Ail for the further preventing Rob- bery and Burglary, and other Felonies, and for the more effectual Tranfportation of Felons, in Cafes of Felons returning from Tranfportation.
