And it is hereby further enacted by the Authority aforefaid, That out of the Monies arifmg by virtue of this Act, there fliall yearly, and every Year, be feparated and kept apart, at the faid Receipt of Exchequer, the Sum of twenty-two thoufand five hundred Pounds ; which faid Sum of twenty-two Yearly Fund of thoufand five hundred Pounds fliall be, and is hereby declared to be, a yearly Fund for anfwering and 12,5001. for paying the Annuities aforefaid; and fliall yearly, and every Year, be equally divided amongft the (aid P**"?? Book of Regiftiy for fuch Orders, without Fee or Charge ; and after fuch Entry made, fuch Aflignmcnt fliall intitle fuch Affignee, his, her or their Executors, Adminiftrators, and Afligns, to the Benefit thereof, and Payment thereon ; and fuch Affignee may in like Manner affign again, and Co tot'm tjuotlcs ; and afterwards it fliall not be in the Power of fuch Perfon or Perfons, who fliall make Affignee may fuch Aflignment, to make void, releafe, or difcharge the fame, or any Monies thereby due, or any ai'fign again tc«  Part thereof. And be it further , enacted by the Authority aforefaid, That in cafe any Guardian or Truftee, Infants beiiig having the Difpofal of the Money of any Infant, fliall, in purfuance of the Power herein before given to Purchafcis of him or them in that Behalf, have advanced and paid to fuch Receiver or Receivers as aforefaid, any te " T 1C ^'» Sum or Sums of Money of fuch Infant for the Purchafe of ten Tickets, or more, in the faid Lottery, in fntitiedTo'tbe' Manner herein directed, and fliall thereupon, within the Time herein before appointed for naming of Benefit. Lives, name the faid Infant to be a Nominee, fuch Infant, upon Payment of fuch Sum or Sums of Mo- ney, fliall become a Contributor within the Meaning of this Act, in fuch Manner and Proportion, as any other Contributor; and the faid Guardians and Truftees, as to the Sum fo advanced by them, are hereby difcharged. XLVI. And for preventing all Frauds in receiving any Share of the yearly Fund hereby appointed to AbfentNominees be fet apart as aforefaid ; Be it further enacted by the Authority aforefaid, That every Contributor, his, to he certified her or their Executors, Adminiftrators, Afligns, or Agents, upon their demanding any half yearly Pay- Ilvln B- ment of his, her or their refpective Shares of the faid yearly Fund (unlefs the Nominee appear in Perfon at the faid Receipt) fliall, produce a Certificate of the Life of his, her or their refpective Nominee, figncd by the Minifter and Churchwardens of the Parifti where fuch Nominee fliall be then living upon the Day when the faid half yearly Payment fhall become due (if fuch Nominee fliall be then refiding in that Part of Great Britain called England-, Dominion of Wales, or Town of Berwick upon Tweed) or other- wife, it fhall and may be lawful to and for every fuch Contributor, his, her or their Executors, Admi- ftrators, or Afligns, at his, her or their Election, to make Oath of the Truth of his, her or their refpec- tive Nominee's Life, upon the Day when the faid half yearly Payment fliall become due, before one or more Juftices of the Peace of the refpective County, Riding, City, Town, or Place, wherein fuch Per- fon, at the Time of making fuch Oath, fliall refide ; and in like Manner, every fuch Contributor, his, her or their Executors, Adminiftrators, or Afligns, or Agents, whofe Nominee fhall refide in any Town or Place, being extraparochial, upon the Day when any of the faid half yearly Payments fliall become due, fhall make a like Oath before any fuch Juftice or Juftices aforefaid, of the Life of fuch Nominee on that Day (which Oath the faid Juftice or Juftices are hereby impowercd to adminifter) and fuch Juftice or Juftices fliall make a Certificate thereof, for which Oath and Certificate no Fee or Reward fliall be de- manded or paid ; and the faid Certificates fliall be filed in the Office of the Auditor of the faid Receipt of Exchequer; and if any Perfon fliall be guiltyof a falfe Oath, or fliall forge any Certificate, touching the Penaltyona falfs Premifies, and be thereof lawfully convicted, fuch Perfon fliall incur the Pains and Penalties to be in- ° atl > or forged Aided upon Perfons who fliall commit wilful Perjury and Forgery ; and in cafe any Nominee (hall, at Certificate, the Time of fuch Demand, be refident in that Part of Great Britain called Scotland, or in the Kingdom of Irelatid, and any one or more of the Barons of the Exchequer there, for the Time being, fliall certify that, upon Proof to him or them made (which Proof he and they is and are hereby authorized and re- quired to take in a furamary Way) it doth feem probable to him or them, that the faid Nominee is living (which Certificate is to be given, and Examination made, without Fee or Charge) the faid Certificate being filed as aforefaid, fliall be a fufficient Warrant for making the faid half yearly Payments to the refpective Contributors, their Executors, Adminiftrators, or Afligns ; and in cafe any fuch Nomi nee .Nominees b c - fliall, at the Time of fuch Demand, be refident in any Parts beyond the Seas, the Proprietors of all fuch yond Suas how Orders, or their Agents, fliall produce Certificates of the Life of his, her or their refpective Nominees, tobecetified under the Hand of the BritiJI) Minifter refiding at the Place where any fuch Nominee ftiafl bs living, lmn 3- upon the Day when the faid half yearly Payment fliall become due ; and in cafe no Britijh Minifter fhall refide at the Place where any fuch Nominee fhall live,, then the faid Proprietors of fuch Orders, or their 4 G 3 Agents,
