- according to their refpective Parts, Shares and Interefts in the faid yearly Fund, and in the faid Prin-
- cipal Stock of three millions two hundred thoufand Pounds : And whereas the laid United Company
- of Merchants of England trading to the Eajl-Indies, by Virtue of the laid Acts of Parliament and
' Charters, ibme or one of them, claims to He a Body Politick and Corporate, and to have perpetual ' Succeftion, and claim alfo the whole and fole Trade, exclufive of all others, in, to and from the
- Eajl-Indies, and Limits aforefaid for ever : But neverthelefs the faid United Company being willing,
- that all Doubts touching the Continuance of their Corporation, and of their Right to the whole and
' fole Trade within the Limits aforefaid for ever, after the Redemption of the faid yearly Fund fhould
- be removed, were and are contented, and accordingly have confented and agreed, to fubject their
' Right and Claim to the faid whole, fole, and exclufive Trade, to be redeemable or determinable by ' Parliament, in Manner herein after mentioned ; and have confented and agreed that their prefent An-
- nuity or yearly Fund of one hundred and fixty thoufand Pounds, payable in refpect of their faid
' Capital Stock or Debt of three millions two hundred thoufand Pounds from the Publick, be from and ' after the twenty-ninth Day of September one thoufand feven hundred and thirty, reduced to an
- Annuity or yearly Fund of one hundred twenty-eight thoufand Pounds, redeemable by Parliament
- on one Year's Notice to be given after the twenty-fifth Day of March one thoufand feven hundred
- and thirty-fix, on Payment to them of their faid whole Capital Debt, with all Arrears in refpect
' thereof, in Manner hereafter mentioned, and were and are moreover willing, and have confented and ' agreed to pay into his Majefty's Exchequer, on or before the twenty-fourth Day of December one ' thoufand feven hundred and thirty, the full Sum of two hundred thoufand Pounds, without any 'Intereft or Addition to their faid Capital Stock or Debt for the fame, to be applied as hereafter ' mentioned, but upon fuch'Terms, Conditions, Grants, Confirmations, Articles and Provilions never-
- thelefs as herein after are made, granted, provided, declared and enacted : ' Now for the preventing,
quieting and determining any Doubts, Difputes or Difficulties that have been, or may be raifed con- cerning the Right or Claim or the United Company of Merchants of England trading to the Eq/l- Indies, to the whole and fole Trade to the Eajl-Indies, exclufive of all others, and for perfecting and- ccm- pleating the feveral Matters and Things fo as aforefaid confented to by the faid Company, and to the End the faid Company may be able to fupport and carry on the Trade to the Eajl-Indies with Credit and Security, and improve the fame for the Benefit of this Nation, we your Majefty's moft dutiful and loyal Subjects, the Commons of Great Britain in Parliament affembled, do moft humbly befeech your Majefty that it may be enacted, and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Par- liament affembled, and by the Authority of the fame, That the faid United Company, in Purfuance of United Com- their before recited Agreement, fhall and they are hereby required and enjoined to pay into the Re- P ar| y t0 pay ceipt of his Majefty's Exchequer, on or before the twenty-fourth D a y of December one thoufand feven the'Exdiequer hundred and thirty, the full and entire Sum of two hundred thoufand Pounds of lawful Money of by 14 Dec. 1730. Great Britain, to be applied towards the Supplies granted to his Majefty for the Service of the Year one -thoufand feven hundred and thirty, for which no Intereft fhall be ever payable, nor fhall any Addition be made fo their Capital Stock or Debt from the Publick on Account of the fame, nor fhall the fame; or any Part thereof, be repayable to the faid United Company. II. And be it further enacted by the Authority aforefaid, That in cafe the faid United Company fhall On Failure of make Failure in Payment of the faid Sum of two hundred thoufand Pounds, or any Part thereof, at the Payment may Time before appointed for Payment thereof, then the Money whereof fuch Failure in Payment fhall be be fued " made, fhall and may be recovered in his Majefty's Name, for the Ufes and Purpofes aforefaid, by Action of Debt or upon the Cafe, Bill, Suit or Information, in any of his Majefty's Courts of Record at Wejlminjler, wherein no Effoin, Protection, Wager of Law, or more than one Imparlance fhall be' granted or allowed -, in which Action, Bill, Suit, or Information, it fhall be lawful to declare, that the faid United Company of Merchants of England trading to the Eajl-Indies, are indebted to his Majefty the Monies whereof they (hall have made Default in Payment, according to the Form- of this Statute, and have not paid the fame, which fhall be fufficient ; and in or upon fuch Action, Bill, Suit or Infor- mation, there (hall be further recovered to his Majefty's Ufe, againft the faid Unity Company, Da- mages after the Rate of eight Pounds per Centum per Awium, for the Monies fo unpaid contrary to this Act, befides full Cofts of Suit ; and the faid United Company, and their Capital Stock and Fund, (hall be and are hereby made fubject and liable thereto. III. Provided always, That in cafe the Commiffioners of his Majefty's Treafury now or for the Time On Advance of being, or any three or more of them, or the Lord High Treafurer for the Time being, lhall judge the Money a it convenient for his Majefty's Service, that all or any Part of the faid Sum of two hundred thoufand an'owedVf'-u Pounds fo as aforefaid appointed to be paid by the faid United Company, fhould be paid in Advance per Cent. by them on any Day or Days before or fooner than the laid twenty-fourth Day of December one thou- fand feven hundred and thirty, before appointed for Payment thereof, and the faid United Company (hall voluntarily confent to pay the fame in Advance accordingly ; then and in every fuch Cafe the faid Commiffioners of the Treafury, or the Lord High Treafurer, may and have hereby Power to sllow to the fame United Company, out of every fuch Payment in Advance, a Rebate or Difcount after a Rate not exceeding three Pounds pir Centum per Jnniun upon the Monies fo paid in Advance, from the refpective Day or Days of fuch Payment, to the Day on which the fame is herein before appointed to be paid as aforefaid. After 20 Sept. IV..
